Dear Mr. Braddy:
This office received your stormwater application for the subject project on March 29, 2007. A
preliminary review of the plans and specifications has been completed. In order to complete your
application and before a stomrwater permit can be issued, the following items must be addressed:
1) Delineate drainage basins on site plan & describe stormwater controls for each basins.
2) Provide written detailed vegetation plan, prepared by a qualified individual, that indicates a
variety of suitable species, location, spacing, soil preparation, fertilizer requirements,
installation procedures, construction schedule, etc. Cattails are a dominant type species and
should not be included in the vegetation plan.
3) Dimensions for orifice/riser details do not match; riser detail not adequately shown.
4) Site plan shows an existing collection system; explain how this runoff is routed to the pond.
5) Is ditch along NE property line "blue line" stream; do buffer rules apply.
6) Site plan shows vegetated fiker/level spreader device & 4-inch pvc.pipe discharge placed
Within the 50-ft Tar -Pamlico Buffer area; explaini)ustify.
7) Revise stormwater narrative, application, plans & details to reflect all changes.
The above requested information must be received in this office prior to June 30, 2007, or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all
required items including the application fee. If you need additional time to submit the required information,

1. Two copies of a map delineating the drainage basins are enclosed. Stormwater from Catchment 1, 4A
and 4B is routed to the stormwater treatment pond. Catchments 2 and 3 have no disturbance other than
the berms shown on the plans. Disturbed areas will be seeded to grass.
2. The vegetation for the wetland shelf consists of sprigging on a 12-inch pattern common rush (Juncos
Effuses) and soft stem bull rush (Scirpus Validus), when the pond is filled with water. Native plants
will be obtained locally. Fertilizer will not be used.
3. Orifice details have been changed and are shown on the enclosed maps.
4. Routing arrows are shown on the enclosed maps. The pond shown on the plans is proposed. There is
not a pond on this site at this time.
5. The pond is set back from the ditch on the north boundary line sufficiently to comply with the buffer
rules. A request was made over one month ago for a determination to be made by DWQ.
6. The level spreader is the over flow for the treatment pond. The orifice discharges into a stone reveted
portion of a drainage ditch There is no other place to discharge.

STORMWATER PERMIT
This six -acre site was first built upon in about 1994. At that time less t11an 30 percent was impervious.
The proposed improvements consist of a new building with additional parking, which makes 411percent of
We site impervious.
This site is topographically flat at an elevation of about 13 feet Soils near surface are fine sands
becoming more clayey with depth.
The regulations provide for the treatment of the first inch of rainfall. In this case two inches will be
stored in the pond for treatment. The cleaner water that falls late during the event will by-pass the pond.
This allows the first inch of water during every rainfall event within a 24 hours period to be treated.
The stormwater treatment system selected is a wet pond and swales.
The stormwater treatment strategy is to direct all flow to the pond, which will hold about two inches of
rainfall in temporary storage. The remaining storm events will by-pass the pond. 7 !
Soils are mapped as Seabrook and Tomotley. Soils are nether entirely Seabrook or Tomotley, according j
the published descriptions. In general, soils are a cross between the sandy nature of Seabrook and the
clayey Tomotley. The seasonal water table, based on mottling, is at about the 15-inch depth. The permitted
pool elevation is set at about 18 inches of depth.
The Tar -Pamlico rules strategy is to use the swales and treatment pond and to buy out the fractional
amounts of nitrogen and phosphorus that cannot be eliminated by the p�oppsed�Mp�

Seabrook Series
The Seabrook series consists of moderately well
drained soils that formed in sandy marine and fluvial
sediments. Slopes range from 0 to 2 percent.
Typical pedon of Seabrook loamy sand; 3 miles west
of Washington on U.S. Highway 264, about 75 feet east
of the road, in a cultivated field (State plane coordinates
675,000 feet N., 2,565,000 feet E.):
Ap-0 to 8 inches; grayish brown (1 OYR 5/2) loamy
sand; weak fine granular structure; very friable;
many fine roots; slightly acid; clear wavy boundary.
C1-8 to 28 inches; light olive brown (2.5Y 5/4) loamy
sand; few fine distinct olive yellow (2.5Y 6/6) and
light gray (2.5Y 7/2) mottles; weak fine granular
structure; very friable; strongly acid; gradual smooth
boundary.
C2-28 to 37 inches; pale yellow (2.5Y 7/4) loamy
sand; few fine distinct yellowish brown (10YR 5/6)
and common fine distinct light gray (2.5Y 7/2)
mottles; massive; very friable and loose; strongly
acid; gradual wavy boundary.
Cg-37 to 80 inches; light gray (5Y 7/1) sand; single
grain; loose; few strong brown concretions'/4 inch in
diameter; strongly acid.
The combined thickness of the sandy horizons is
more than 60 inches. Reaction ranges from very
strongly acid to slightly acid throughout the profile,
except where the surface layer has been limed.
The Ap horizon has hue of 10YR, value of 3 to 5,
and chroma of 2 or 3.
The C horizon has hue of 10YR or 2.5Y, value of 4
to 7, and chroma of 3 to 6. Its is loamy sand, loamy fine
sand, or sand.
The Cg horizon has hue of 2.5Y or 5Y, value of 5 to
7, and chroma of 1 or 2. It has textures similar to those
of the C horizon.
State Series
The State series consists of well drained soils that
formed in loamy marine and fluvial sediments. Slopes
range from 0 to 3 percent.
Typical pedon of State sandy loam, 0 to 3 percent
slopes; 2.9 miles east of Godley's store on Secondary
Road 1912, about 0.8 mile north on Secondary Road
1910, about 100 feet west of the road, in a cultivated
field (State plane coordinates 583,000 feet N.,

Stormwater Application for the subject project on March 6, 2001.
Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No- SW7010217 dated April 20, 2001 to Second Baptist Church.
This permit shall be effective from the date of issuance until
rescinded and shall be subject to the conditions and limitations as
specified therein:
If any parts, requirements, or limitations contained in this
permit are unacceptable,. you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form
of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447.
Unless such demands are made this permit shall be final and
binding.

