Inaccordancewith Idle 15 NCAC 2H.1000, the Coastal Stommwater Management Regulations, deed
restrictions and protective covenants are required for High Density ReaMetttial Subdivisions where
lots will be subdivided and sold and runoff will be treated in an engineered stormwater control facility.
Deed restrictions and protective covenants are necessary to ensure that the development maintains a
"built -upon" area consistent with the design criteria used to size the stormwater control facility.

Management Permit Number as issued by the Division of Water Qualty
under NCAC 2H.1000.

maintain compliance with the stomhwater management permit

The following additional information and clarifications are provided in response to your
letter of October 12, 2007 for the above -referenced project.
Enclosed please find three copies of revised sheets C4, C9 and C 11 which show a piping
system to be installed to direct the stormwater from the area in question to pond 43. The
piping system will be installed in the right-of-way of the street.
The previously submitted drainage pattern map will remain unchanged since the runoff
will still go to pond 43. The calculations remain unchanged since we will not be
introducing any new runoff.

This office received a Coastal Stormwater Permit Modification Application and plans for the subject
project on July 11, 2007. A preliminary review of the project indicates that before a State Stormwater permit can
be issued the following additional information is needed.
1. As shown on pages C4 and C9 of the plans, and per additional information provided it appears that the
portion of Brookshire Drive (from station 12-58 to cul-de-sac) and a portion of Westly Drive (from station.
4+00 to the intersection with Brookshire Drive) will be discharging as overland flow to existing 404
wetlands. As per your explanation, that this runoff eventually will make its way to pond =3, the onlc logical
way to reach pond #3 is through the wetlands, draining the wetlands and all surrounding drainage area to
said wetlands. As proposed this system cannot be permitted. Please revise. The plans show that the
Drainage Area to Pond #3 includes the above area. Please revise the drainage pattern and associated
calculations if needed.
2. Please provide two copies of signed and sealed revised sheets and calculations.
The above requested information must be received in this office prior to November 12, 2007 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
items including the application fee. If you need additional time to submit the required information, please mail
or fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules recuire that the permit be issued prior to anv
development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina
General Statute 143-215.1 and may result in civil penalties of up to S10,000 per day.

The following additional information and clarifications are provided in response to your
letter of August 17, 2007 and our telephone conversation of September 7, 2007 for the
above -referenced project.
1. We have corrected the impervious area square footage for the basin information to
match the surface area tabulation and the numbers presented in the calculations.
2. We have revised the receiving stream name to Hayward Creek vs. Haywood Creek.
After further study of the USGS topographic map, we have added a second stream, UT to
Wilson Creek, which drains the large wetland portion of the land where no development
is occurring. Both streams are classified as C;Sw;NSW.
3. We have revised the receiving stream names on sheet C1 of the plans.
4. We have added a benchmark at each of the pond or forebay areas to help assist with
determining the sediment cleanout levels.
5. We have enclosed a signed and notarized deed restriction document showing the
allowable impervious area per lot.
6. As we discussed by telephone, this project has four basins. The basins are connected
with large diameter pipes. Basin #3 is the final basin to which the other ponds drain.
Basin #3 has the only outlet structure. Basin 43 alone has a surface area of 141,855
square feet compared to the SA/DA requirement of 101,677 square feet. We are treating
the other ponds as forebays. With all four basins/forebays combined, the provided pond
surface area is 270,359 square feet. We have added to sheet C4 of the drawings the
delineation of the drainage areas for all of the forebay areas and the pond total surface

areas. We have also included and expounded on this information in a revised stormwater
management narrative which we have attached.
We have also added a forebay area into drainage basin 43 to treat the runoff entering the
pond from the west.

