Devil Hills, NC expires on April 10, 2021. This is a reminder that permit renewal
applications are due 180 days prior to expiration. We do not have a record of receiving
a renewal application.
Please submit a completed permit renewal application along with a $505.00 fee for
permit renewal. Also, it was noted in the file review that a designer's certification that the
project was constructed in accordance with the approved plans as required by the
permit has not been submitted. Please include this with your application. Permit

Dear Samir:
Attached are responses to your stormwater comments dated March 9, 2007 for the Daniel -Gal
(formerly Woodcat 111) at 710 South Croatan Highway, parts of Lots 1-4, all of Lots 5-8, Block
12, Kill Devil Hills Realty Corp., Kill Devil Hills, North Carolina. This site is a combination of
stormwater management systems.
Responses to the specific comments are as follows:
1) Permit Page 1, was modified to show new project name.
2) Stream classification on Page 2, was changed to SB as requested.
3) We concur with your assessment that the F to 2' separation can not be credited between
the bottom of the stormwater management facility "A" and the seasonal high water table.
The entire storm drain system and basins were raised at least 6" to achieve the required
separation. Basin "A" was changed to bottom = 6.5' and top = 8.8'. Previously, the basin
was at, bottom = 5.7' and top = 8.0'. The inverts of the swales (Basins B and C) were
raised from 6.0' bottom to 6.5'.
4) Assuming the SHWT is 5.0', we raised the entire site/storm drainage system to a
minimum bottom elevation of 6.5', a 1.5' separation. We realize this delta is less than the
preferred 2.0' separation. To compensate, we have achieved a storage volume of 12,654
CF and an infiltration volume (during the storm event) of 5,409 CF. The 1' design storm
is 3,794 CF and the 2" design storm is 7,587 CF. The outfall structure orifice was also
deleted from the previous submittal with the overflow at 8.0'. This design will allow 4 x
the 1" storm event to be managed entirely on site. Please note that the Town of Kill
Devil Hills required storage for the 4.3" storm.

The proposed Daniel -Gal, LLC (formerly Woodcat III Development) is new construction of a
14,287 SF strip shopping center located on a 1.72 acre parcel in Kill Devil Hills, North Carolina.
The site is located at the intersection of South Croatan Highway (US 158) and Baum Street. The
Developer is David Peres, a local retailer in the Outer Banks of North Carolina. The proposed
development site sits on fallow property that has been previously developed, but currently is lightly
wooded and is assumed to have been fallow for at least 10 years. The property is surrounded by
roadway on three sides; South Croatan Highway (US 158 Bypass) to the east, Baum Street to the
south and Blue Jay Street to the west. On the north side of the property, the Brewery Station, a local
restaurant is an active business.
The existing site elevation is around 7.0 to 9.0 (1988 datum) and is very flat with slopes less than
1.0%. The soil report previously submitted identifies the soils as SP, SP-SM and further identifies
the seasonal high water table at 3' below grade or around elevation 5.0'. Existing drainage ditches are
located in the right-of-way to the east and west of the site and currently, stormwater runoff appears to
either be infiltrated or surface flow to these ditch systems. The ditches in the vicinity of the project
are around 5.5' to 6.0' and are dry, re -enforcing the SH WT at the 5.0' to 5.5' range.
For the proposed development, all stormwater runoff will be collected by the curb cuts allowing
stormwater to drain directly to stormwater basins on three sides of the site with connecting leveling
pipes. The infiltration basins vary from T to 2.3' in depth with the largest area "Basin A," a
structural impoundment to provide storage volume. Stormwater Basin "A" has a bottom elevation at
6.5' and a top elevation of 8.8'. Basins "B" and "C" are linear swales with a bottom of 6.5' and top at
8.5'. At several locations, the bottom elevations vary, creating forebays and aiding in the pre-
treatment of the stormwater. Based on the Town requirements, the system is designed for a 10-year
storm (4.3" storm event) and the basins are sized for the 10-year storm. An outlet control structure is
being proposed with an overflow rim elevation at 8.5'. Total storage below the overflow is 17,601
ft3 and the 2.0" design storm volume is 7,587 ft3.

