This letter is to notify you that the Washington Regional Office of the Division of Water Quality
has received your response letter regarding the violation of permit conditions at the Hatteras Island Plaza.
Upon review and consideration of the information submitted, please note that the Washington
Regional Office will not proceed with any further enforcement actions for this violation. Please be advised
that this decision in no way prohibits this Office from issuing further enforcement actions if any future
violations result on or at this site.

1. A signed copy of the Operation & Maintenance Agreement is not in the files per permit requirements.
2. The drainage area is not consistent with the current permit. Two additional buildings have been built that have not been included in the
permit, nor had a modification been completed.
3. The built upon area has changed due to the addition of the two aforementioned buildings being constructed that were not on the original
plans.
4. It was impossible to determine the slope ratio and if erosion was present due to the excessive overgrowth of large stemmed vegetation. It
is part of your routine Operation and Maintenance to keep the vegetation properly managed.

This letter is to notify you that staff of the Washington Regional Office of the Division of Water Quality
conducted a compliance inspection at the stonnwater treatment facilities serving Hatteras Island Plaza on March 1,
2007. A copy of the inspection report is included for your review. Please note the concerns indicated under the
comments section of the report. This inspection was conducted in connection with your request for renewal of permit
SW7970115. This inspection revealed that the permitted wet detention pond has not been satisfactorily maintained
which is a violation of permit SW7970115.
Specifically, the inspection revealed that there is excessive large stemmed growth and vegetation around the
pond. Part II 2., 3., and 4 of permit SW7970115 issued April 10, 1997 addresses the operation and maintenance
requirements for the wet detention ponds. These conditions require that the facilities be properly maintained and
operated at all times and that records of the maintenance activities must be kept and made available upon request.
Please submit a proposed list of maintenance activities and schedule within 30 days of receipt of this letter for
cleaning and returning the wet detention ponds to their original design. All work should be completed no later than
May 31, 2007. Please be advised that any violation of the conditions contained in permit SW7970115 may subject
you to appropriate enforcement actions in accordance with North Carolina General Statute 143-215.6A which
provides that a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per violation may be assessed
against a person who fails to comply with permit conditions.
