Hwy, Jarvisburg, NC expires on January 10, 2021. This is a reminder that permit
renewal applications are due 180 days prior to expiration. We do not have a record of
receiving a renewal application.
Please submit a completed permit renewal application along with a $505.00 fee for
permit renewal. Also, it was noted in the file review that a designer's certification that the
project was constructed in accordance with the approved plans as required by the
permit has not been submitted. Please include this with your application. Permit

The Washington Regional Office received your completed
storwmater application on October 16, 2006. After reviewing the
plans, specifications and supporting information, it has been
determined that this project will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit SW7060618 dated January 10, 2007 to Soundside
Recycling & Materials, Inc. for (2) wet detention ponds to serve
Soundside Recycling & Materials located at Jarvisburg, NC.
This permit replaces stormwater permit SW7000517 previously
issued for this site, and shall be effective from the date of
issuance until January 10, 2017, and shall be subject to the
conditions and limitations as specified therein. Please pay
special attention to the Operation and Maintenance requirements in
this permit. Failure to establish an adequate system for
operation and maintenance of the stormwater management system will
result in future compliance problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the
form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-
7447. Unless such demands are made this permit shall be final and
binding.

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and
volume of stormwater described in the application and other
supporting data.
2. This stormwater system has been approved for the management
of stormwater runoff as described on page 4 of this permit,
the Project Data Sheet.
3. Approved plans and specifications for this project are
incorporated by reference and are enforceable parts of the

4. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales)
shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit
and receiving approval from the Division.
5. The following items will require a modification to the
permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -
upon area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions
to the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes
have been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed
in its entirety, vegetated and operational for its
intended use prior to the construction of any built -
upon surfaces except roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2. The facilities must be properly maintained and operated at
all times. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the
scheduled intervals.
3. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:

a. Semiannual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made
available upon request to authorized personnel of DWQ. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
5. This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of
this permitted facility, a certification must be received
from an appropriate designer for the system installed
certifying that the permitted facility has been installed in
accordance with this permit, the approved plans and
specifications, and other supporting documentation. Mail the
Certification to the Washington Regional Office, 943
Washington Square Mall, Washington, North Carolina, 27889,
attention Division of Water Quality.
7. A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials as may be appropriate. The
approval of this request will be considered on its merits and
may or may not be approved.
2. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6(a) to 143-215.6(c).
3. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

4. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective
action, including those as may be required by this Division,
such as the construction of additional or replacement
stormwater management systems.
5. The permit may be modified, revoked and reissued or
terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does
not stay any permit condition.
6. At least six months prior to the expiration date, the
permittee must submit a written request for permit renewal
to the Division of Water Quality, Washington Regional
Office.

3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the

actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-

11. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Swimmer Best Management Practices Manual
(N.C. Department of Environment, Hcalth and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality
(i.e. stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.

Preface: This narrative is written to supercede the previously submitted narrative. The
Division of Water Quality determined that the project could not be permitted under Low
Density parameters and required modifications to the design BMP to provide more
intensive treatment for stormwater run-off. The BMP selected for this purpose is Wet
Detention Basins.
Soundside Recycling & Materials Inc. is a currently operational facility in the
Jarvisburg community of Currituck County. The operation involves separating and
processing construction, land clearing and demolition waste for recycling or offsite
disposal. The facility is located on a 34 acre tract of land, approximately half of which is
currently cultivated farmland. The prevailing in situ soils are mapped as fine sands in the
Conetoe and Nimmo series. On site soils evaluation (report attached) substantially bear
out these mapped soils boundaries. The existing terrain is essentially flat with slopes
generally less than 1%. There are no U.S.A.C.O.E. or Coastal wetlands existing on
the tract.
The purpose for the expansion is threefold; first, the owners wish to comply with a
directive from the Currituck County Board of Commissioners to move the recycling
operation farther from the US 158 right-of-way and provide better screening, secondly, to
diversify the operation to include composting and thirdly, to provide an area for use by
Dare County as a temporary stockpile area for hurricane generated debris. Both the
composting and the hurricane debris stockpile area will be subject to separate permits and
are for future implementation. Of the two, only the composting operation will involve
impervious coverage. The required concrete pad is shown to assure its inclusion in the
coverage calculations required for the design of the wet detention basin to serve the
subject area. There are two wet detention basins proposed for the portion of the tract
lying to the east of the entrance parking area. The entrance area is currently sloped to
sheet flow to the roadside swale. Since the improvements in this area are established and
no further development is proposed, there are no modifications to this area proposed. The
areas lying to the east of the existing wood chip berm will make up the two tributary
areas for which the ponds are designed. These tributary areas are delineated on the plat.
The area designated as HURRICANE DEBRIS STORAGE AREA is not included within
either of the two tributary areas. No impervious coverage is proposed for this area and
stormwater runoff will continue to sheet flow across the existing field to the existing
drainage ditch, as shown on the plat. The outfall devices for the two wet detention basins
also are designed to drain to this existing farm ditch which drains generally to the
southeast and eventually connects with existing swamp land bordering the Currituck
Sound, approximately 2-3 miles away. Stormwater run-off from both tributary areas sheet
flow to grassed swales which will convey the water to the intended wet detention basin.

