Dear Ms. Adams:
I received your letter dated December 6, 2012 to Mr. Arthur Ravenel, III, Managing Partner, ARTTCOTWO, LLC
regarding the site conditions at the Tractor Supply Store in New Bern, NC. Please be assured we have taken
immediate actions to remedy this matter. Trident Construction is the general contractor for this project.
Prior to your Notice, on October 10, 2012, we had Kevin Avolis, Avolis Engineering, the civil engineer for this
project inspect the site conditions, as we also were not satisfied'with the maturity and stabilization of the
grassing. On November 8, 2012, Kevin Avolis provided a remediation plan for the stabilization and grassing of
the deficient areas. The plan is attached for your review.
Brian Elks, Elks Landscapinkq, was provided the November 8"remediation drawing and issued a Notice to
Proceed. On December 10' , we were notified by Mr. Elks that the winter seeding is completed and should
germinate immediately. He will also provide spring seeding and fertilizing. Mr. Elks will be providing pictures,
which will be forwarded to you.
We have also directed Mr. Brad Carpenter of GHC Construction to investigate the rip -rap and correct/improve
the banks to assure that the erosion basin is correct. Upon receiving photographs from Mr. Carpenter of the
completed work, they will be forwarded to you.
We trust that these corrective actions are satisfactory, and hope you understand that we were taking proactive
steps to correct this matter prior to receiving you letter. Please let me know if you have any questions.

This letter is to notify you that you are in violation of Title 15A North Carolina Administrative Code (hereby
known as NCAC) 21-1 .1003 for failing to comply with terms, conditions and limitations of a Stormwater
Management Permit, 15A NCAC 21-1 .1003 is a rule of the Environmental Management Commission
implementing Part I of Article 21 of the North Carolina General Statutes.
On November 28, 2009, Mrs. Kristin Jarman of the Washington Regional Office performed an Inspection to
determine the status of compliance with Stormwater Permit Number S W71 10902 issued to you on October 6,
2011 for the subject project located at 3821 ML King, Jr. Boulevard in New Bern, NC, and lying within Craven
County, North Carolina. As a result of the site inspection and file review, the following violations are noted:
l . Unpermitted drainage has been entering the basin.
2. There is severe erosion in the basin where the unpermitted drainage has been occurring and in
other areas around the basin.

Requested Response
This Office requests that you respond to this letter in writing to the address listed on the letterhead within 30
calendar days of receipt of this Notice and should address the following items:
Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s)
and a time frame for completion of those actions. As part of the plan please return the riprap at the
northeast inlet outfall to its proper place.
Failure to provide the "Plan of Action" within 30 calendar days, or failure to correct the violations by the date
designated in the 'Plan of Action", are considered violations of 15A NCAC 21-1.1000, and may result in the
initiation of enforcement action which may include recommendations for the assessment of civil penalties,
pursuant to NCGS 143-215.6A.
Thank you for your attention to this matter. Please be advised, these violations and any future violations are
subject to a civil penalty assessment of up to $25,000.00 per day for each violation pursuant to North
Carolina General Statute 143-215.6A.. Should you have any questions regarding these matters, please contact

Unpermitted offsite drainage has been entering the North East corner of the basin and has eroded the corner of the basin. A lot of erosion
and loss of vegetative cover is present in various parts of the basin. A vehicle has been driven in the basin. That is alright if it was used
for maintenance but maintenance vehicles should be in the basin as little as possible to avoid soil compaction. Some of the rip rap at the
North East outlet has moved out into the basin and needs to be put back in the correct area.
