Revised plans were received on July 24, 2007. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW7070229 dated July 26, 2007 to Commercial Ready Mix Products, Inc. This permit shall be effective from the date of issuance until July 26, 2017 and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 5. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size b. Project name change C. Transfer of ownership d. Redesign or addition to the approved amount of built - upon area e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 6., The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in. writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built - upon surfaces except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: 5 a. Semi-annual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. III, GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the' Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6 9. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee. shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may. be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 6. Inspect the bioretention area system for soil and mulch erosion, vegetated cover, and general condition after every significant runoff producing rainfall event and at least monthly. Remove trash as needed. 2. Repair eroded areas immediately, rc-secd and re -mulch as necessary to maintain good vegetative and mulch cover. 3. Remove accumulated sediment as needed to maintain good infiltration. When the filtering capacity diminishes substantially (e.g, when water ponds on the surface for more than 24 hours), the top few inches of material must he ranoved and replaoed with fresh planting soil material. The removed sediments should be disposed of in an acceptable manner (eg., landfill): 4. Replace, or add additional mulch as needed. Removal of the old mulch layer before applying the new layer is recommended every 2 to 3 years. 5. Prune tress and shrubs and remove debris on an annual basis. Commercial Ready Mix Stormwater Narrative Existing Conditions: The proposed Commercial Ready Mix site is located on an 8 acres parcel located on lot 1 of the Hertford Industrial Complex in Winton. The parcel is located on Industrial Park Drive and has an existing ditch located along the north, south and west perimeter of the site. The Soil Survey for Hertford County has mapped the soils to consist primarily of Treeloam and soil borings have found large amounts of clay. Elevations on the project range from 42 to 46 feet above sea level. The existing ditched convey the runoff from the site and ultimately to Mill Branch. Proposed Development: Commercial Ready Mix intends to develop the site to serve as a maintenance facility for their associated commercial operations. Plans consist primarily of a large paved area for parking and storage of vehicles as well as two large structures. The land is being developed to convey runoff via sheet flow to two proposed bioretention areas. Permitting Compliance: The site is being developed per the High Density Stormwater Management Option, for the Coastal Counties. Stormwater management for the entire development will be designed and permitted in accordance with the North Carolina Department of Environment and Natural Resources, Stormwater Management Rules. The bioretention areas have been designed to manage runoff produced by one -inch of rainfall. The existing clay soil will be excavated to a depth of 24" and replaced with a loamy sand mixture. Underdrain is provided along portions of the basins edge due toi relatively high inverts within the existing ditch. This runoff is directed to the basins via flumes within the curbed parking area. At this point, riprap has been provided to dissipate energy and distribute the runoff to the basins by level spreaders where possible. Excess runoff is routed through a vegetative filter prior to discharge into the existing perimeter ditches. The submitted information includes the NCDENR Stormwater Management Application, Bioretention Basin Supplement, built upon area calculations, stormwater management drawings, and application fee. The entire site was prior timberland (prior to 1998). Current site condition is cleared with roughly 12" of Fill Sand. The Soil Survey for Hertford County has mapped the soils to consist mainly of Lf (Tree Loam) with a depth to Season High Water Table (SHWT) of 0.5 to 1.5 feet. However, upon completion of recent soil borings, it was determined that this site showed signs of a more Clay subsurface down to 48 inches and no SHWT within the first 60 inches. Albemarle & Associates performed soil borings on November 15, 2006 of the north and south portions of the property where the proposed basins are to be located. Borings were taken utilizing a hand auger down to a depth of 60 inches with little to no variation from one boring to the next. The site consists of "fill" sand to a depth of 12 inches. The section of soil from 12 inches down to 24 inches contains tan clay. The soils in this section were sticky, but friable with no mottling. From 24 inches to 48 inches, the soils are sticky, tan clay with grey loam mix. Again, no mottling was found. The soils found between 48 inches and 60 inches were found to be grey, very sticky loam -clay with some tan mix. This section would be more indicative of the Tree Loam soils as indicated in the Soil Survey of Hertford County. Again, no mottling found. The borings taken were both at approximately a 45.00 MSL ground level. This would put the extent of the boring log down around 40.00 MSL. The adjacent property to the North showed elevations along the 2-foot deep ditch banks of about 42.00 MSL. Some water was observed in these ditches at very minimal depth due to recent rains prior to the site visit. Permeability in the surface soil is considered to be moderate while the subsurface soils have a slow to no permeability rate down to 48 inches. Insped the bioiewntion area system for soil and mulch erosion, vegetated cover, and general condition after every significant runoff producing rainfall event and at least monthly. Remove trash as needed. 2. Repair eroded areas immediately, rc-sced and rc-mulch as necessary to maMtain good vegetative and mulch cover. 3. Remove accumulated sediment as needed to maintain good infiltration. When the filtering capacity diminishes substantially (e.g., when water ponds on the surface for more than 24 hours), the top few inches of material must he removed and replaced with fresh planting soil material. The removed sediments should be disposed of in an acceptable manner (e.g., landfill). 4. Replace, or add additional mulch as needed. Removat of the old mulch layer before applying the new layer is recommended every 2 to 3 years. 5. Prune trees and shrubs and remove debris on an annual basis. Grdased vegetation should not exceed 6 inches in height 6. Treat all diseased trees and shnubs whenever needed.
