Dear Mr. Veit:
A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permits SV 7070213 and SW7070310 for stormwater treatment systems
consisting of bioretention areas and wet detention ponds serving the Craven County
Judicial Center and entrance road located at 1100 Clarks Road, New Bern, NC expire
on June 20, 2021 and March 21, 2021 respectively. This is a reminder that permit
renewal applications are due 180 days prior to expiration. We do not have a record of
receiving a renewal application.
Please submit a completed permit renewal application along with a $505.00 fee for each
permit renewal. Also, it was noted in the file review that designers' certifications that the
projects were constructed in accordance with the approved plans as required by the
permits have not been submitted. Please include these with your applications. Permit
application forms for renewal can be found on our website at:

Coastal Stormwater rules require that this property be covered under a stormwater
permit. Failure to maintain a permit subjects the owner to assessment of civil penalties.

Please allow us to respond to your review comments dated March 15, 2007 in the same_ order as your
comments. A copy of your letter is attached for your convenience.
1. Revised drawings and calculations to match; added dimensions to the Stormwater Pond.
2. SA/DA ratio used is 4; however, the volume from an one (1) inch rain event dictates the size of the
permanent pool and surface area
3. SA/DA used was from "Chart 4 For Wet Detention Basins Discharging Directly To A Stream". The
Drainage Calculations Sheets have been revised to reflect the Required Surface Area and Volume and
the Provided Surface Area and Volume. The SA/DA Ratio information has been added to the
Calculation Sheet.
4. Changed Designed Rainfall to one (1) inch.
5. Although the Soil Survey of Craven County indicates Lenoir Silt Loam with high ground water table, the
excavation of the four (4) feet deep roadside swale indicated no visible ground water. If the elevation of
the Permanent Pool was changed from elevation 22.5 feet to elevation 23.5 feet or more, water would
stand in the roadside swales and the NC Department of Transportation would not take over the Entrance
Road for continuous.maintenance in the future.

This office received a Coastal Stormwater permit application and plans for the subject project on March 9,
2007. A preliminary review of the project indicates that before a State Stormwater permit can be issued the
following additional information is needed.
• Calculations show that approximate size of the Wet Detention Pond is 250' x44', however drawing
detail shows size to be approximately 170' x 40'. Please revise;
• SAIDA ratio used is 2.7, which corresponds to the depth of 4 feet. Please revise and use correct
SAIDA ration for the depth of 3.5 feet;
• Please provide Required Surface Area and Volume (Preferable method by DWQ is Simple Method
by Schueler — example in BMP Manual) and Provided Surface Area and Volume on your
calculations and show those same numbers on your Supplement Sheet;
• Non SA waters require Design Rainfall of 1 inch instead of 1.5 as you specified. Please revise;
• According to soil report Seasonal High Water Table is at elevation of approximately 24-25 feet.
Permanent pool as proposed has elevation of 22.5 feet. Please revise so Permanent Poll elevation
corresponds to SHWT. Site visit to determine exact. SHWT is scheduled for March 16, 2007:
• Please provide two copies of signed and sealed revised sheets and calculations.
The above requested information must be received in this office prior to March 23, 2007 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
items including the application fee. If you need additional time to submit the required information, please mail
or fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any
development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina
General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day.

Once satisfactory compaction is achieved to the base course, the contractor shall pave the roadway
according to the typical section shown on the Entrance Road Construction Plans.
After all the roadway construction has been completed, all the disturbed area permanently stabilized
and the erosion and sedimentation devices cleaned and reworked if needed, the Owner will inspect the
Entrance Road on a monthly basis and after any major rain event.
STORMWATER POND MANAGEMENT PLAN
The maintenance activities shall be performed according to "SWU-102 Rev. 3.99 Wet Detention
Basin Supplement." The requirement for, complete draw -down for pond maintenance or emergency draw -
down will be accomplished with a portable trash pump. Since the roadside swales have been excavated
according to the approved "Erosion and Sedimentation Control Plan ", the invert ofthe stormwater pond is
dictated by the swale elevations. Checking these elevations, it has been determined that the pond elevation
is approximately one (1) foot below the outlet ditch; therefore it is impossible to de -water the pond by gravity
flow. This is the reason for having to de -water the wet detention pond with a portable trash pump.
Another area of concern at and near the detention pond is that of vegetative maintenance. This
maintenance will require that the Owner maintain the ground (grass) on a season schedule sch that the grass
around the stormwater pond and grass lined Swale do not exceed four (4) inches in height and that the
maintenance personnel repair any bare places in the ground cover immediately after they are discovered.
SOIL CONDITIONS AT THE WET DETENTION POND
According to the Soil Survey of Craven County, North Carolina issued March 1989, the soil at the
proposed wet detention pond location is Lenoir Silt Loam, "Le".
Lenoir Silt Loam is nearly level and somewhat poorly drained; surface layer is very dark grayish
brown silt loam five inches (5") thick. Subsurface layer is light yellowish brown silt loam eight inches (8")
thick. Subsoil is brownish yellow silt loam in upper part, changing to brownish yellow clay with gray
mottles, and then changing to gray clay in this seventy-two inch (72") layer. Seasonal high water table is
1 to 2 feet below the surface.

The Stornnvater Management Plan will include maintenance of all Erosion and Sedimentation
Control Devices as defined in the approved Erosion and Sedimentation Control Plan:
-Whereas the erosion and sediment control devices shalI be instal led at the beginning of construction
and maintained throughout all phases of the Entrance Road construction, the Stormwater Management will
occur in two (2) phases.
The first phase will consist of constructing a rock all weather entrance road to the Craven County
Judicial Center. This road with the exception to the connection with NCSR 1225, Clarks Road, will follow
the location of the permanent entrance road. The temporary deviation at the connection with NCSR 1225
is to utilize the existing driveway until the new entrance driveway details have been completed and approved
by the NC DOT, Division of 1-lighways. The roadway section will have been graded to subgrade, the swales
excavated to proper alignment and elevation, the rock check dams installed and the entire disturbed area,,
except the roadbed, seeded, and stabilized. The roadbed will be stabilized with six (6) inches of aggregate
base course (ABC); this six (6) inches ofbase course is to provide an all weather access to the Judicial Center
while it is under construction.
During the construction of the Judicial Center it will be the responsibility of the building contractor
to maintain not only the all weather riding surface, but also the shoulders, swales, silt fence, check dams,
stormwater pond, and all of the vegetative ground cover within the construction limits ofthe Entrance Road.
The building contractor shall inspect all of the previously installed erosion and sediment control devices and
stonnwater pond weekly and after each major rain event, and he will repair any damage to the, devices,
vegetative ground cover, and remove all liter and construction debris within the construction limits.
At some stage during the construction of the Judicial Center, the second phase begins when Craven
County, the Owner, will elect to complete the entrance road construction. During this continued roadway
construction, the responsibility forthe road and disturbed area maintenance will be the Owner or the Owner's
roadway contractor.
The work on this final phase of the entrance road construction will consist of maintaining all erosion
and sedimentation control devices, repairing any damage to the vegetative around cover and final roadway
construction.
The final roadway construction will consist of installing curb and gutter with the concrete flumes,
regrading and adding to the stone base course, rebuilding the shoulders behind the curb and gutter and next
to the flumes, permanently seed the previous area after rebuildinn, the shoulders, remove the remaining
portion of the construction entrance, and the construction road.
