This permit shall be effective from the date of issuance until December 13, 2021 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.5 on page 4 of this permit. 3. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans and permit. 4. The tract will be limited to the amount of built -upon area indicated on page 4 of this permit, and per approved plans. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control system. SCHEDULE OF COMPLIANCE 14.50 ft UT -Dismal Swamp Canal C - SW The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plans must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. Page 5 of 9 f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. Page 6 of 9 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. This permit shall be effective from the date of issuance until December 13, 2021. Application for permit renewal shall be submitted 180 days prior to the expiration date of this permit and must be accompanied by the processing fee. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Page 7 of 9 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the project. 9. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days. Permit issued this the 13th day of December, 2011. I went by the site and was impressed with the size of the borrow pit. It is huge. Common sense tells me if we have little to worry about should we get the 100 year storm and 8 inches of rain. The borrow pit will rise a foot and be ok. I do have some concern for the wetland plantings and talked to Bill. He said that he should be through his review late this week or early next week. I ask that he and I talk before I send you my limited comments. We will need to get a revised sw application, specs.& plans that reflect all changes; including those items/questions raised in my email yesterday. I will hold off on drafting the stormwater permit until I have a chance to review the revised package. . The question raised by Greg about an outfall for the main pond is valid. Most projects that I see that use old borrow pits, or oversized lakes, to collect/treat stormwater have some type of outfall (at least a rip -rap emergency overflow to handle the 100-yr storm). Obviously, with an overflow you must have a reasonable outlet elevation & consider downstream impacts; the elevation must also accommodate the design storage/treatment levels in the pond. Another consideration; the overflow elevation should not significantly alter the water levels in the constructed wetlands, or otherwise adversely affect the viability of the wetland systems. Without an established overflow/spillway for the main pond, you need to consider what happens with a 10/25/100-year storm event. Does water back up into roadside swales; if so, is that really a problem once every 25/100 years ? Incidentally, I believe we have nearly experienced (2) 500-year storm events in eastern NC in the last 5 years. FYI, Coastal Plain Conservation Nursery is located at Edenton, NC & has supplied wetland plants for a number of wet pond projects in our area in recent years. The owner, Ellen Colodney, has a good working knowledge of wetland plants & stormwater treatment systems. Also, our website has a list of nurseries that supply wetland plants. I mention this because some contractors may have limited experience with acquiring plants & the details involved with the construction of wetland systems. In general, the contractor should be able to review the plans & build the system without having to refer to the State BMP Manual. If we need to discuss prior to submitting the revised sw package, OK: if not, I will be looking for: the revised package in the next couple of weeks. Also, detail should show elevations. (4) Need to show swale detail; I suggest 5:1 for ease of maintenance. Swales should be located in permanent drainage easement (PDE) on plans. Standard Penetration Tests (SPT's) were performed at 2 ft. intervals within each test boring. A total of eighteen soil test borings were planned, however, the heavily wooded conditions along the western portion of the site prevented the mobilization of the drill rig to the boring locations within the planned roadway. As such, a total of six hand auger borings were drilled at the borings located within the roadway on the western side of the site (B-8 through B-13). Dynamic Cone Penetrometer tests were performed at each of the Hand Auger boring locations. For correlation purposes, a test boring was drilled at the edge of the woodline alongside Hand Auger boring locations DCP-8, DCP-9, DCP-10 and DCP-11. These borings are approximately 120 ft. west of the roadway centerline. A total of six bulk bag samples of subgrade soils were collected at selected boring locations for laboratory California Bearing Ratio Testing. All drilling, sampling and testing was performed in accordance with applicable ASTM Standards or other widely accepted standards. At the completion of drilling, water level measurements were made within the completed bore holes. All samples obtained from the borings were visually examined by a Geotechnical Engineer and classified according to the Unified Soils Classification System. In addition, selected samples obtained from the borings were subjected to laboratory moisture content, Atterberg Limits and percent finer than a #200 sieve testing to aid in the classification of the near surface soils. A Site Location Plan, a Boring Location Plan, Subsurface Profiles and the detailed results of field sampling and testing are presented in Appendix A. U.S. HIGHWAY 17 CAMDEN COUNTY, NORTH CAROLINA MTL PROJECT #10-12620NC Groundwater The water level measurements made at the completion of drilling operations indicated the level of groundwater to be approximately 5.0 to 5.5 ft. below the existing ground surface at the time of drilling. Seasonal groundwater level fluctuations on the order of 2 to 3 feet are not uncommon in this area. Lowest groundwater levels normally occur in late summer and early fall while the highest levels generally occur in late winter and early spring. At the