Bern, NC (Stormwater Permit No. SW7060612 Modification). We had our surveyors field verify elevations, locations of
inlets and outlets, and provide enough topographic information for us to verify pond volumes and surface area. 1 will

❑ I am writing on behalf of our client, McCarthy Court 111, LLC regarding the
PRINCIPALS, Notice of Violation for Permit Condition Violations on their site in New Bern,
Thomas J. Stone NC. Our firm was the designer of the stormwater BMP on this site. We are
Jahn P. warren, AIA working with the owners to correct this violation. We will contact a surveyor and
Mark J. Davis, P.E. have them obtain the elevations and topographic information necessary for us to
check and certify the stormwater BMP. We plan to have the surveyor on site no
later than Friday, February 25". Once we get the field survey information, we
ASSOCIATES will complete the certification and send it to your office by March I lth. I hope

Dear Mr. Bateman:
This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 2H
.1003 for failing to comply with terms, conditions and limitations of a Stormwater Management Permit
No. SW7060612.
On December 7, 2010, Samir Dumpor of the Washington Regional Office performed an inspection to
determine the status of compliance with Stormwater Permit SW7060612. Permit Number SW7060612
was issued to you on May 2, 2007 for the McCarthy Court 3, located along the McCarthy Boulevard, in
New Bern, Craven County, North Carolina.
As a result of the site inspection and DWQ file review, the following observations and violations are
noted:
1. Failure to Submit a Designer's Certification
Title 15A NCAC 211 .1008 Q) and stormwater Permit Number SW7060612, Condition 11.6, requires that
upon completion of construction, the designer for the type of stormwater system installed must certify that
the system was inspected during construction, was constructed in substantial conformity with plans and
specifications approved by DWQ, and complies with the requirements of this Section. As of the date of
this letter, DWQ has not received this certification.
Required Response
This Office requires that you respond to this letter in writing to the address listed at the bottom of the
letterhead within 30 calendar days of receipt of this Notice. Please provide a written "Plan of Action"
which outlines the actions you will take to correct the following violation(s) and a time frame for
completion of those actions.

By copy of this letter to the Craven County Inspection Office, DWQ is requesting that the Building
Inspector consider withholding building permits and Certificates of Occupancy for this project until this
matter is satisfactorily resolved.
Thank you for your attention to this matter. This Office is considering sending a
recommendation for enforcement to the Director of the Division of Water Quality regarding
these issues and any future/continued violations that may be encountered. Your above -
mentioned response to this correspondence will be considered in this process. This office
requires that the violations, as detailed above, be abated immediately. These violations and
any future violations are subject to a civil penalty assessment of up to $25,000.00 per day
for each violation. Should you have any -questions regarding these matters, please contact Samir