STORMWATER MANAGEMENT NARRATIVE

This project proposes the development of a 130.13 acre undeveloped wooded tract into a
274 lot residential subdivision. The subdivision will have an overall built -upon area of
20.1%. The project will result in the development of high density pockets and will have a
collection system. Therefore, a stormwater detention pond system is proposed in order to
meet the treatment requirements for the runoff from the one inch storm.
The western side of the site consists of a large area of 404 wetlands and undeveloped
uplands. This area will remain undeveloped and will not drain to the detention pond
system. The undeveloped area drains to a different stream (UT to Wilson Creek vs.
Hayward Creek).
Stormwater runoff from the developed areas of the site will be collected in a curb and
gutter roadway system primarily. The main entrance road will have a grass swale
section. There are four ponds located along the entrance road to collect the stormwater
runoff. The four ponds are all connected in series with large diameter pipes with invert
elevations below the permanent pool Ievel. The last pond in the series, basin #3, is the
only pond with an outlet structure. All project runoff from the developed areas ultimately
drains through basin #3.
All pond areas have a permanent pool depth of four feet. The SA/DA requirement for the
project is 2.48% to meet the 90% TSS removal criteria. This value equates to a required
pond surface area of 101,677 square feet. Basin #3 alone provides a total permanent pool
surface area of 141,855 square feet. All four basins combined provide a total pond
surface area of 270,359 square feet which is 266% of the minimum required surface area
at the permanent pool elevation.
The project also has a small pond shown as lake #5 on the northern side of the project.
This pond is not included as a part of the stormwater treatment system although it will
provide some benefit. This pond area is primarily a collection point for runoff in the area
which is directed further downstream to the detention pond system.
The final stormwater pond #3 also receives some stormwater runoff directly along its
western and northeastern sides. Forebay areas are formed into these areas of this final
pond to provide pretreatment of this runoff. vv1tCgR

This office received a Coastal Stormwater Permit Modification Application and plans for the subject
project on July 11, 2007. A preliminary review of the project indicates that before a State Stormwater permit can
be issued the following additional information is needed.
b� Clarify which Impervious area is correct (Stormwater Application form, page 2 table, Drainage Area 1).
V 2. Revise the receiving stream name to Hayward Creek.
✓3. Revise plan sheet C1 for receiving stream name.
J4. Provide a Benchmark for sediment removal for each wet pond.
5. Provide signed and notarized deed restriction document with allowable impervious area per lot.
6. It is impossible to determine the Stormwater model on this project. Multiple ponds with inlets in both
forebay and main ponds will not achieve the 85% TSS removal. Delineate drainage areas to each pond and
direct all inlets to forebays. Provide Wet Detention Supplements for all ponds. Provide all necessary
information and calculations for each pond. If the last pond in this system has large enough Surface area to
handle all of the runoff, than care should be taken that all stormwater runoff is directed to the forebay of
last pond. Please revise
7. Please provide two copies of signed and sealed revised sheets and calculations.
The above requested information must be received in this office prior to September 17, 2007 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
items including the application fee. If you need additional time to submit the required information, please mail
or fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any
development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina
General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day.

