Land Resources (DEMLR). A complete package includes all of the items listed below. A detailed application
instmction sheet and BMP checklists are available from

W.R. Toole Engoinecrs, Inc. (WRTE) and the Owner (New Bern Mall, LLC) is requesting the
amendment of the Storinwater Permit #SW7000718 located at Martin Luther King Jr. Blvd as
summarized below.
The current detention pond was designed and approved based on the following site characteristics:

The pond in its current designed configuration provides f, as measured to the concrete

spillway. Based on the required storage volume of 150, fo, t d provides additional storage
capacity totaling approximately 38,644 ft'. Based on development requirements for stormwater
storage utilizing a design runoff Of 1.5" for any new impervious area, the new pond could potentially
provide a design storage capacity for an additional 7.09 AC.
Attached is a site plan dated 11/10/2014 proposing a newly developed parcel (Starbucks) adjacent to
the existing Mattress Firm parcel. Stormwater runoff from the undeveloped Starbucks parcel currently
flows from the site to the open ditch along MLK Jr Blvd. Proposed improvement to the Starbucks
parcel will redirect stormwater runoff to the Newbem Mall stormwater detention pond. The parcel will
contribute runoff for 0.45 AC total of which 0.29 AC will be impervious. The required stormwater
storage volume associated with this new impervious area is 1580 ft' (0.29 AC * 1.5") whicli is within
the additional available capacity of the pond.
In order to confirm the function of the pond and contributing storm sewer system, the original
hydrologic and hydraulic models were updated to add the proposed Starbucks parcel to the overall
Newbern Mall drainage basin. A revised drainage basin map showing the additional area is attached.
The Starbucks parcel contributing to the New Bern Mall basin is 0.45 AC, with a composite CN = 95.

Hydraulics: Although the pond provides adequate volume, WRTE models indicate that localized
flooding,may be experienced within the parking lot of mall. This condition is due to the head water
elevations in the pond during frequent, storm events that are in excess of the throat and grate trap
elevations of the storm sewer system catch basins.

construction of impervious areas with runoff to be treated in an offsite permitted stormwater
facility, in compliance with the provisions of Session Law 2008-211 and 15A NCAC 2H .1000
(hereafter referred to as the "stormwater rules') and the approved stormwater management
plans and specifications and other supporting data as attached and on file with and approved
by the Division of Water Quality and considered a part of this permit. The stormwater runoff
from the site will be routed to a wet detention pond operated and maintained by H/S New
Bern Outparcels, LLC under the terms and conditions set forth in Permit No. SW7000718
Modification issued December 12, 2011.
This permit shall be effective from the date of issuance until rescinded, and shall be subject
to the following specified conditions and limitations:
1. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
The runoff associated with this project has been approved to be discharged into a
stormwater management system permitted under SW7000718 Modification, as
described in Section 1.5 on pa.ge 3 f thi ermit. This project is listed as the Outparcel
0 11s
for future development, and allowable buift-upon area Tor outparcel is 2.59 acres or
83%. as shown in Permit SW7000718 Modification.
3. The built -upon area allotted to this development by Stormwater Management Permit
No. SW7000718 Modification, is 71,676 square feet (or 83% of this outparcel area).
This project proposes 67,990 square feet of impervious area.
4. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
5. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
The runoff from the permitted built -upon area must be directed into the permitted
stormwater system.

The offsite stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface associated with this project.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee is responsible for keeping the stormwater collection system on the lot
clear of debris, and keeping the site stabilized in accordance with the requirements of
the NC Erosion and Sediment Control Design Manual.
4. HIS New Bern Outparcels, LLC, shall, at all times, provide the operation and
maintenance necessary to assure the permitted stormwater management system
functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the scheduled intervals
including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
.d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins
and piping.
9. Access to the outlet structure must be available at all times.
The permiftee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition or selling of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.