This office received your stormwater application for the subject project on December 4,
2006. A preliminary review of the projects indicates that before a State Stormwater permit can
be issued, the following items must be addressed:
1) Revise page 1 of the Stormwater Management Permit Application to show New
Project Name.
2) Revise page 2 of the Stormwater Management Permit Application to show Stream
Classification SB, rather than SA as shown in application.
3) The revised set of plans, along with site specific information regarding soil and water
table conditions, indicates less than 12-inches of separation between the bottom of
basin A and the seasonal high water table (SHWT). The stormwater rules require 2-
feet of separation for infiltration systems; however, on a case -by -case basis, this
office has permitted a few projects where only 1-foot of separation was attainable
(providing at least 2 times the required storage). To my knowledge, the Division has
not issued stormwater permits for infiltration systems with less than 1-foot of
separation. I suggest that you have your consultants redesign the project to make
sure that all proposed infiltration systems for this site provide at least 12-24 inches of
separation from the SHWT.
4) The calculations show that only basin "A" was used to store required volume for
design storm of 1". Basin "A" has only 0.7 feet of separation from the bottom to
SHWT (see note 3). As per your response, infiltration was only credited for the
swales with bottom elevation of 7.0'. Since actual storage can only be credited from
the bottom of the basin to the lowest point on the containment dike, or the discharge
elevation (in this case the orifice elevation of 6.9'); the required storage will not be
achieved. Please explain.
5) Revise plans, calculations, supplement sheets & stormwater narrative to reflect any
changes.
The above requested information must be received in this office prior to April 9, 2007, or
your application will be returned as incomplete. The return of this project will necessitate
resubmittal of all required items including the application fee. If you need additional time to
submit the required information, please mail or fax your request for time extension to this office
at the Letterhead address.

Pursuant to your request, a representative of GET Solutions, Inc. visited the above
stated site on the date of November 17, 2006. The purpose of our site visit was to
perform shallow subsurface soil exploration and saturated hydraulic conductivity (field
infiltration) testing on the existing shallow subsurface soils.
Shallow Subsurface Soil Exploration and Subsurface Soil Conditions
Our shallow subsurface exploration services consisted of performing two (2) 6-foot deep
hand auger borings (designated as HA-1 and HA-2) within the proposed BMP storm
water management ponds along the northern portion of the proposed development.
These boring locations are illustrated on the Hand Auger Boring Location Plan"
attached to this report (Figure 1)• The sketch was developed based on the plan that
was provided to G E T Solutions, Inc. by Massey Design and Associates, P.C.
The hand auger borings were limited to a depth of approximately 6-feet below existing
grades as a result of caving below the groundwater level. The surficial soils encountered
at the hand auger boring locations to a depth of approximately 2 to 4-inches below
existing grades were noted to consist of Sandy TOPSOIL with roots. Underlying the
surficial organic soils, the subsurface soils were uniform and consistent throughout the
site, and to the explored depths. These soils were primarily granular in nature and were
field classified by the G. E. T. Solutions, Inc. representative to consist of SAND (SP, SP-
SM) with varying amounts of silt.