1.0 PROJECT DESCRIPTION
This project will involve the development of a 130.1 acre site in order to construct a 270 lot
residential subdivision. The project will have curb and gutter streets, a public water and sewer
system and a series of detention ponds.
No Neuse Riparian Buffer areas exist on the subject property. Section 404 Wetlands exist on the
site as shown. The wetlands will be protected by silt fencing. The wetlands do not occur within
the areas to be cleared or developed at this time.
The area to be disturbed is 79.4 acres in size. A $2,100 land disturbance fee is submitted with
this permit application SINCE A FEE OF $1,900 was previously submitted in conjunction with
the land clearing only portion of this project (CRAVE-2007-040)..
2.0 SITE DESCRIPTION
The total site is 130.1 acres in size and is surrounded on all sides by woodsland with the
exception of a short distance bordered by a public road. The site has flat topography. A large
portion of the site is 404 wetlands, but there is not work proposed in this area.
3.0 ADJACENT PROPERTY
The site is bordered along the north, west and south by undeveloped woodsland.
The site is bordered along the east by a public road for a distance of approximately 600 feet. The
remaining land uses are undeveloped woodsland.
The land clearing proposed under this project will not affect any of the adjacent properties.
4.0 SOILS
The Craven County Soils Survey indicates the Torhunta soil type on the site. The soil is
described as a fine sandy loam in the upper 12 inches and a sandy loam below that depth.
5.0 PLANNED EROSION AND SEDIMENTATION CONTROL PRACTICES
Erosion and Sedimentation Control practices to be utilized on this land clearing phase of the
project include: Gravel Control Entrance, Grassing, Surface Preparation, Surface Stabilization,
Dust Control, Silt Fencing, Inlet Protection, Excelsior Matting and Rip Rap Outlet Protection.
Construction details and specifications for each planned erosion control device are included on
the project plans and are described in this Erosion Control Plan. This Erosion Control Plan will
become a part of the construction documents.
5.1 Gravel Control Entrance
A gravel control entrance will be constructed on the project site at the entrance off of
Trent Creek Road. This location will be the only project entrance. During wet weather, it
may be necessary to wash vehicle tires at this location to prevent the transport of soil onto
the adjacent areas. A detail of the gravel control entrance is included on the project
drawings. Any soil material transported onto the adjacent public road will be removed on
a daily basis or as needed.
5.2 Grassing
The areas disturbed by this project will be stabilized with grass as specified on the project
vegetation plan. Disturbed areas will be reseeded as necessary to establish an adequate
stand of vegetation.
5.3 Surface Preparation
All surfaces will be lightly roughened by discing prior to vegetating. The surfaces of the
slopes will be left in a loose condition and grooved on the contour.
5.4 Surface Stabilization
Surface stabilization will be accomplished with vegetation and mulching as specified in
the vegetation plan.
5.5 Dust Control
Dust will be controlled on the site by sprinkling should excessive dust be generated
during the course of construction.
5.6 Silt Fencing
Silt fencing will be utilized along the 404 Wetlands where they are near the clearing
activity. Due to the relatively flat nature of the site, the silt fencing expected to perform
satisfactorily. No significant amount of stormwater runoff will occur from the subject
property to adjacent properties.

5.7 Inlet Protection Devices
Inlet protection devices will be utilized at all catch basins which are all located within the
curb and guttered roadway. The inlet protection devices will retain sediment outside of
the structure where it can be removed on a regular basis. The device will help to prevent
sediment from entering the stormwater collection system.
5.8 Excelsior Matting
Excelsior matting is specified to stabilize the roadside swales along Savoy Boulevard
which is the only grass swale roadway. The matting will stabilize the bare earth while the
grass grows in.
5.9 Rip Rap Outlet Protection
Rip rap outlet protection will be provided at all pipes in order to prevent scour at the
downstream end. The rip rap outlet devices are provided at all pipe discharges regardless
of the flow.
6.0 SCHEDULE OF EROSION AND SEDIMENTATION CONTROL ACTIVITIES
Included on the project plans is the schedule of erosion and sedimentation control activities.
7.0 MAINTENANCE PLAN
Included on the project plans is the maintenance plan for the project.

Until this permit is modified or rescinded, perm

STANDARD CONDITION FOR GENERAL PERMITS
This General Permit does not relieve the permittee from responsibility for compliance with any
other applicable federal, state, or local law, rule, standard, ordinance, order, judgement, or
decree.
GENERAL PERMIT COVERAGE
All persons desiring to be covered by this General Permit must register with the DWQ or
appropriate delegated agency by the filing of a Notice of Intent (NOI) and applicable fees. The
NOI shall be submitted and a certificate of coverage issued prior to the clearing and grading of a
proposed site.
Any owner or developer not wishing to be covered or limited by this General Permit may make
application for an individual Stormwater Management Permit in accordance with NCAC
2H.1000, stating the reasons supporting the request. Any application for an individual permit
should be made at least 90 days prior to the time the permit is needed.
This General Permit does not cover activities covered by an individual permit. Any person
conducting an activity covered by an individual permit but which could be covered by this
General Permit may request that the individual permit be rescinded and coverage under this
General Permit be provided.
The definition of any word or phrase in this General Permit shall be the same as given in Article
21, Chapter 143 of the General Statutes of North Carolina, as amended. Other words and phrases
used in the General Permit are defined in 15A NCAC 2H.1002.

