After a preliminary review of the application package, I have the following comments/additional information request.
1. The bio-retention supplement form shows that a cell with trees/shrubs was selected and lists the depth of mulch as 0
with a note of 'insufficient mulch depth, unless installing grassed cell'. Need to revise supplement form to show
appropriate depth of mulch.
2. The planting plan section of the supplement is blank and needs to be completed.
Please provide above revisions on or before February 15, 2012. If you need additional time or have any questions please
contact me.

As you are aware, this office issued a Notice of Violation (NOV) letter dated September 2, 2011 to your
attention for failure to obtain a State Stormwater Management Permit prior to construction of built -upon
area (BUA) associated with the subject facility. The NOV was issued based on information received from
staff with the Town of Southern Pines as well as a file review by Mike Lawyer with this office. This
information concerned a timeline of events of land disturbing activities and construction during 2004 and
again in 2007/2008. After receiving a response to the NOV letter from Mr. Scott Matthews, an onsite
meeting in which you, Mr. Matthews and Mr. Lawyer attended was held to discuss the timeline of events.
Subsequent to that meeting, Mr. Lawyer met with Mr. Brent Lockamy, Town Engineer with Southern
Pines, to also discuss the events in 2004 and 2007/2008. Based on the outcomes of these meetings as
well as additional information provided by Mr. Matthews and Mr. Lockamy, it would appear as though the
work completed in 2004 added BUA to the existing development, but did not exceed one acre in land
disturbance. Additionally, work conducted in 2007/2008 did exceed one acre of land disturbance, but did
not result in the increase of BUA. Stormwater Management Permitting is essentially triggered by the
project location (such as being within an HQW watershed), land disturbance of one acre or greater and
the addition or increase of BUA. With respect to these rules and the aforementioned clarification of the
activities conducted in 2004 and 2007/2008, the Fayetteville Regional Office of the Division of Water
Quality hereby rescinds the Notice of Violation dated September 2, 2011 that was issued to Sandhills
Classical Christian School.

After much discussion and review of documents pertaining to work previously conducted at Sandhills Classical as well as
discussion with my supervisor, Belinda Henson, our office has decided to rescind the Notice of Violation dated

Hi Mike,
I've done little more research. I've attached the original erosion control plan that the Town of Southern Pines
issued a NOV on. The disturbed area matches the Oct 2007 EC permit with 1.12 acres disturbed, but does not
include any impervious surface. (gravel parking lot, basketball court, or the classroom building built in '04). I've
also added the approximate disturbed area for the gravel parking, basketball court, and the classroom building
together and came up with a disturbed area of 28,969 sf. This would be the worse case scenario and is well
below the 43,560 sf requirement for a stormwater management permit.
Per our on -site meeting, a stormwater permit would not be required if it did not include any built -upon area.
This looks to be the case.
Let me know what you think. The Town should have this plan on record to support my findings.

This letter is to notify you that you are in violation of Title 15A North Carolina Administrative Code (NCAC)
2H .1003 in accordance with North Carolina General Statute (G.S.) §143-214.7 for failure to apply for and
secure a Stormwater Management Permit for the subject project.
Our office has been made aware that the subject development project was originally approved in 2001
prior to the reclassification of Mill Creek from WS-III to WS-III,HQW in August 2002. Subsequent additions
to the development occurred in 2007/2008 and approval for an Erosion and Sediment Control Plan for
further development was granted by the Town of Southern Pines on May 11, 2011. A letter dated May 16,
2011 was sent via Certified Mail to your attention regarding the requirement to obtain a State Stormwater
Management Permit for the construction of built -upon areas within one mile of and draining to High
Quality Waters (HOW) as is the case with the subject project.
A review of DWQ files confirms that a State Stormwater Management Permit has not been issued prior to
the construction of built -upon areas at the subject site as described above. As a result, the following
violation is noted:
Title 15A NCAC 2H .1003, in accordance with G.S. §143-214.7, requires a State Stormwater
Management Permit for development activities that require a Sedimentation/Erosion Control Plan and are
within one mile of and draining to High Quality Waters (HQW). DWQ file review confirms that a State
Stormwater Management Permit was not obtained prior to the construction of built -upon areas at the
subject site as described above.
Required Response
This Office requests that you respond, in writing, within 30 calendar days from receipt of this Notice.
Your response should be sent to this office at the letterhead address and should address the following
items:
Please explain when construction (excavation, grubbing, and clearing) began at the site.
2. Please clearly explain why the Stormwater Management Permit was not obtained.

3. Submit a complete permit application with a completed supplement form, a signed O&M
agreement, sealed calculations, and two sets of detailed plans along with the processing
fee currently set at $505. Please note that a Designer's Certification is also required upon
project completion.
Thank you for your immediate attention to this matter. Please be advised that this violation and any
continuing or future violation(s) are subject to a civil penalty assessment of up to $25,000 per day
for each violation pursuant to North Carolina General Statute 143-215.6A.