LOW DENSITY DEVELOPMENT
In accordance with the provisions of Article 21 of Chapter 143,
General Statutes of North Carolina as amended, and other applicable
Laws, Rules and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of stormwater management
systems in compliance with the provisions of 15A NCAC 2H.1000
(hereafter referred to as the "stormwater rules") and the approved
stormwater management plans and specifications, and other
supporting data as attached and on file with and approved by the
Division of Water Quality and considered a part of this permit for
grass swales to serve Second Baptist Church located near
Washington, NC.
This Permit shall be effective from the date of issuance until
rescinded and shall be subject to the following specific conditions
and limitations:
I. DESIGN STANDARDS
1. The following criteria are approved as meeting the stormwater
rules for this project:

project site are of such high density that stormwater runoff
threatens water quality.
4. Approved plans and specifications for projects covered by this
permit are incorporated by reference and are enforceable parts
of the permit.
5. The only runoff conveyance systems allowed will be vegetated
conveyances such as swales with minimum side slopes of 3:1
(H:V) or curb outlet systems as defined in the stormwater
rules and approved by the Division.
6. No piping shall be allowed except:
a. That minimum amount necessary to direct runoff beneath an
impervious surface such as a road
b. That minimum amount needed under driveways to provide
access to lots.
7. Projects covered by this permit will maintain a minimum 30
foot wide vegetative buffer between all impervious areas and
surface waters. In addition, projects in the Neuse River
Basin must comply with the Neuse Riparian Buffer Rules.
8. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
9. Deed restrictions are incorporated into this permit by
reference and must be recorded with the Office of Register of
Deeds. A copy of the recorded restrictions must be received
by this Office within 30 days of the date of recording.
Recorded deed restrictions must include, as a minimum, the
following statements related to stormwater management:
a. A statement of the allowable built -upon area per lot in
the following form:
"The allowable built -upon area shall not exceed 1.8
acres, inclusive of that portion of the right-of-way
between the front lot line and the edge of the pavement,
structures, pavement, walkways of brick, stone, slate,
not including wood decking."

b. Items related to stormwater management must remain in the
deed restriction, and this is to be indicated by
including the following: "The covenants pertaining to
stormwater regulations may not be changed or deleted
without concurrence of the State."
C. To assure that vegetated conveyances are not piped (in
accordance with item 5) deed restrictions must indicate
that: "Filling in or piping of any vegetative
conveyances (ditches, swales, etc.) associated with the
development except for average driveway crossings, is
strictly prohibited by any persons."
10. The Engineer /Owner/Developer/ Permittee must certify in writing
that the project's stormwater controls, and impervious
surfaces have been constructed within substantial intent of
the approved plans and specifications.
11. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Change of ownership
d. Redesign or addition to the approved amount of built -upon
area
e. Further subdivision of the project area.
In addition, the Director may determine that other
revisions to the project should require a modification to
the permit.
12. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee shall comply with the following schedule for
construction and maintenance of the Low Density Option
stormwater systems:

a. Swales and other vegetated conveyances shall be
constructed in their entirety, vegetated, and be
operational for their intended use prior to the
construction of any built -upon surface except roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the swales or other vegetated
conveyances will be repaired immediately.
2. The permittee shall at all times provide the operation and
maintenance necessary to operate the permitted stormwater
management systems at optimum efficiency to include:
a. Inspections
b. Sediment removal

5. The permittee shall submit all information requested by the
Director or his representative within the time frame specified
in the written information request.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to an enforcement
action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until
revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance, or termination does not stay any
permit condition.

4. The issuance of this permit does not prohibit the Director
from reopening and modifying the permit, revoking and
reissuing the permit, or terminating the permit as allowed by
the laws, rules and regulations contained in Title 15A of the
North Carolina Administrative Code, Subchapter 2H.1000; and
North Carolina General Statute 143-215.1 et.al.
5. The permittee shall submit to the Director and shall have
received approval for revised plans, specifications, and
calculations prior to construction, for those revisions under
any of the following conditions:
a. Any additions, deletions or redesign of the previously
permitted amount of built -upon area proposed regardless
of the size of the modification.
b. Further subdivision of the project area.
6. The permit is not transferable to any person except after
notice to and approval by the Director. The Director may
require. modification or revocation and reissuance of the
permit to change the name and incorporate such other
requirements as may be necessary. A formal permit request
must be submitted to the Division of Water Quality accompanied
by the appropriate fee, documentation from both parties
involved, and other supporting materials as may be
appropriate. The approval of this request will be considered
on its merits, and may or may not be approved.
7. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state and federal) which have jurisdiction.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a
table listing each lot number, size and the allowable built -upon area for each lot must be provided as an
attachment.
The following covenants are intended to ensure ongoing compliance with state stormwater management permit
number as issued by the Division of Water Quality. These covenants may
not be changed or deleted without the consent of the State.
No more than square feet of any lot shall be covered by structures or impervious materials.

-3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
�4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prim to
.construction.
l5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity and performance of the system as permitted.

shall include all the applicable items required above, that the covenants will be binding on all parties and
persons claiming under them, that they will run with the land, that the required covenants cannot be changed or

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. The complete application package should be
submitted to the appropriate DWQ Regional Office.