The subsurface description is of a generalized nature provided to highlight the major
soil strata encountered. The records of the subsurface exploration provided on the
attached Log of Boring sheets and the Generalized Soil Profile should be reviewed for
specific information as to individual borings. The stratifications shown on the records
of the subsurface exploration represent the conditions only at the actual boring
locations. Variations may occur and should be expected between boring locations. The
stratifications represent the approximate boundary between subsurface materials and
the transition may be gradual.
Groundwater Level
The groundwater table depth was measured at each boring location during drilling
operations and was found to occur approximately 3 feet below the existing site
grades. Groundwater conditions will vary with environmental variations and seasonal
conditions, such as the frequency and magnitude of rainfall patterns, as well as man-
made influences, such as existing swales, drainage ponds, under drains and areas of
covered soil (paved parking lots, side walks, etc.). It is estimated normal seasonal high
groundwater level will fluctuate within 2 to 4 feet above the current levels. We
recommend that the contractor determine the actual groundwater levels at the time of
the construction to determine groundwater impact on this project, if any.
Saturated Hydraulic Conductivity (Field Infiltration) Testing:
The infiltration testing was completed within the northeast BMP pond area (HA-1) by
performing a hand auger boring to a depth of at least 2-feet below the encountered
groundwater level at the test location. Following obtaining a relatively static
groundwater level reading, a second hand auger boring was performed adjacent to the
initial boring, at a distance of of least 10-feet. The second hand auger boring was
extended to a depth of approximately 1-foot above the groundwater level previously
encountered. Representative samples of the soils to be tested for Hydraulic
Conductivity were then obtained and sealed in glass jars for laboratory analysis,
including natural moisture and #200 sieve wash testing.
Once equipment setup and subsequent saturation.of the subsurface soils to be tested
was complete, the infiltration rate of the soils was recorded at increments ranging from
100 mI to 200 ml. The records of the infiltration test results are included on attached
"Saturated Hydraulic Conductivity Worksheet". Additionally, the average field
Infiltration test results and the encountered groundwater level for the test location are
provided in Table I on the following page. The attached "Hand Auger Boring Location
Plan" provides the approximate test location.

Dear Samir:
Attached are responses to your stormwater comments for the Daniel -Gal (formerly Woodcat III)
at 710 South Croatan Highway, parts of Lots 1-4, all of Lots 5-8, Block 12, Kill Devil Hills
Realty Corp., Kill Devil Hills, North Carolina. Also please be aware that the Town of Kill Devil
Hills also had comments on the storm drainage system and as a result of the Town's comments,
the available storage was increased significantly to achieve enough storage on -site for a 4.3"
storm.
Responses to the specific comments are as follows:
1) Pasquotank River Basin was noted in lieu of Atlantic Ocean in application. Receiving
stream and class noted.
2) The design was modified to increase the on -site storage as per Town comments.
Infiltration was not credited except for the swales with bottom elevation of 7.0'. No
infiltration credit was taken except for the 4.3 inch and greater storms since this site does
not meet the separation requirements according to your calculations.
3) The discharge orifice was raised to 1.2 foot above the bottom of the basin to increase the
storage under the orifice to 4,592 ft3. Design storm for the 1" is 3,867 ft3. This area
should be considered storage for the water quality volume.
4) Plans, calculations and supplemental sheets have been resubmitted.

This office received your stormwater application for the subject project on December 4,
2006. A site visit and a soil test was performed by me on January 25, 2007. Seasonal High
Water Table was observed to be at approximately 2.5 feet below existing grade (elevation
approximately 6.5 feet), at both Stormwater Management areas "A" and "C resulting in
separation between the bottom of system and the Seasonal High Water table, in range of 0.5-
1.0 feet.
A preliminary review of the projects indicates that before a State Stormwater permit can
be issued, the following items must be addressed:
1) Review page 2 of the Stormwater Management Permit Application to show
Pasquotank River Basin rather than Atlantic Ocean. The Atlantis Ocean should be
listed under the Receiving Steam, and Receiving Stream Class needs to be
determined.
2) As proposed, the basins do not meet the requirements for infiltration basins due to
lack of 2 feet of separation between the bottom of system and the Seasonal High
Water table; either modify the current design, or submit alternative design.
3) Review storage calculations; actual storage can only be credited from the bottom of
the basin to the lowest point on the containment dike, or the discharge elevation (in
this case the orifice elevation); either relocate or remove the orifice, or submit
alternative design.
4) Revise plans, calculations, supplement sheets & stormwater narrative to reflect any
changes.
The above requested information must be received in this office prior to March 1, 2007,
or your application will be returned as incomplete. The return of this project will necessitate
resubmittal of all required items including the application fee. If you need additional time to
submit the required information, please mail or fax your request for time extension to this office
at the Letterhead address.
