Man Made Basin off Fodery Creek Hyde County Project Setting The 20 acre project site is located off Landing Road (SR1136) adjacent a man made canaUbasin and Fodery Creek off Swan Quarter Bay in the Town of Swan Quarter, Hyde County, North Carolina. The tract is dominated by a large expanse of Juncus roemerianus marsh with some limited highground between the marsh and SR 1136. The L-shaped man made canal off Fodery Ceek was dug from this marsh prior to permit requirements and has an adjacent highground spoil bank that is used by small boat commercial fishing operations for parking and loading/off loading. There is a larger piece of highground south of the canal that resulted in part from filling activities authorized by Major CAMA/Dredge and Fill permit No. 20-93 issued on 11 February 1993. The highground areas have varying amounts of gravel and levels of soil compaction resulting from vehicular traffic. These areas are vegetated with fescue grass. The upland wetland interface is vegetated with some woody vegetation mainly wax myrtle. The marsh adjacent the relic spoil bank and the larger area of highground to the south has been impacted by its prior use as an area to dispose of various types of trash. The Newman Family LLC purchased the property in 1993 after obtaining the aforementioned Major CAMA/Dredge and Fill permit. Activities undertaken as part of the permit included the recovery of the discarded trash in the marsh. The impacts associated with the trash dumping and prior filling have lead to the invaisive nonnative Phragmitessp. reed gaining a hold along the edges of the filled areas outcompeting the native marsh grasses in some areas. Water depths in the canal range from 2.5 to 3.5' below the normal water level (NWL). The canal and Fodery Creek are designated as Primary Nursery Areas (PNA) and Coastal Waters by the Marine Fisheries Commission and SA HQW by the Environmental Management Commission. Project Description The applicant proposes to improve the use of the canal and adjacent highground area by small boat commercial fishing operations participating in the local blue crab, gill net and oyster fisheries. The applicant proposes to undertake maintenance excavation in an area of the canal 20' wide x 115' long removing an average of 1' of material for a consistent water depth of 3.5' below the NWL. The spoil will be placed in a closed body dump truck for placement on the larger highground area to the south of the canal. The applicant will then construct a 3' tall x 172' long bulkhead along the edge of the canal at the NWL. Once the spoil material from the maintenance excavation is dry it will be placed behind the bulkhead as backfill. A 5' wide x 172' long wooden dock is proposed along the landward edge of the proposed bulkhead. The applicant also proposes to construct a 2' tall x 44' long retaining wall from the relic spoil berm adjacent the canal to the larger area of highground to the south. The retaining wall is to be constructed across a wetland area along the interface of a homogenous stand Phragmites sn. and the large expanse of Juncus roemerianus marsh. The wetland area to be filled landward of the retaining wall is 1,088 ft2 in size and is surrounded on three sides by highground. The Newman Family LLC. Anticipated Impacts The project as proposed disturb 2,300 ft' of canal bottom. The project will result in the filling of 1,088 ft' of 404 wetlands vegetated with Phragmites sp. and the filling of 3,200 ft' of uplands associated with the temporary spoil disposal area. The wooden dock will shade 860 ft' of uplands. The development activities will promote the use of this area by small commercial fishing operations and their associated impacts. This maintenance and expansion is needed to facilitate the influx of small fishing vessels we have seen in the recent years. We are proposing to you to undertake maintenance excavation, bulkhead and dock construction as well as some minor wetland fill. We are proposing to excavate approximately 85 cubic yards or material from our basin to give it an approximate depth of 3.5 feet. Along with this excavation we propose to construct 172' bulkhead and 142' dock along this basin. With our spoil from the basin we are also proposing to fill 1088 square feet of 404 wetland. We will construct a retaining wall approximately 2 foot in height to keep the spoil from encroaching on the surrounding wetlands. The purpose of these development activities is to provide more space for commercial fishing operation participants in the crab pot, small boat oyster, and gill net fisheries. The bulkhead and dock will provide "side to" Mooring and the wetland fill will be used for temporary storage of seasonal fishing gear. At the end of Landing Road (S.R. 1136) on the site of the old Jarvis — Restaurant, Motel and Crab house. The total tract acreage is 12.57 acres and contains 4,653 linear feet of shoreline, 109,056.86 square feet of wetlands, 301,363.77 square feet of AEC. Total area of impact due to proposed construction is 5.0 acres. Due to the current economic climate, we have put our presently