parking within 500' of the fresh pond between Nags Head and Kill Devil Hills.

Warren Eadus with Quible & Associates, on behalf of Francis Elbers, has requested.the
attached application be processed under the Express Permit Review Program, forthe construction
of Artisan Marble & Tile.
The project site is located at 2230 Lark Avenue (Lot 5A of the Charles L. Sineath Subdivision)
off US 158 in the Town of Nags Head just south of the town limits with Kill Devil Hills. The entire
project site is within the 1,200' Public Water Supply Area of Environmental Concern (AEC) as
identified in North Carolina Administrative Code 15A NCAC 07H.0405(c)(1)(A). All development
within this AEC is subject to authorization by the Division of Coastal Management. The site is
currently undeveloped.
Vegetation on the site consists mainly of pines with a few small live oaks, and a moderate
under story of bay, green briar, and upland grasses. The site is bordered on the north by Nags Head
Self Storage Annex, and has metal storage buildings, with concrete, asphalt, and Turfstone pervious
pavers, drive and parking areas. A chain link fence surrounds the self -storage site. A recreation
area/park owned by the Town of Nags Head abuts the project site to the south. The recreation
area/park consist of two lighted soccer fields surrounded by a chain link fence. Adjacent to the
soccer fields is a building with a covered picnic area and bathrooms, and asphalt parking lot. The
project site is bordered on the west by property owned by the Town of Nags Head containing the
fresh pond. The site is t10.5' above sea level.
Project description
The applicant proposes to construct two buildings, consisting of a ±18,200 ftZwarehouse and
fabrication building, a 5,200 ftZ office and showroom. In addition, f9,766.5 ftZ of concrete and
asphalt parking area with loading docks, a driveway, and t19,398.8 ftZ of Turfstone parking area are
proposed. The existing elevation of the property at the building location will be raised f2.1' for a
finished floor elevation of t12.6'. Thirty-four parking spaces arelproposed as well as a driveway
connection to Lark Avenue. The driveway, parking area, and loading dock areas will be a
combination of concrete, asphalt and Turfstone pervious pavers. The applicant proposes to
construct an onsite septic tank and drain field system with a 300 gpd maximum. The septic system
will be located more than 500' from the fresh pond yet within 1,200' AEC.
The total amount of disturbance for the project site is t2.0 acres (t87,120 ftZ), which is the
majority of the site. The total impervious coverage for the site is ±33,327 ftZ (38.2%). As proposed,
±10,106.6 ftZ (29.94%) of impervious surface is proposed within 500' of the fresh pond.
A high -density onsite stormwater retention system is proposed and an application has been
submitted to the Division of Water Quality for approval. A Sedimentation and Erosion Control Plan
will be submitted to the Town of Nags Head at a later date. Water will be provided by. the Town of
Nags Head.
Anticipated impacts
The project as proposed will result in the disturbance of t87,120 ftZ of uplands as a result of
the development.

PROPOSED PROJECT DESCRIPTION
Introduction
The proposed project involves the construction of a stone fabrication facility, and all associated
infrastructure for Artisan Marble and Tile on a 2.0 acre site The site is approximately centered around
latitude 35.9846583' north and longitude 75.6492838' west.
The applicants propose to construct an 18,200 sf warehouse and fabrication facility and an additional
5,200 sf office and showroom building. Development that requires a CAMA Major application is limited
to the installation of the septic system on site. The proposed septic system will have a maximum daily
flow rate of 300 gpd and will be sited outside of the 500 feet Fresh Pond AEC Buffer.
Existing Impervious Surfaces
The site is currently undeveloped and there are no existing impervious surfaces
Proposed Impervious coverage
Proposed impervious coverage at the site is an 18,200 sf warehouse building, 5,200 sf office and
showroom building and 9,766.5 sf of concrete and asphalt sited within 1,200 feet of the Fresh Pond AEC
The proposed development also includes pervious Turfstone drive aisles and loading area equaling
19,398.8 sf. The percentage of proposed impervious coverage within the 1,200 sf Fresh Pond AEC is
38.2 percent. Proposed impervious coverage within the 500 feet Fresh Pond Setback is 29.94 percent.
The total proposed built upon surface area for the two acre site is 60 percent. This coverage includes the
22.2 percent coverage of Turfstone pervious paving.
Stormwater Management
A site specific Stormwater Management Plan is being designed for this project. The Stormwater
Management Plan will be submitted to the Division of Water Quality for review and approval. In general,
the stormwater plan proposes to collect runoff and convey the stormwater to appropriately. sized
infiltration basins. All of the proposed stormwater infiltration basins are sited entirely out of the 500 feet
Fresh Pond cone of depression and setback for septic systems and other potential sources of pollution.
Water and Sewer
Potable water will be provided by The Town of Nags Head through the Dare County Water Distribution
System. .
Sewage will be handled on site via a conventional on site sewage treatment system with a maximum daily
flow rate of 300 gpd. Title 15A NCAC 07H .0405(c)(1) Small Surface Water Supply Watersheds allows
for the placement of on site septic systems and stormwater collection and treatment systems within the
1,200 feet Fresh Pond AEC provided the system(s) are site outside of the 500 feet cone of depression.
There are no proposed or perceived contamination sources associated with the development sited within
the 500 feet cone of' depression for the Fresh Pond AEC.