6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. H/S New Bern Outparcels, LLC, must kee ecords of maintenance activities and
make them available upon request to autho Prizred personnel of DWQ. The records will
indicate the date, activity, name of person performing the work and what actions were
taken.
8. This permit shall become voidable unless the facilities are constructed in accordance
with i , he conditions of this permit, the approved plans and specifications, and other
supporting data.
9. H/S New Bern Outparcels, LLC, is responsible for providing, prior to issuance of a
Certificate of Occupancy, and prior to operation of the permitted stormwater
management facility, a certification from an appropriate designer for the system
installed, certifying that the permitted facility has been installed in accordance with
Stormwater Permit No. SW7000718 Modification, the approved plans and
specifications, and other supporting documentation. Any devi " ations from the approved
plans and specifications must be noted on the Certification.
10. A co% of the approved plans and specifications shall be maintained on file by the
Permi ee for a minimum of ten years from the date of the completion of construction.
11. This lot is limited to the amount of built -upon area indicated in the supporting
calculations and per aFproved plans. The project must have a built -upon area less than
or equal to the amoun permitted under Stormwater Permit No. SW7000718
Modification. Additional built -upon area will require a modification to the overall Permit.
12. H/S New Bern Outparcels, LLC, must record any deed restrictions as required by their
permit, and they must verif6that the proposed built -upon area does not exceed the
allowable built -upon area. nce the lot transfer is complete, the built -upon area may not
be revised without approval from the permittee, and responsibility for meeting the built -
upon area limit is transferred to the individual property owner.
13. The drainage features shown as a part of the stormwater management system on
the ap roved plan shall not be filled in, altered, or piped by any party without first
submiqing a revision to the permit an receiving approval from the Division.
14. The Director may notify the permittee when the,F.ermitted site does not meet one or
more of the minimum requirements of the perm Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
111. GENERAL CONDITIONS
This permit is not transferable ex r cept after notice to and approval b�, the Director. In
the event there is a desire for the facilities to change ownership, or here is a name
change of the Permittee, a formal permit request must be submitted to the Division of
Water Quality accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this
request will be considered on its merits and may or may not be approved. The
permittee is responsible for compliance with all terms and conditions of this permit until
such time as the Director approves the permit transfer.
Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to enforcement action by the Division of Water Quality, in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from comp ing with any
and all statutes, rules, regulations, or ordinances which may be imposV by other
government agencies (local, state, and federal) which have jurisdiction.

4. In the event that the offste stormwater facilities fail to perform satisfactorily, including
the creation of nuisance conditions, H/S New Bern Outparcels, LLC is responsible for
taking immediate corrective action, includinq those as may be required by this Division,
such as the construction of additional or replacement stormwater management
systems.
5. The permittee grants permission for DENR Staff to enter the property for the purpose of
inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance or termination does
not stay any permit condition.
7. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.

As per our site visit on August 18, 2011 please find attached the grading, drainage, and
erosion control plan showing the area in question dated September 9, 1991. The exhibit
was prepared for the expansion of the K-mart on -site and depicts the curb cuts that allows
for the onsite storm water detention, and the area being designed for a silt basin.
It is our opinion that the attached grading, drainage, and erosion control plan adequately
demonstrates that the area in question is juristiciontonal tinder Section 402 of the Clean
Water Act. Therefore, the 0.35 acre area should be except under Section 404 of the
Clean Water Act, and not require USACE� permitting in order to construct the proposed
stormwater ponds.
The applicant, Hull Story Gibson Companies, LLC — Mr. Steve Mitchell, respectfully
request a letter from your office authorizing the 0.35 acre area is jurisdictional Linder
Section 402 of the Clean Water Act in effort to move forward with permitting the
proposed stormwater improvements with North Carolina Department of E-tivironnient and
Natural Resources- Division of Water Quality.

The Washington Regional Office received a complete Stormwater Modification Application for
Twin Rivers Mall Project on November 28, 2011 and additional information on December 5,
2011. Staff review of the plans and specifications has determined that the project, as
proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H. 1000
and Session Law 2008-211. We are forwarding Permit No. SW7000718 Modification dated
December 12, 2011, for a wet pond to serve this project. This Modification is to include the
abandonment and filling of existing stormwater wetland, creation of a new wet pond at the rear
of the property, revision to underground stormwater collection system and addition of built -
upon area at the newly created outparcel (at the location of existing stormwater wetland).
This permit shall be effective from the date of issuance until December 12, 2021, shell void
permit SW7000718 issued October 19, 2009, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequate system for operation
and maintenance of the stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such
demands are made this permit shall be final and binding.