permitted condo project on hold for the short-term. In order to help ease the financial burden of the previously incurred expenses, we are proposing a temporary (2 to 4 year) alternative project. With this project we are proposing a Campground including 35 `long-term lease" camping sites for Travel Trailers or Recreational Vehicles. The civil design was achieved by duplicating the footprint of the previous trailer park and incorporating the impervious footprint of the old restaurant, motel, crab house, and parking lot for additional campsites. There will be no new impervious area in this project. Boat Slips Approximately 35 currently permitted boat slips will also be constructed at this time as an amenity for the campground. We also intend to respect all environmental issues alTecting the site and hope to decrease buffer impact and slow the erosion factors that present themselves. The project is in the Tar -Pamlico River Basin and is surrounded by Fodrey Creek Canal and directly off of the Swan Quarter Bay. Runoff from this project will be controlled during construction by silt fencing. Vegetation on tract includes natural marsh lands, grassed areas, natural volunteer weeds, and brush. The site will be enhanced by an over seeding of grass. Adjacent properties' uses are a Commercial Fishing Dock, Crab Houses, and Marinas. The property will be using the Swan Quarter Sewer District system for all on -site sewer needs. Property will be using the Hyde County Public Water System for all on -site water systems. It is on Landing Road at the former Jarvis Motel, Restaurant and Crab House. The site was filled with excavated material that created the canal extension of Fodrey Creek. The material is classified as Udorthents soil type, which is very inconsistent in the profile. Actual soil testing was performed and the static water level found to be at elevation 1.2'MSL on 1988 NAVD. The permeability tests concluded the rate of vertical movement of water to be less than 0.52 inches per hour. The surrounding waters are SA and more restrictive on allowed discharges than other water classifications. The design provides for the collection and treatment of the first flush 1.5 inches rainfall and is contained entirely outside the Tar -Pamlico buffer zones. It should be noted that the site has been substantially impervious from a former use. All impervious areas except the driveway area to the boat ramp will be removed. The chart of impacts is as follows: - Total existing impervious area within the construction zone: 1.69 ac - Total existing impervious area within the Tar -Pamlico buffer: 0.62 ac - Total proposed impervious area within the construction zone: 1.14 ac - Total proposed impervious area within the Tar -Pamlico Buffer Zone: 0.17 ac There will be a substantial reduction in the impervious areas on the site. Fill material will be placed in the building pad and parking lot areas. There will be seven collection centers that has surface storage sub -surface, stone storage, sand filter drip system, pipe allocation to provide the five day drawdown rate and provide diffuse flow over the surface of the buffer zone. The primary infiltration area has been designed to accommodate the total required sediment volume to be filtered through sod, six inches minimum of sand, non -woven fabric which will filter particle sizes of 0.074 mm, storage stone. The filtered water will pass through pipes into another stone storage area also in fabric. The 12' x 12' stone and secondary sand filter will polish the discharge. The sand filter is 1'-0" deep and has a stone void area and pipe to discharge the water to the buffer area. The recommended sand gradation for the filter is 0.35 — 0.5 mm which is much less efficient than the filter fabric which filters the water twice following the first sand filter in the primary area. The storage computations checked the required 1.5 inches storage and the BMP sand filter requirements at 810 CF storage and 540 SF surface area. The actual provided design exceeds the minimum requirements. The total of the infiltrator basin sand of 6inches and the sand filter of 12 inches is 18 inches. The discharge pipe at the edge of the buffer is 40 LF each way of the supply pipe with four holes of different sizes to control the rate of release and provide for diffuse flow across the surface of the buffer. Over flow flumes are provided at each of the seven areas which will provide diffuse flow into the buffer zones. There will be no impervious areas remaining or proposed in the Zone I. The primary filter area will contain all sediment. In the event infiltration slows to a problem period, the sod may be removed and replaced and the system is totally restored. DESCRIPTION OF PROJECT Location of Project The property is located in Swan Quarter on Landing Road adjacent to Fodrey Creek. Type of Development The project is planned to be a 45 unit condominium complex in five buildings. Parking will be below the living floors in an unenclosed garage. Earth Disturbing Activities: The site has been used for a motel, restaurant, trailer park and