Carl I need to do a minor modification on the stormwater permit for King Creek Subdivision, SW7121216. In summary,
we have lost a few lots and need to update and revise the HD Deed restriction table. The overall lot impervious won't
change, just need to do a revision to it. Can I just send in a narrative letter and new HD Deed Restriction Form on this?
think this is what I've done in the past. Also, who should this be sent in to? Samir?
Also, this is a no $ modification change, correct? Please advise if there is an application fee.

V. SUPPLEMENT AND O&M FORMS
The applicable state stormwater management permit supplement and operation and maintenance (O&M) forms
must be submitted for each BMP specified for this project. The latest versions of the forms can be downloaded

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. A detailed application instruction sheet and BMP
checklists are available fromhttp://portal.ncdenr.org/web/wq/ws/su/statesw/forms_docs. Thecomplete
application package should be submitted to the appropriate DWQ Office. (The appropriate office may be
found by locating project on the interactive online map at http:/ / portal.ncdenr.org/web/wq/ ws/su/maps.)
Please indicate that the following required information have been provided by initialing in the space provided for
each item. All original documents MUST be signed and initialed in blue ink. Download the latest versions for
each submitted application package fromhttp://portal.ncdenr.org/web/wq/ws/su/statesw/forms does.

include the soil type, expected infiltration rate, and the method of determining the infiltration rate.

corporation or LLC must be listed as an active corporation in good standing with the NC
Secretary of State, otherwise the application will be returned.

VII. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be
provided as an attachment to the completed and notarized deed restriction form. The appropriate deed
restrictions and protective covenants forms can be downloaded from
http://portal.ncdennorg/web/wq/ws/su/statesw/forms does. Download the latest versions for each
submittal.
In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.
By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and
protective covenants for this project, if required, shall include all the items required in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming
under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the NC DWQ, and that they will be recorded prior to the sale of any lot.

completed Name/Ownership Change Form within 30 days; otherwise I will be operating a stormwater treatment
facility without a valid permit. I understand that the operation of a stormwater treatment facility without a valid
permit is a violation of NC General Statue 143-215.1 and may result in appropriate enforcement action including
the assessment of civil penalties of up to $25,000 per day, pursuant to NCGS 143-215.6.

Please find enclosed the revised State Stormwater permit application for the above referenced
project. The application package has been revised as agreed upon with our office and Scott
Vinson. Enclosed items include an (1) original and one (1) copy of the application form, two (2)
owner authorization forms, two (2) wet detention basin supplements, two (2) level spreader &
filter strip supplements, two (2) notarized operation and maintenance agreements for all BMPs,
two (2) copies of the High Density Residential Subdivision Deed Restriction form, two (2) copies
of the deeds, two (2) Department of the Secretary of State printout, two (2) copies of the
Engineering plans, one (1) copy of the Engineering report, two (2) copies of the SHWT Report,
and one (1) check for $505.00 (Check No.10488) for the permitting application processing fee.
This project is site grading, water line, storm drainage, and stormwater pond, spreader, and filter
strip construction for a proposed 90 lot residential subdivision. Total site area is 58.50 acres.
This is a proposed high density project, with proposed impervious areas and project stormwater
flowing through a pond, level spreader, and filter strip network.

chosen not to Express Revew this project, with the understanding from Scott Vinson that the
project will be reviewed by the end of January, and hopefully able to be permitted shortly

Stormwater Pond #1: On October 10, 2012, a hand augured soil boring was
made to a depth of 60 inches below ground level (approximate elevation 9.50 ft)
in natural soils in close proximity to the proposed stormwater wet detention pond
for the referenced project for the purpose of determining the seasonal high water
table. This information is needed for the design of the permanent pool level
elevation of the proposed stonnwater wet detention pond for this project. The soil
type encountered appeared to be consistent with Croatan muck (CT), which is
nearly level and very poorly drained and is located on broad flats and in
depressions on uplands. This soil type also coincides with the mapped soil for
this area as shown in the "Soil Survey of Craven County, North Carolina" as
prepared by the US Department of Agriculture -Soil Conservation Service. The
bore hole was left open and day to day monitoring indicates the current water
table to be at a depth of approximately 30 inches (Ground Elevation at Bore
measured at 9.50') below the existing ground surface. Therefore and for the
purpose of this application, we find that the seasonal high water table is at
approximate elevation of 7.00 feet.
