On November 18, 2019, the Washington Regional Office received a Plan Revision
request for Stormwater Management Permit Number SW7091119.
The plan revision request is for the following:
Revising the original site plan and adjusting BUA while staying under the
original allotted BUA.
Based on the current Division of Energy, Mineral, and Land Resources Guidance
on this issue your plan revision request is hereby approved. Please incorporate this
approval into your existing plan set and permit file.
Please be aware that all terms and conditions of the permit issued on January 29,
2010 remain in full force and effect. Please also understand that the approval. of this
revision to the approved plans for the subject State Stormwater Permit is done on a case -
by -case basis. Any other changes to this project must be submitted to and approved
through the Division of Energy, Mineral, and Land Resources prior to construction. The
issuance of this plan revision does not preclude the permittee from complying with all
other applicable statutes, rules, regulations or ordinances which may have jurisdiction
over the proposed activity, and obtaining a permit or approval prior to construction

This office received a Coastal Stormwater Permit Application for the subject project on
November 25, 2009. A preliminary review of your project indicates that before a State
Stormwater permit can be issued the following additional information is needed:
J1. Please download, fill out and submit most recent version of the Stormwater
Application and the Wetland Supplement.
J 2. The Stormwater Wetland Operation and Maintenance Agreement is not signed and
notarized. Please revise.
V3. The General Information section of the Stormwater narrative is stating that there are
no wetlands on site, while the General Notes on Plan sheet CV-01 (note 17) is
stating that wetlands are present. Please revise.
4. According to your proposal, the southern half of the southern access drive is not
collected into the Stormwater Wetlands. Please show how will it be collected or
explain some other possible alternative treatment.
5. The northern V-Ditch (to divert off -site drainage) stops abruptly at the proposed
western property line of this project. According to topography of this site, it is quite
possible that this V-Ditch will drain into the Stormwater Wetlands. If the drainage
from this V-Ditch will be taken away from this site, than show us the drainage feature
on adjoining property with the associated easement.
6. Provide necessary easements for drainage and access drive that is located on
adjoining property and explain how will the outlet pipe from the Stormwater Wetlands
drain to nearest drainage feature.
7. Provide two copies of revised documents and plan sheets.
The above requested information must be received in this office prior January 29, 2010
or your application will be returned as incomplete. The return of this project will necessitate
resubmittal of all required items including the application fee. If you need additional time to
submit the required information, please mail or fax your request for time extension to me at the
Letterhead address and include the application number on the request. The request must
include justification for the amount of additional time needed. The request will only be granted
for justifiable delays that are unforeseen and beyond the owner or consultant's control.

You should also be aware that the Stormwater Rules require that the permit be issued
prior to any development activity. Construction without a permit is a violation of 15A NCAC
2H.1000 and North Carolina General Statute 143-215.1 and may result in civil penalties of up to
$25,000 per day.

This letter addresses your comments dated December 28, 2009, on the above referenced project.
Comment I: The newer version of the application is enclosed. Note that there are 2 separate signature pages. ✓
Comment 2: The signed O&M Agreement is enclosed ✓
Comment 3: There are no wetlands on site. The note has been modified.
Comment 4: The southern half of the access road will be incorporated into a SWM when the remainder of the
property is developed. A curb cut has been added at the low point to allow drainage on this portion of the roadway
to continue to drain to the south.
Comment 5: The proposed swale on the north portion of the property is simply to prevent any drainage from the
properties to the north from entering the enclosed drainage system and wetland. The shallow ditch will convey
drainage to the east toward the roadside ditch and to the west at the base of the wetland. The bottom of the ditch
will be below the wetland so the flow will not enter it. A Spot elevation has been added to C-03 to depict this. I
also spoke with Mr. Belvin about this system.
Comment 6: Easements have been added to sheet C-01 depicting the proposed easements.
Comment 7: 2 copies of revised plans and documents are enclosed.
