Dear Mr. Broadway:
The Washington Regional Office received a Coastal Stormwater Permit Application for the New
Retail Store No. 6339 - Edenton project on June 3, 2013. A preliminary review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
Since the project is located within 5 miles from the Edenton Airport, it is
necessary to inform the Airport authorities that this project will utilize a wet
detention basin as a BMP of your choice. It is not clear from the submitted
application if that was done or not. Please clarify.
A detailed BMP planting plan not provided.
It appears that the 3" orifice will drain the required volume in less than 2 days.
Please check the size of orifice calculations by using the Section 3 of the BMP
Manual (orifice equation). Also make sure to sign and seal the Calculations.
The requested information should be received in this Office prior to June 17, 2013, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for
a time extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.

Dear Ms. Ballard:
As authorized, Mr. Benjamin V. Wilson, P.E. of ATC Associates visited the site
observed the entire site and the low lying areas. A preliminary determination was made
of the streams and wetlands in accordance with the following methods:
• Wetlands for 404 Permitting - A determination was made of the wetlands based
on the Corps of Engineers (COE) 1987 Wetlands Manual using the routine
method which is the currently accepted methodology.
• Streams for 404 Permitting by the (COE) - A preliminary determination was
made of the streams based on our experience with the most recent methodology
used by the US Army Corp of Engineers.
• Streams for 401 Permitting and Determination of Stream Delineation by
NCDENR- A preliminary determination was made of the streams using the North
Carolina Division of Water Quality (NCDWQ) stream determination form method.
The site is located in the drainage area of an unnamed tributary to Queen Anne Creek
which drains directly into the Albemarle Sound in the Chowan River Basin. The site is
NOT shown as having a stream on either the Edenton, NC 7.5 Minute USGS
quadrangle or the Chowan Perquimans County SCS Soil Survey (see attached maps).

STREAM EVALUATION: Based on the literature review and the site investigation no
streams were noted at the site.
WETLANDS EVALUATION: The delineation of wetlands at the site was difficult
however conditions at the site do not support a determination of wetlands for the
following reasons.
Hydrophitic Vegetation Indicators — The site has been planted in loblolly pines and
the other plants growing at the site do not conclusively support a determination of
wetlands.
Hydric Soil Indicators - The soil survey indicated that the soils at the site are Roanoke
Silt Loam. Roanoke Silt Loam is listed as a hydric soil on the NC Hydric Soils List, and
the field indicators support a determination of F3 (depleted matrix) in accordance with
the NRCS "Field Indicators of Hydric Soils in the United States" version 7.0, 2010 and
the Regional Supplement to the Corps of Engineers Wetland Delineation Manual:
Atlantic and Gulf Coastal Plain Region (Version 2.0) Environmental Laboratory U.S.
Army Corps of Engineers November 2010. However, there was a lack of significant
redoximorphic features in the soil down to a depth of at least 20 inches.
Wetland Hydrology Indicators — The area topography, the soil moisture and
groundwater indicators do not support a shallow water table. Also lack of primary and
secondary indicators of wetland hydrology do not support a determination of wetlands
on the site.

'Chowan River Basin
Based on preliminary plans for development of the site we anticipate the development at
the site can minimize impacts at the site. Maps with approximate locations of the wetlands
and streams on the site and the data point locations are enclosed with this letter.
A site visit to verify the determinations will be required by NCDWQ and/or the USACE.
Prior to the site visits an agent authorization form will be required. An agent authorization
form is attached that has been executed by the owner. I will be glad to contact the
regulatory agencies at the appropriate time to set up the field confirmation.

RIGHT -OF -ENTRY
This AGREEMENT is made by and between _f�rlZ:�An' L (hereafter referred to as
"owner") and the United States Army Corps of Engineers (hereafter referred to as "USACE").
The purpose of this AGREEMENT is to provide USACE with Right -of -Entry to the following described
premises: property situated along the north side of North Broad Street east of the intersection of Coke
Avenue —see attached map for specific project location .
Owner represents and warrants that it is the Owner of or otherwise has authority to grant a Right -of -Entry
to the above -described premises.
Owner grants USACE, its agents, subcontractors and employees the right to enter upon the above -
described premises, as necessary, for the purpose of installation and sampling of temporary groundwater
monitoring wells.
In consideration for granting the Right -of -Entry, USACE agrees that it shall indemnify and hold Owner
harmless from any and all claims, damages (including personal injury and property damage), and other
liabilities arising out of and to the extent caused by the acts of USACE, it's agents, subcontractors,
employees or any other entities or persons while present on the premises pursuant to this Right -of -Entry.

Description
Hydrologic soil groups are based on estimates of runoff potential. Soils are
assigned to one of four groups according to the rate of water infiltration when the
soils are not protected by vegetation, are thoroughly wet, and receive precipitation
from long -duration storms.
The soils in the United States are assigned to four groups (A, B, C, and D) and
three dual classes (A/D, B/D, and CID). The groups are defined as follows:
Group A. Soils having a high infiltration rate (low runoff potential) when thoroughly
wet. These consist mainly of deep, well drained to excessively drained sands or
gravelly sands. These soils have a high rate of water transmission.
Group B. Soils having a moderate infiltration rate when thoroughly wet. These
consist chiefly of moderately deep or deep, moderately well drained or well drained
soils that have moderately fine texture to moderately coarse texture. These soils
have a moderate rate of water transmission.
Group C. Soils having a slow infiltration rate when thoroughly wet. These consist
chiefly of soils having a layer that impedes the downward movement of water or
soils of moderately fine texture or fine texture. These soils have a slow rate of water
transmission.
Group D. Soils having a very slow infiltration rate (high runoff potential) when
thoroughly wet. These consist chiefly of clays that have a high shrink -swell
potential, soils that have a high water table, soils that have a claypan or clay layer
at or near the surface, and soils that are shallow over nearly impervious material.
These soils have a very slow rate of water transmission.
If a soil is assigned to a dual hydrologic group (A/D, B/D, or CID), the first letter is
for drained areas and the second is for undrained areas. Only the soils that in their
natural condition are in group D are assigned to dual classes.

Thank you for speaking with me this moming. As mentioned on the phone NCDENR has a rule requiring any
developer who is planning on constructing a "wet pond" or any device that will permanently hold water, within
5 miles of an airport, is required to notify the local airport and receive approval to construct the "wet pond".
We are the civil engineering firm representing the developer and we need to request Edenton Airport Approval
to construct a new "Wet Pond" (i.e. a stormwater detention pond that will permanently hold water) located at
our site. The site is located approximately 3.0 miles form the NW corner of Runway 19.