SECTION A: FINAL LIMITATIONS AND CONTROLS
During the period beginning on the effective date of the general permit, the Permittee is
authorized to clear and grade a proposed site. Stormwater runoff from the site shall be in
accordance with the following conditions:
I . Only clearing and grading activities are permitted. The permittee must submit a
modification and receive approval prior to the construction of any built -upon surfaces.
2. The clearing and grading activity approved for this site is subject to the Sedimentation
Erosion Control (SEC) requirements of North Carolina, therefore, a stormwater
management permit is required for any future development on any part of the project area
covered by the SEC plan.
3. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable parts of the permit.
4. No new stormwater piping shall be allowed except that minimum amount necessary to
direct runoff beneath an impervious surface such as a road and that minimum amount
needed under driveways to provide access to lots.
5. The only runoff conveyance systems allowed will be vegetated conveyances such as
swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and
approved by the Division.
6. The approved Site & Grading plan shall contain the following items:
a. A clear vicinity map showing the direction and distance to the nearest town or
city, street name, street number and the nearest intersection of two major roads.
b. The receiving waters.
C. The site drawn to scale showing all proposed built -upon surfaces.
d. All existing and proposed contours and spot elevations.
e. A legend of all symbols used on the site plan.
f. A delineation of the property lines with bearings and distances.
g. A delineation ofjurisdictional 401/404 wetlands and coastal wetlands, or a note
on the plans stating that none exist.
h. A delineation of the 575' AEC area as applicable.
i. A delineation of the 30' buffer area.
j. A calculation of the proposed amount of built -upon area.

SECTION B: SCHEDULE OF COMPLIANCE
1. The permittee shall at all times provide adequate stabilization measures in conformance
with the approved Site & Grading Plan and Erosion Control Plan.
2. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.
The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, including, but not limited to,
the following items:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign of, addition to or deletion of the approved amount of built -upon area,
regardless of size.
e. Further subdivision of the project area.
f. Alteration of the proposed drainage.
4. The Director may determine that revisions to the project will require a modification to
permit coverage.
5. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the General Permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies of
revised plans and certification in writing to the Director that the changes have been made.
6. Any ponds built or expanded on this project after land disturbance has begun, that might
be used as a stormwater treatment device in the future, must be constructed with a
forebay and a 10' wide 6:1 sloped vegetated shelf, per the requirements of the stonnwater
rules.
7. The site may not be subdivided, sold, or developed with impervious surfaces until a
modification to this permit is submitted and approved.

SECTION C: GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in the General Permit is
considered a violation of NCAC 2H.1000, and is grounds for enforcement action in
accordance with North Carolina General Statutes 143-215.6A to 143-215.6C, or for
certificate of coverage termination, revocation and reissuance, or modification in
accordance with NCGS 143-215.1.
2. The certificate of coverage is not transferable except after notice to and approval by the
Director. In the event of an ownership change, the Director may require a separate NOI
and certificate of coverage. The approval of this request will be considered on its merits,
and may or may not be approved. The permittee is responsible for compliance with all
permit conditions until such time as the Director approves the transfer.
3. The issuance of this general permit does not prohibit the Director from reopening and
modifying the general permit, revoking and reissuing the general permit, or terminating
the general permit as allowed by the laws, rules, and regulations contained in NCGS 143-
215.1 and 15A NCAC 2H.1000.
4. The certificate of coverage is issued in accordance with this general permit and may be
modified, revoked and reissued, or terminated for cause. The notification of planned
modifications or non-compliance does not stay any general permit condition.
5. Upon the presentation of proper credentials, and during normal business hours, the
permittee shall allow the Director, an authorized representative of the Director, or DENR
staff, to enter the property, inspect the project for compliance with the permit, and sample
or monitor for water quality.
6. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
7. Any person who knowingly makes any false statement, representation, or certification
regarding the project shall be subject to civil or criminal penalties.
8. The General Permit, Notice of Intent, Certificate of Coverage, approved plans and
supporting documentation are considered public record and are open for inspection.

1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be

2. No more than —0— square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

any impervious surfaces proposed at this time. The project will involve clearing the roadway
right -of -way areas and other locations where lakes and/or detention ponds are proposed to be
located. A stormwater permit modification will be submitted to cover future development once

Approval of the land clearing phase would allow this work to occur while the final project plans