crab house and is substantially impervious. The majority of the impervious surfaces will be removed and placed back to grade with clean sand from a contractor's pit near Swan Quarter. The site will be cleaned up, concrete removed, devices installed and filled and graded. Existing Drainage Patterns: The property currently drains directly into the canals surrounding most of the site. There are no existing point source drainage structures. Proposed Drainage Patterns: The proposed drainage will be collected upland of the buffers from all impervious surfaces, detained, treated and released for surface diffuse flow across the buffer zones. Construction Sequence: The plan calls for multiple sediment basins connected by diversion swales. The exact phasing is not known but some basins may be combined. The basin size specified is for the largest basin allowed on site. Centipede sod will be placed in critical areas and seeded on non -erosive surfaces/ B. EROSION AND SEDIMENTATION CONTROL MEASURES A copy of the latest approved soil erosion and control plan must be on file at the job site. Timely and proper attention shall be required for prevention of offsite erosion and sedimentation. Various levels of erosion control are proposed in the plan. If it becomes evident that additional erosion and sedimentation control measures are needed they shall be installed immediately. A temporary cover sufficient to restrain erosion must be provided within 21 calendar days of completion of any phase of grading. A permanent ground cover, sufficient to restrain erosion, must be provided within the shorter of 30 working or 120 calendar days after completion of the construction or development. 2. A buffer zone, sufficient to restrain sedimentation, must be maintained between the land - disturbing activity any adjacent property or watercourses. Maintain / Do Not Disturb existing vegetative cover in areas of no construction. 3. Install a gravel construction pad at the construction entrance, as noted on the plans. The pad will be a minimum of 50 ft long, 20 ft. wide and 6" deep of washed #57 stone. 4. All disturbed areas will be seeded within 21 days following construction in accordance with the seeding schedule as shown on the plans. Rye grass is not to be used as ground cover. C. DESCRIPTION OF PROJECT Location of Project The property is located in Swan Quarter on Landing Road adjacent to Fodrey Creek. Type of Development The project is planned to be a 45 unit condominium complex in five buildings. Parking will be below the living floors in an unenclosed garage. Earth Disturbing Activities: The site has been used for a motel, restaurant, trailer park and crab house and is substantially impervious. The majority of the impervious surfaces will be removed and placed back to grade with clean sand from a contractor's pit near Swan Quarter. The site will be cleaned up, concrete removed, devices installed and filled and graded. Existing Drainage Patterns: The property currently drains directly into the canals surrounding most of the site. There are no existing point source drainage structures. Proposed Drainage Patterns: The proposed drainage will be collected upland of the buffers from all impervious surfaces, detained, treated and released for surface diffuse flow across the buffer zones. Construction Sequence: The plan calls for multiple sediment basins connected by diversion swales. The exact phasing is not known but some basins may be combined. The basin size specified is for the largest basin allowed on site. Centipede sod will be placed in critical areas and seeded on non -erosive surfaces/ B. EROSION AND SEDIMENTATION CONTROL MEASURES A copy of the latest approved soil erosion and control plan must be on file at the job site. Timely and proper attention shall be required for prevention of offsite erosion and sedimentation. Various levels of erosion control are proposed in the plan. If it becomes evident that additional erosion and sedimentation control measures are needed they shall be installed immediately. A temporary cover sufficient to restrain erosion must be provided within 21 calendar days of completion of any phase of grading. A permanent ground cover, sufficient to restrain erosion, must be provided within the shorter of 30 working or 120 calendar days after completion of the construction or development. 2. A buffer zone, sufficient to restrain sedimentation, must be maintained between the land - disturbing activity any adjacent property or watercourses. Maintain / Do Not Disturb existing vegetative cover in areas of no construction. 3. Install a gravel construction pad at the construction entrance, as noted on the plans. The pad will be a minimum of 50 ft long, 20 ft. wide and 6" deep of washed #57 stone. 4. All disturbed areas will be seeded within 21 days following construction in accordance with the seeding schedule as shown on the plans. Rye grass is not to be used as ground cover. C. TIME SEQUENCE OF OPERATIONS Construction sequence is as noted on the sedimentation and erosion control plan sheet. Construction is planned to begin May 2007.
