REGAN Secremry BRIAN WRENN Director NORTH CAROLINA Environmental Quality October 5, 2020 Croatan Surf Club Condominium Association, Inc. Attention: Holly O. Quinn, Registered Agent P.O. Box 310 Nags Head, NC 27959 Subject: Stormwater Permit Renewal/Ownership Change Stormwater Management Permit SW7070301 Croatan Surf Club Dare County Dear Holly O. Quinn: A Division of Energy, Mineral, and Land Resources file review has determined that Stormwater Permit SV 7070301 for a stormwater treatment system consisting of underground infiltration trenches serving the Croatan Surf Club located at 1319 N. Virginia Trail, Kill Devil Hills, NC expires on March 19, 2021. This is a reminder that permit renewal applications are due 180 days prior to expiration. We do not have a record of receiving a renewal application. This permit was originally issued to Croatan Surf Club, LLC. A search of the Dare County tax records indication that the property is now owned by the Croatan Surf Club Condominium Association, Inc. The Coastal stormwater rules and the NC General Statutes require a stormwater permit for this project. Stormwater permits are not automatically transferred when property is sold. Please submit a completed permit renewal application and a stormwater ownership transfer application along with a $505.00 processing fee. Permit application forms for renewal and ownership transfer can be found on our website at: https://deq.nc.aov/about/divisions/enerav-mineral-land-resources/erierav-mineral-land- rules/stormwater-program/post-co nstruction. North Carolina General Statutes and the Coastal Stormwater rules require that this property be covered under a stormwater permit. Failure to maintain a permit subjects the owner to assessment of civil penalties. If you have questions, please feel free to contact me at (252) 948-3923. 1 will be glad to discuss this by phone or meet with you. If you would like, I can e-mail you a copy of the application form. Virginia Dare Trail, Kill Devil Hills, Dare County, NC Dear Mr. Vinson: Landmark Engineering & Environmental, P.C. submits this letter for the purpose of providing a stormwater narrative along with attached calculation sheets for the above referenced project. Stormwater storage capacity in the proposed infiltration chambers not including the underlying soil above the seasonal high water table at the site are calculated as providing storage in excess of the 1 inch requirement. Stormwater runoff from impervious surfaces draining to the stormwater management system conservatively consists of 100% of the building, asphalt concrete curbing and dumpster pads (46,178 sq. ft.). Additionally, as requested 100% of the pool, pool decking, and access ramp from the building to the pool area is calculated to drain to the stormwater management system (7,226). The remaining impervious areas, dune walks, dune deck and gazebo, will infiltrate locally. The stormwater management system consists of a collection system of catch basins and stormwater piping, which will convey all of runoff from impervious areas to an underground infiltration system consisting of 142 Stormtech sc740 chambers, and 81 Stormtech sc310 chambers. Stormwater from impervious areas will sheet flow to catch basins (pavement), roof gutter drains, (building) and a perimeter edge drain, (eastern portion of pool deck area). Nyloplast drainage structures as well as concrete catch basins all have sumps providing sediment traps to prevent sediment from reaching the infiltration Chambers. These sumps will be checked and cleaned as part of routine maintenance of the system. Additionally, 4 inch cleanouts will be installed on the first and last stormceptor in every row to provide an additional means of cleaning out and maintaining the stormceptor system without removal of the stormceptor chambers. This is accomplished using a vacuum truck and jetting and vacuuming out any sediments present in the stomceptors. In the unlikely event that the stormceptors underneath the building need to be replaced during the life of the project, they will be able to be accessed due to the frangible nature of the concrete pavement under the building, which is not in any way connected to the building structure above, as required by FEMA requirements in a VE flood zone. Concrete parking slabs are to be frangible, meaning no rebar or welded wire mesh will be present, and are installed with saw cut joints every six feet in both directions. These slabs will be able to be removed by a "bobcat" type piece of equipment. Which would allow access to the underlying stormceptors for replacement. w There are two drainage areas for this project. Drainage area 1 includes all of the building and underlying concrete parking area as well as all of the pool area. Drainage area 1 is further broken down into three sub areas: area 1A consists of the southwestern wing of the building, area 1 B consists of the eastern wing of the building and the entire pool area, and 1 C consists of the northwestern wing of the building. Drainage area 2 consists of all uncovered parking areas (including those areas listed as reserve, which will not be installed, but are required to be shown and included in coverage requirements per the Town of Kill Devil Hills), and dumpster pads. Based on the attached calculation, the system conservatively provides well in excess the NCDE&NR's requirement of storing one inch of runoff over all impervious surfaces Thank you for your time and attention to this matter. Doorman with Atlantic Environmental Consultants. LLC, on behalf of Clarence Dean with Croatan Surf Club, LLC, has requested the attached application be processed underthe Express Permit Review Program, for the construction of 36-unitcondominium building under the name of the Croatan Surf Club. The property is located at 1319 North Virginia Dare Trail in the Town of Kill Devil Hills, on NC Highway 12 adjacent the Atlantic Ocean in Dare County, North Carolina. The proposed project site comprises ±2.8 acres and is the old Quagmires Restaurant and Lounge site. The project site is within the Ocean Hazard Area of Environmental Concern (AEC) as identified in North Carolina