The site is proposed to be developed as a showroom, offices and a warehouse facility for the Artisan Marble and Tile
Company. The facility will be used to store materials for use in the off -site commercial and residential marble and tile
installation operations. Daily operation will be consistent with offices, showroom open to the public and typical warehouse
operations consisting of deliveries of materials, storage and subsequent loading for off -site installations.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
Construction methodology will be consistent with projects of this type and will be performed by licensed contractors. All
construction equipment will be kept on site and there will be no crossing of wetlands or waters during the construction of the
property. Construction equipment likely to be used will include dump trucks, front end loader, excavators and similar
equipment for the installation of infrastructure and erection of the proposed offices and warehouse facility.
d. List all development activities you propose.
The applicants propose to construct an 18,200 sf warehouse and 5,200 sf office facility and 9,766.5 sf of asphalt and
concrete drives and loading areas. Development that requires CAMA Major permitting is limited to the installation of a septic
system with a proposed volume of 300 gpd. The wastewater system will be composed of two 1,000 gallon concrete tanks
and a conventional drain field consisting of four 38 feet long three inch pvc drain pipes installed on 3 feet centers .
Development also includes the installation of a stormwater system and all other necessary utilities and landscaping
requirements mandated by local and state requirements.

THIS DEED made this the 30'h day of _ October 2007, by and between
SINEATH PROPERTIES, LLC, a North Carolina limited liability company, party of the first
part, to ELDERS HOLDINGS, LLC, a North Carolina limited liability company, of 206 W.
Villa Dunes Dr., Nags Head, NC 27959, party of the second part:
WITNESSETH:
THAT the said party of the first pan, for valuable consideration to it in hand paid by the said party
of the second part, the receipt of which is hereby acknowledged, has bargained, sold and conveyed,
and by these presents does bargain, sell and convey unto the said party of the second part, his heirs
and assigns, all those certain lands lying and being in the Town of Nags Head, Nags Bead Township,
Dare County, North Carolina, and more particularly described as follows:
All that certain lot or parcel of land designated as Lot 5A on map or plat thereof
entitled "Lots 4 & 5 - Division of Land for Charles L. Sineath & wife, Susan a,
Sineath, Town ofNags Head, Nags Head Township, Dare County, North Carolina"
by Seaboard Surveying & Planning, Inc, dated December 11, 2000 and recorded in
Plat Cabinet E, Slide 370, in the office of the Register of Deeds of Dare County,
North Carolina.
Less and except that portion of Lot 5A which was conveyed to the Town of Nags
Head by deed dated April 7, 2003 and recorded in Book 1487, Page 106, Dare
County Registry and deed of correction dated October 29, 2007 recorded in Book
1748, Page 156, Dare County Registry.
Same being a portion of the property conveyed to Sineath Properties, LLC by deed
dated November 15, 2002 and recorded in Book 1461, Page 63, Public Registry of
Dare County, North Carolina.
This conveyance is made subject to the ad valorem taxes for 2007 and any easements, covenants and
restrictions of record and any governmental rules and regulations that may affect the use thereof.
TO HAVE AND TO HOLD the above described lands and premises together with all the privileges
and appurtenances thereunto belonging unto the said party of the second part, his heirs and assigns,
in fee simple forever.
AND the said party of the first part, for itself and its successors, heirs, administrators, executors and
assigns, covenants to and with the said party of the second part, his heirs and assigns, that it is seized
of said lands in fee, that it has a good right to convey the same in fee simple; that the same are free
and clear of all encumbrances whatsoever except as otherwise set forth herein; and that it will
forever warrant and defend the title to the same against the claims of all persons whomsoever.

Please be advised that on December 5, 2007 the Board of Commissioners of the
Town of Nags Head reviewed the site plan/permitted use application for
construction of a 18,200 sq. ft. warehouse for stone fabrication and a 5,200 sq.
ft. accessory building for the supporting showroom and office located at 2230
Lark Avenue, Nags Head. The Board voted unanimously to approve the site
plan/permitted use application with the following conditions:
- Obtain appropriate CAMA Permits prior to issuance of Building Permit.
- Obtain NC DENR High Density Stormwater Permit prior to issuance of
Certificate of Occupancy.
You have 1 year from the date of Board of Commissioners approval (December
5, 2007) to obtain a building permit for this project.