time of our study, we believe groundwater levels were between their seasonal low and high elevations. RECOMMENDATIONS Basis The following recommendations are based on data obtained by this subsurface exploration program, the site orientation and the traffic volume data given previously and our past experience within the area. If the project information presented is incorrect or changed in the final design or if site or subsurface conditions encountered during construction differ appreciably from those indicated by this report, this office should be notified to determine the applicability of our recommendations in light of the changed conditions. Site Preparation Initially, areas planned to support pavements or new fill should be stripped of all surface vegetation and topsoil. Stripping of topsoil is expected to extend a minimum 12 inches below existing grade. In wooded areas, the depth of organic soil removal canbe significantly greater than the indicated topsoil thickness due to the presence of mature tree root structures. The results of testing indicate that the upper 12 to 18 inches of subgrade soils lying directly beneath the topsoil consist of dark brown (organically stained), silty, clayey sand and silty clay. As such, isolated portions of the site where excessive organic matter contents are encountered may require an additional 6 inches of stripping. Stripping should extend at least 2 ft. beyond pavement lines. These areas should then be proofrolled with a heavily loaded dump truck and be monitored by the Geotechnical Engineer to locate any pockets of excessively soft surface soils. All areas that deflect excessively or rut and fail to tighten up under continued proofrolling should be undercut to firm material and be replaced with properly compacted fill. 5 SUBSURFACE EXPLORATION AND GEOTECHNICAL ENGINEERING McCallum P. C. ECO-INDUSTRIAL PARK I U.S. HIGHWAY 17 CAMDEN COUNTY, NORTH CAROLINA MTL PROJECT #10-12620NC Based on the results of our Standard Penetration and Dynamic Cone Penetrometer Testing, it is possible that isolated portions of the site will require soft subgrade soil undercuts of up to 12 inches (see Borings DCP-8, DCP-9, DCP-10 and DCP-11). However, the subgrade soils to be exposed by the stripping operations do have a tendency to become softened and unstable when saturated and worked by equipment. Therefore, to help prevent additional undercutting, the exposed subgrade should be well drained to help prevent accumulation of water on the site and construction traffic across the site should be limited as much as possible. It will be most preferable to have the subgrade exposed only during the drier seasons of the year and to limit construction traffic to well defined areas outside the pavement area, if possible. After the successful completion of proofrolling and any required undercutting operations, fill required to reach finished subgrade elevations can be placed. Pavement area fills should extend approximately 2 ft. beyond pavement lines. Fill and backfill should be classified as SP-SM, SP or SW by the Unified Soils Classification System, with no more than 12 percent passing the No. 200 sieve. All fill and backfill materials proposed for use should be tested and approved by the Geotechnical Engineer prior to their placement on site. All fill and backfill placed beneath the pavements should be compacted in loose lifts of 8 inches or less to a minimum of 95 percent of their maximum dry density as determined by the procedures outlined in ASTM D 698. Pavements The parameters of the near surface subgrade soils will generally govern the design and performance of the paved areas for the planned subdivision. When properly compacted near optimum moisture content, these materials can provide only fair to poor subgrades for pavements. They have a tendency to become unstable and "pump" or deflect excessively under rolling loads when they are wet of optimum. Therefore, care must be taken to have subgrades exposed to the environment for only short periods of time. In addition, adequate drainage of the subgrade areas must be maintained to help prevent ponding and the resulting damage to the subgrade soils. To help provide parameters for pavement design, six California Bearing Ratio (CBR) tests were performed on the near surface subgrade soils. The results of our laboratory CBR testing indicate soaked CBR values ranging from 6.1 to 17.9 percent. A design CBR value (0.67 of CBRav9) of 7.8 was utilized for the pavement section design analyses. CBR tests are generally performed on remolded samples just above optimum moisture content at dry densities near maximum. Therefore, to develop Feld conditions with CBR values of the magnitude obtained in the laboratory, similar subgrade moisture and density conditions will have to be obtained in the field. We recommend original soil subgrades beneath pavements be compacted to at least 95 percent of ASTM D 698 prior to placement of the aggregate base course. Depending on the moisture condition of the subgrade soils at the time of construction, it may not be possible to achieve the specified degree of compaction. Should this be the case, you may wish to approve the subgrade based on the results of proofrolling in accordance with the procedures outlined previously in this report. A flexible pavement section was determined using the AASHTO "Guide for Design of Pavement Structures — 1993", the maximum anticipated traffic volume and the results our CBR tests. The recommended flexible pavement sections tabulated below are based on an initial serviceability of 4.2, a terminal serviceability of 2.8, a reliability of 85%, a standard deviation of 0.49, and ESAL factors of 0.0002 (passenger vehicles) and 0.37 (single unit trucks) and 1.28 (tractor trailers). The pavement sections were designed to meet or exceed the calculated 1,650,000 ESALs for a twenty-year design life. The selection of one of the provided alternative sections should be based on the section providing the most economical and structural value for the project.