construction, operation and maintenance of a wet pond in compliance with the
provisions of 15A NCAC 2H .1000 and Session Law 2008-211 (hereafter referred to as
the "stormwater rules') and the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until December 12, 2021, and
shall be subject to the following specified conditions and limitations:
1. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 37.44 acres of existing
impervious area and 2.59 acres (83%) of proposed impervious area for
outparcel, totaling in 40.03 acres of impervious area.
3. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
4. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.
5. The following design elements have been permitted for this wet detention pond
stormwater facility, and must be provided in the system at all times.

1 No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any
vegetative practices (such as swales) shown on the approved plans as part of
the stormwater management system without submitting a revision to the permit
and receiving approval from the Division.
2. The permittee is responsible for verifying that the proposed built -upon area for
the entire lot, including driveways and sidewalks, does not exceed the allowable
built -upon area. Once the lot transfer is complete, the built -upon area may not be
revised without approval from the Division of Water Quality, and responsibility for
meeting the built -upon area limit is transferred to the individual property owner.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of bypass structure, infiltration media, flow
spreader, catch basins, piping and vegetated filter.
g. A clear access path to the bypass structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.

5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
7. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Ma
,jor permit was sought.
f. Fil I ng in, altering, or piping of any vegetative conveyance shown on the
approved plan.
The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
9. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times.
10. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
11. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
12. If the stormwater system Was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
14. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW7000718 Modification,
as issued by the Division of Water Quality under NCAC 2H. 1000.
b. The State of North Carolina is made a beneficiary of these covenants to

the extent necessary to maintain compliance with the Stormwater
Management Permit.
C. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina,
Division of Water Quality.
e. Alteration of the drainage as shown on the approved plans may hot take
place without the concurrence of the Division of Water Quality.
f. The maximum built -upon for outparcel is 2.59 acres (83%). This allotted
amount includes any built -upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line
and the edge of the pavement. Built upon area includes, but is not limited
to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and
parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools.
9. All runoff on the lot must drain into the permitted system. This may be
accomplished through providing roof drain gutters which drain to the
street, grading the lot to drain toward the street, or grading perimeter
swales and directing them into the pond or street. Lots that will naturally
drain into the system are not required to provide these measures.
h. Built -upon area in excess of the permitted amount will require a permit
modification.
The owner of each lot within the subdivision, whose ownership is not
retained by the permittee, must submit a separate Offsite Stormwater
Management Permit application package to the Division of Water Quality
and receive a permit prior to any construction on the lot.
15. A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots. The recorded
copy must contain all of the statements above, the signature of the Permittee,
the deed book number and page, and the stamp/signature of the Register of
Deeds.
Ill. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
The permitee is responsible for compliance with all of the terms and conditions of
this permit until such time as the Director approves the transfer request.
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in

accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.
10. This permit shall be effective from the date of issuance until December 12, 2021.
Application for permit renewal shall be submitted 180 days prior to the expiration
date of this permit and must be accompanied by the processing fee.

October 19, 2009, for a stormwater wetland to serve this project.

r review. As we discussed by phone in late November, Hull Storey New Bern, LLC
evelopment exclusion from stormwater permitting based on the following:
Total site disturbance has been limited to 0.95 acres +/-.
There will be no net increase in run-off from the site. Pervious areas in the form of
landscaped islands and planting beds will be added as part of the redevelopment.
Stormwater from the redeveloped site will be controlled equal to or better than
existing conditions.
As you will note, a portion of the existing mall will be demolished to allow for the
construction of the new TJ Maxx. Additionally, minor island changes and restriping will occur in
the existing parking lot.

