We have historically required that the 1" design volume be available between the permanent pool & temporary pool. The other potential problem would be that we might have to take this application out of our Express program and place it in our Routine review program because of the additional time it would take to complete the modeling and bring it before the group at our monthly meetings. It will take time and I'm sure several discussions among the group in order for us to consider changing past policies on how the stormwater rules are implemented, with no guarantee that the group will change policy on this particular design requirement. It seems a much easier task to raise the larger outlet orifices on the outlet structures then it would be to change existing policies that, to my knowledge, have not changed since 1995. If you do decide to make the requested changes and you need an additional few days to complete this, please write, I'll be glad to grant an extension to the new March 19 deadline for submittal. The assessment was conducted on May 23, 2006 on approximately 23.9 acres of primarily undeveloped agricultural land located south of the split between Highway 13 and Highway 561. USGS 7 5-Minute Topographic Map H&H reviewed the USGS 7.5-minute topographic map with coverage of the subject property area. According to the USGS map, no streams are identified on the subject property (Figure 1). Although no streams are identified o❑ the subject property, topography on the map indicates that a drainage feature is present along the northeastern, eastern, and southeastern portions of the subject site and a swamp area is depicted southwest of the subject property. Hertford County Soil Survev Il&H reviewed the Soil Survey of Hertford County to determine if a surface water feature is depicted on the soil survey map (Figure 2). No surface water features are depicted on the subject property in the soil survey. Site -Specific Stream Evaluation On May 23, 2006 H&H conducted a site specific survey of the subject property for jurisdictional streams and completed with North Carolina Department of the Environmental and Natural Resources (DENR) Division of Water Quality (DWQ) guidance forms. Photographs of an identified on -site stream and drainage ditch are included in Appendix B. H&H's findings for the potential stream and drainage ditch are summarized as follows: Northeastern and Eastern Drainage flitch- H&H observed a drainage ditch located in the northeastern portion of the site and along the eastern property boundary (photograph #I). The drainage ditch contained less than I -inch of water of standing water at the time of the site visit and appears to receive stormwater from the subject property and from Highway 13. The northeastern and eastern drainage ditch intersects with an off -site drainage feature at a location on the eastern property boundary. ,ftMrl & Hi(kmdn A PgpRl9i6NaL CpgppgpMly Mr. Josh Pelletier August 17, 2006 Page 3 Southeastern Intermittent Stream — H&t-1 observed that surface water was flowing from the off - site drainage ditch (mentioned above) and into the northeastern and eastern drainage ditch at this location on the eastern property boundary. At this location, H&H noted that the northeastern and eastern drainage ditch appeared to develop characteristics of an internmittent stream (photograph #2). Utilizing the DWQ Stream Identification Form (Version 3.1), H&H verified that the southeastern stream has the geomorphology, hydrology, and biological characteristics necessary to classify the water body as all intermittent stream. The stream length on the subject property is approximately 775 f. These characteristics were absent upgradient of the intersecting drainage ditches. This intersection appears to demark the transition from an ephemeral stream to an intermittent stream on the subject property. Copies for the DWQ Stream Identification Forms for the northeastern and eastern drainage ditch and the Southeastern Intermittent Stream arc provided in Appendix C. In addition, the on -site drainage ditch and stream are depicted on a Wetland Survey revised July 17, 2006 and provided in Appendix D. 3.0 Potential Wetlands H&J-1 reviewed a US Fish and Wildlife Service (FWS) National Wetlands Inventory (NWI) map on the NWI Mapper website. Based upon a review of the NWI map, no potential wetland areas are depicted on the subject property (Figure 3). However, a site -specific survey is necessary to evaluate the presence or absence of wetlands. On May 23, 2006, H&H performed a wetland survey on the property in accordance with the 1987 Corps manual. A wetlands must meet the three criteria of hydrology, hydric soils, and hydrophytic vegetation. H&H noted that although wetland characteristics appear to be present on property located approximately 100 fir southwest of the subject site (photograph #3), it does not appear that potential wetland areas are present on the subject site (photograph #4).