stormwater permit; SW7000517; issued July 9, 2000. After reviewing the recent plans and information
provided by Mr. Bob Stewart, it appears that your project will result in high density pockets of
development that will require additional stormwater controls. Before a stomrwater permit can be issued,
the following items must be addressed:
1) Revise application package to show adequate stormwater measures for entire site.
2) Revise site plan & stormwater narrative to show all built -upon areas, (all buildings, concrete,
gravel surfaces & roads should be listed and described).
3) Delineate drainage basins and provide all stormwater calculations.
4) Revise application, plans, details, and narrative to reflect all changes.

The following italicized deed restrictions arid protective covenants are required to be recorded for all

1. The following covenants are intended to ensure ongoing compliance with state stormwater marugeme mt permit
number as issued by the Division of Water Quality. Nese covenants may
not be clanged or deleted without the consent of the State.
2. No more than A11A square feet of any lot shall be covered by strictures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
constriction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity and performance of the system as permitted.

Soundside Recycling & Materials Inc. is a currently operational facility in the Jarvisburg
community of Currituck County. The operation involves separating and processing
construction, land clearing and demolition waste for recycling or offsite disposal. The
facility is located on a 34 acre tract of land, approximately half of which is currently
cultivated farmland. The purpose for the expansion is threefold; first, the owners wish to
comply with a directive from the Currituck County Board of Commissioners to move the
recycling operation farther from the US 158 right-of-way and provide better screening,
secondly, to diversify the operation to include composting and thirdly, to provide an area
for use by Dare County as a temporary stockpile area for hurricane generated debris.
Both the composting and the hurricane debris stockpile area will be subject to separate
permits and are for future implementation. Of the two, only the composting operation
will involve impervious coverage. The required concrete pad is shown to assure its
inclusion in the coverage calculations required for the low density permit application.
The existing and proposed impervious coverage will total 259,486 s.f., 17.5% of the total
tract area. The existing terrain is essentially flat with slopes generally less than 1%.
Stormwater run-off will sheet flow or flow by shallow, grassed swales to a "spillway
Swale" located parallel to the main roadway through the facility. This swale will be
constructed so that the far side bank will be 0.2' lower than the roadside bank. When the
swale fills with run-off water it will overflow on the far side bank and sheet flow across a
grassed filter approximately 70' in width and graded to a 3% slope. Ultimately, the water
will be collected in an existing farm ditch which drains generally to the southeast and
eventually connects with existing swamp land bordering the Currituck Sound,
approximately 2-3 miles away. Other than culverts at road crossings, no formal
stormwater conveyance system is proposed. There are no U.S.A.C.O.E. or Coastal
wetlands existing on the tract.

Stormwater Application for the subject project on May 8, 2000.
Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW7000517 dated July 10, 2000 to Mr. H.D. Newbern, IV.
This permit replaces SW7991014 shall be effective from the
date of issuance until rescinded and shall be subject to the
conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form
of. a written petition, conforming to Chapter 150B of the North

I. DESIGN STANDARDS
1. The following criteria are approved as meeting the stormwater
rules for this project:.,
a. The total project area is 33.acres.
b. Total impervious area proposed is 2.39 acres.

d. Allowable built -upon area must be consistent with
proposed restrictions submitted in the application by the
permittee.

foot wide vegetative buffer between all impervious areas and
.surface waters. In addition, projects in the Neuse River
Basin must comply with the Neuse Riparian Buffer Rules.
8. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
9.. Deed restrictions are incorporated into this permit by
reference and must be recorded with the Office of Register of
Deeds. ,A copy of the recorded restrictions must be received
by this 'Office within 30 days of the .date of recording.
Recorded deed restrictions must include, as a minimum, the
following statements related to�stormwater management:
a_ 'A statement.of.the allowable built -upon area per lot in

acres,inclusive of that portion of the right-of-way.

12. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in .the notice, the
permittee shall submit a.written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee shall comply with the following schedule for
construction and .maintenance of the Low Density Option
stormwater systems:

a: Swales and other vegetated -conveyances shall"' be
constructed in' their _ entirety,' vegetated, and .be
operational for their intended use prior to the
construction of any built -upon surface except roads. .
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the swales or - other vegetated

2: The permittee shall, at all times provide theoperationand
maintenance necessary to operate`'the' permitted• stormwater
management systems at optimum efficiency to include:
a. Inspections
b. Sediment removal
c. Mowing, and revegetating of the side slopes'
d. "Immediate repair of eroded areas
e_ Maintenance. of side .slopes in accordance with approved
plans and specifications.
3. The permittee shall submit recorded deed restrictions limiting
built -upon area per lot in accordance with Part I, item 9,
within 30 days of the date of recording.
4. The Permittee shall submit the Engineer/Owner/Designer/
Permittee Certification in accordance with Part I, item 12,
within 30 days of completion of the project.
5. The permittee shall submit all information requested by the
Director or his representative within the time frame specified
in the written information request.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions .and limitations contained
in this permit may subject the Permittee to an enforcement
action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143=215.6C.
2. The permit issued shall continue in force and effect until
revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance, or termination does not stay any
permit condition.

4. The issuance :of this permit does not prohibit the Director
from reopening and modifying the permit, revoking and
reissuing the permit, or terminating the permit as allowed by
the laws, rules and regulations contained in Title 15A of the
North Carolina Administrative Code, Subchapter 2H.1000; and
North Carolina General Statute 143-215.1 et.al.
5. The-,.permittee: shall submit' to •_the Director, -and shall have
received approval for 1 revised -.plans',: specifications, and
calculations prior to construction, for. those revisions under
•• any,'of,the following`conditions

a. Any additions, deletions or redesign of the previously
permittedamount of built -upon area .proposed regardless
of the size of the modification.

6. The, permit is not transferable' to any person except after
notice to .and approval by the Director. The Director may
require modification or revocation and reissuance of the
permit to change the name and incorporate such other
requirements .as. may- be_ necessary.,,.. .-A, request
must be submitted to the Division of Water Quality accompanied
by the appropriate fee, documentation from both parties
involved, and other supporting'materials as may be
appropriate.. The approval of this request will be considered
on its merits, and may or may not be approved.
7. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state and federal) which have jurisdiction.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a
table listing each lot number, size and the allowable built -upon area for each lot must be provided as an
attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit
number as issued by the Division of Water Quality. These covenants may
not be changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted storrwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity and performance of the system as permitted.

shall include all the applicable items required above, that the covenants will be binding on all parties and

Storm Water Management Narrative
The storm water for the site located off of B ter Newbern Road (SRI 121) will be
directed to flow onto the Bermuda sod field to th Nort of the recycling site. There is a natural
slope less than one percent from the south side oft a site to the Bermuda sod field. The storm
water run off from the existing dirt roads drain into the ponds and loading dock to evaporate. The
2-Acre Recycling Site will be used to dump, sort, and process construction waste for recycling.

collection system as defined by 15A NCAC 2H .1002(18). Low density requirements and density factors can

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted

Storm Water Management Narrative
The storm water for the site located at 7565 Carotoke Highway will be directed to flow
onto the Grass pasture to the North, East, and South of the recycling site. There is a natural hill
that has less than one percent slope where the recycling area will be. This will not be changed
and will allow storm water to slowly run to a lower area and seep in. The storm water run off
from the road drain swell will drain onto the pasture to evaporate. The 2-Acre Recycling area
will be used to dump, sort, and process construction waste for recycling. The recycling area and
entrance road will be impervious area of ABC stone or asphalt shingle scrap. The drain swale
will be seeded with fescue and will be mulched to prevent erosion.