I have enclosed three sets of Site Development Plans for the proposed New Bern Mall Michael's
and Shoe Store for your review. Hull Storey New Bern, LLC requests a redevelopment exclusion from
stormwater permitting based on the following:
I Total site disturbance has been limited to 0.80 acres +/-.
2. There will be no net increase in run-o from the site. Pervious areas in the form of
landscaped islands and planting beds will be added as part of the redevelopment.
3. Stormwater from the redeveloped site will be controlled equal to or better than existing
conditions.
4. Stormwater from the disturbed areas discharge to an existing, on -site stormwater
management facility with North Carolina permit number SW7000718, renewed October
19,2009.
As you will note, a portion of the existing mall will be demolished to allow for the construction of
these new tenants. Additionally, minor island changes and restriping will occur in the existing parking lot
to provide truck access to the new loading areas.

On June 2, 2010, the Washington Regional Office of the Division of Water Quality received a request to exclude the
subject proposed redevelopment project, located at 3 194 Dr. MLK Blvd, New Bern, North Carolina, from Stormwater
Management Permit requirements. Staff review of the plans and supporting documents has determined that the project
proposes activities that are excluded from State Stormwater permitting requirements as set forth in Section 2.(d)(3) of
Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC 2H . 1000, as
amended.
Therefore, the Director of the Division of Water Quality is hereby providing confirmation that the subject project is
excluded from State Stormwater permitting requirements under the following conditions: 1) The project must be
constructed as shown on the plans submitted to this Office; 2) The proposed New Bern Mall - Michael's and Shoe Store
project, represent overall reduction of approximately 1,800 square feet of existing built -upon area; and 3) The proposed
stormwater control, provides at least equal protection of surface waters as the existing stormwater control, provided by
utilizing the sheet flow.
The existing built -upon area mentioned in this exclusion request is covered under the Twin Rivers Mall Stormwater
Permit Number SW7000718. During the Exclusion review process it was determined that this change will constitute
minor Plan Revision for said Stormwater Permit, with no further action on your behalf required.
Under Section .1 003(b) of the stormwater rules, the entire common plan of development must be permitted. Therefore,
any future development or changes to the proposed development, including but not limited to, the locations of the built -
upon area and construction of additional built -upon area, may require approval or a Stormwater Management permit
application and permit issuance from the Division of Water Quality prior to any construction. Any construction on the site
prior to receipt of the required approval or permit will constitute a violation of Title 15A NCAC 2H. 1000 and Session
Law 2008-211, and may result in the initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits and approvals,
which may be required by Federal, State, or local government agencies, rule or law, If you have any questions, or need

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW
SW7000718 to for Twin Rivers Mall - New Bern on 9/25/2000. This permit expires on
9/25/2010. Section .1 003(h) of 15 A NCAC 2H . 1000 (the stormwater rules) requires that
applications for permit renewals shall be submitted 180 days prior to the expiration of a permit
and must be accompanied by a processing fee, which is currently set at $505.00. The Renewal
Application Form can be downloaded at http://www.ncwaterguality.org/su/bmp forms.htm.
If this is still an active project please complete and submit the renewal application in a timely
manner. If this project has not been constructed and a permit is no longer needed, please
submit a request to have the permit rescinded. If you have sold the project, or are no longer the
per�mittee, please provide the name, mailing address and phone number of the person or entity
that is now responsible for this permit. A form for change of ownership, should be completed
and submitted if the property has changed hands. This form can be found at the above website
address.
Your permit also requires that upon completion of construction and prior to operation of the
permitted treatment units a certification of completion be submitted to the Division from an
appropriate designer for the system installed. This is to certify that the permitted facility has
been installed in accordance with the permit, the approved plans, specifications and supporting
documentation. Please include a copy of the certification with your permit renewal request and
pro I cessing fee.

4.. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
5. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -upon
area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions
to the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit.- Withirf -tlYe-- time- frame specified -in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surfaces
except roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2. The facilities must be.properly maintained and opierated at all
times. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals.
3. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:

a. Serni-annual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4 Records of maintenance activities must be kept and made
available upon request to authorized personnel of DWQ. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
S. This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropri��te designer for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the
Washington Regional Office, 943 Washington Square Mall,
Washington, North Carolina, 27889, attention Division of Water
Quality.
7. A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials as may be- appropriate. The
approval of this request will be considered on its merits and
may or may not be approved.
2. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Water Quality, in accordance with North
Carolina General Statute 143-215.6(a) to 143-215.6(c).

3. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any
permit condition.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number.

changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick. stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the storm water control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