Administrative Code 15A NCAC 07H.0304. All development within this area is subject to authorization by the Division of Coastal Management. The property is ±200' wide by ±610' deep. The old restaurant and lounge have been removed with ±11,794 ft2 of concrete and gravel parking area and a section of retaining wall in the area of the old restaurant remaining. The only other structure on the site is a chain link fence along the road frontage, property lines and at the landward toe of the primary dune to prevent access to the site. The majority of the site was cleared when the building was removed and most of this area is void of vegetation. Some upland grass is present adjacent NC 12 and several yucca and cactus plants are located along the north property line at the west end of the site near NC 12. The land disturbance on the site ends at the 145' AEC line. As you move east towards the ocean, a ±70' wide area is undisturbed up to the landward toe of the dune. This area is vegetated sporadically with upland grass and Spartina patens. The dune has a base width of ±90', top width of ±45', is ±26' high and is considered a primary dune. It is vegetated with American beachgrass and S. patens. The waterward side of the dune has a ±3' cut face and this is also the first line of natural stable vegetation as delineated by Lynn Mathis of DCM on 19 January 2007. The beach is ±30' to the normal high water mark at this location. The project site is bordered on the north (upstream) side by the Sea Oats condominium complex. A wooden privacy fence runs the length of this adjoining property along the property line. The project site is bordered on the south (downstream) side by a relatively new 12 bedroom single- family residence that was constructed well landward of the existing setback for this area. A PVC privacy fence runs the length of this adjoining property along the property line. Both adjoining properties have wooden walks over the dune to access the beach area. The Atlantic Ocean is classified as SB by the Environmental Management Commission and is open to shell fishing. Project description The applicant proposes to construct a 36-unit (30,766 ft2) condominium building on the site. Seven of the units will be 2 bedroom and the remaining 29 units will be 3 bedroom. The structure will be four stories tall including the ground floor concrete parking level. The proposed structure will be located immediately landward of the large structure setback line which is 120' at this location. The building will be constructed in a J shape with the bottom of the J facing the ocean. A covered pool is proposed in the open interior area of the building. Two asphalt driveways will give access to the uncovered asphalt parking areas as well as to the concrete parking area under the building and create a circular or looped traffic pattern on the site. Croatan Surf Club Croatan Surf Club, LLC, C/O Clarence Dean Dare County Express Permit Review Program Page Two In the 60' wide small structure setback area between the proposed building and the landward toe of the primary dune, the applicant proposes to construct a recreation area divided into three sections. A main outdoor pool with an ±8' wide concrete apron section will take up most of the area with a kiddie wading pool area with an ±5' wide concrete apron on the north end and a spa with an ±5' wide concrete apron on the south end. Freestanding bathrooms are proposed adjacent the kiddie pool and the spa areas. The three sections will be separated by vegetated landscaped areas that are 4' to 5' wide. The three pool areas described above will impact ±7,226 ft2 of area including the decks and access ramps. Access to the beach will be via two 4' wide wooden ramps that will originate at either end of the main pool area and connect along the landward crest of the dune. Two - 5' wide by 25' long wooden decks are proposed adjacent the walkway along the landward crest of the dune. A single 4' wide wooden walkway will project perpendicular to the crest of the dune with steps to access the beach. A gazebo (±170 ft2) is proposed adjacent the beach access walkway on the waterward crest of the dune. The total impact of the wooden walkways with decks and gazebo is ±1,273 ft2 and will be elevated above the existing vegetation. The applicant proposes to install a Stormtech Infiltration Trench System for stormwater control. The bulk of this system will be installed under the proposed building beneath asphalt parking, with a portion being install under the proposed asphalt parking area between the new building and NC 12. A L.L.P. wastewater system including Advantex treatment units is proposed to handle wastewater. Anticipated impacts The project as proposed will result in the disturbance of ±92,000 ft2 of uplands as a result of the development activities. The project as proposed will result in construction of ±8,594 ft2 (29.7%) of impervious surface within the Ocean Hazard AEC associated with the construction of a portion of the condominium, as well as the outside pools with concrete aprons. The construction of the beach access will impact ±1,273 ft2 of dune structure. The structure as proposed will create a negative visual impact for the existing structure on the southern side. David W. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is 9 feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as 10 feet landward in a major storm.(VE Zwr,e) The floodwaters in a major storm are predicted to be about feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Without the proper signature, the application will not be complete. Appli ant's Signature 8114 Date SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and erosion. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer will determine the vegetation line and setback distance at your site. If thepropertyhas seen little change and theproposed development can still meet the setback requirement, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary. If substantial progress has not been made, the permit must be renewed and a new setback line established. It is unlawful to continue work after permit expiration without this approval.