We do have the plans for the projects done on this site. 1t is my understanding that the Town does not nor has it "held"
a 5/70 exemption for projects and in addition previous projects on this site did not meet the qualifications (>24%
impervious) for the 5/70 exemption. Therefore a 5/70 exemption could not have been granted.
While the Town has approved the erosion control plans for various projects all approvals have had the following
stipulation attached "
The developer is responsible for obtaining any and all permits and approvals necessary for the development of
this project prior to the commencement of this land -disturbing activity This could include the Division of
Environmental Management under storm water regulations, the US Army Corps of Engineers under Article 404
jurisdiction, local county or town agencies under their local ordinances, or others that may be required. This approval
cannot supersede any other permit or approval; however, in the case of a Cease and Desist Order from the Corps of
Engineers, that Order would only apply to wetland areas. All other lands must still be in compliance with the
Sedimentation Pollution Control Act.".
This is further indicated in the March 31, 2008 letter from the Town that specifically ask the developer to Please contact
Mike Lawyer with NC DWQ in Fayetteville.
It is our understanding from discussion with NCDWQ that the site will be placed under a notice of violation (NOV) within
the next couple of days. The NOV will require the site to become compliant for the previous work completed that does
not have the required Stormwater permit. The forthcoming letter from DWQ will explain the requirements for
compliance.
As for the proposed building addition and the current proposal to add the path to exceed the 24%and obtain a 5/70
exemption the Town is going to deny the request for the 5/70 exemption. The proposed project will need to obtain a
stormwater permit from the State. This permit should be able to be done in conjunction with the work required to
satisfy the NOV. We are also disapproving any change to the erosion control plan at this time. You may still request the
approval of the additional disturbance due to the addition of the gravel path but the plans will need to be revised to
reflect the new disturbed area. In addition, the FRO form will need to be updated and any required fees will be
required.

Kathy,
You should have a record of the approved plan for the 1st Classroom Building, and I'm not surprised that you
don't have a record of the 5/70. We were given a verbal ok by Planning at that time, and the only change they
had me do was to make sure that the building was not located in the Highway Corridor.
The school is not complaining yet, even though the Town has not once, but twice approval plans that did not
require State Stormwater Permitting. Now the school must spend thousands of dollars to upgrade its pond or
provide impervious surface to exceed the 24%.
The school would like to move forward with the proposed gravel pathways, as smooth and quickly as possible.
At least this option will provide some benefit for the children at the school.

The only change is that we added the gravel path, thus making the site over the 24%. 1 also found the plans for
the 1st classroom building they're dated 12/06/04, and approved by the Town. That's when we were told that
the Town would approved the 5/70. We will revised the disturbed area and FRO forms.

I received revised plans dated 8-11-11. Is the only change adding the gravel path thus making the percent impervious
over24%?

Per the remarks on your letter of transmittal it appears you are now requesting the S/70 exemption for the site. One
question I would have is if a stormwater permit would still be required from the State for the project done in Oct 2007?
Mr. Mike Lawyer should be able to help us out with that question.
Also, I noticed that the disturbed area did not change with the addition of the path. The new path area will need to be
included in the disturbed area and documentation updated appropriately.

Scott,
A found a little information from our file and from an email from Mike Lawyer this morning.
It appears that the original church project was approved on 11/8/01 and that portion of the project was approved prio
to the reclassifications of Mill and McDeeds Creeks, which happened in August 2002, so it would not have even been
subject to HOW rules.
The projects done in 2007/2008 would be subject to the HOW rules if over 1 acre is disturbed. Looking back at those
files this is what I can gather.
• October 9, 2007 an erosion control plan was approved to disturb 1.12 acres. It appears these plans were done
for disturbance that was unpermitted. Apparently a building, basketball court and a gravel parking lot were
added without the Town's knowledge and then this plan was submitted to rectify. The amount of impervious
added was 75,360 sf. This project was under 24% and a stormwater permit should have been obtained and the
runoff from the BUA should be treated.
• 5-20-08 a revised plan was approved to disturb and additional 0.65 acres. This revised plan appears to have
been for a stormwater pond and does not appear to have added any impervious. I do not have any record as to
why the pond was added?
The current plan will still be under 24% impervious and a permit from the State should be obtained.
So, looks like the 2007/2008 and the current project will need to be permitted and the runoff from the BUA for those
projects should be treated.
Again we will need copies of the approve stormwater permit, plans and calculations. If the plans change due to
stormwater requirement or for anything else then the Town's erosion control approval will be invalidated and we will
need to review the changes and have to opportunity to comment. The Town will not sign off on the plans and
construction should not start until all plans and permits are approved.

Do you guys have anything from the Town stating that the site was given a 5/70 provision?
The response letter indicates that it is in a 5/70 area however the provision has to be granted from the Town and the
project must meet certain qualifications. One of those is the requirement is to have the percent impervious be above
24%. None of the projects including this one have exceeded that threshold and therefore does not qualify for the
exemption.
Speaking with the planning department today, it is my understanding that the previous projects for this site have not
been accounted for in the acreage for the 5/70 provision and was not given the exemption. Therefore a stormwater
permit will be required from NCDENR. Please contact Mr. Mike Lawyer to determine the requirement of that permit.
We will need copies of all permits, applications, plans and calculations that are submitted to NCDENR.

Southern Pines for the Sandhills Classical Christian School Classroom Building project to be located in

project is subject to a State Stormwater Management Permit for development activities within one mile of and
draining to High Quality Waters (HQW).
Please be advised that construction of any built -upon areas prior to issuance of a State Stormwater
Management Permit will be considered a violation of the NC Administrative Codes and could result in the
assessment of civil penalties of up to $25,000 per day, per violation. The State Stormwater Management
Permit is in addition to the NPDES Stormwater General Permit (NCG010000) received for construction activities.
