Robeson County is in receipt of the Notice of Violation (NOV-2012-PCO295) dated
August 28, 2012. We are aware of the fact that the Gate Valve at the Wet Detention
Pond is not properly maintaining a seal, thus allowing water to escape from the pond.
Robeson County and our Maintenance Department understand that this gate valve is only
to be used in the case of an emergency or to perform maintenance on the pond or its
structures. Currently we are working with the Engineer of Record and the contractors
responsible for the gate valves installation to correct this issue.
With regard to the areas of the pond which need to be replanted/re-vegetated, this would
be a warranty issue since the groundcover was not established in the allowed grow -in
period. We have contacted the responsible landscaping company and will ensure that this
area is brought into compliance.
We anticipate that the corrective measures required will be complete by the end of
November 2012.

On August 21, 2012, Michael Lawyer, Environmental Specialist from the Fayetteville Regional Office of the Division of
Water Quality conducted a Compliance Evaluation Inspection at the Robeson County DSS Facility located at 120 Glen
Cowan Road in Lumberton, Robeson County, North Carolina. The purpose of the inspection was to ensure compliance
with Stormwater Management Permit SW6100103 that was issued on February 15, 2010. A copy of the Compliance
Inspection Report is enclosed for your review. As a result of the inspection and subsequent file review, it has been
determined that the facility is Not Compliant. Please refer to the enclosed Compliance Inspection Report for additional
comments and observations made during the inspection.
The required actions that are necessary to bring this site into compliance are noted under the Inspection Summary and
Comments sections of the report. You are asked to provide this office a written/typed response within 30 calendar days
from receipt of this letter. Your response should specify actions that will be undertaken and the time frame that will be
required to correct the deficiencies as well as copies of any maintenance records as required by Section II, Item 4 of the
permit. Failure to properly resolve the violation(s) may constitute the assessment of a civil penalty of up to
$25,000 per day, per violation. If you have any questions or this office can be of any assistance, please contact Mr.

Inspection Summary:
Inspection conducted to ensure compliance with the conditions of Stormwater Management Permit SW6100103.
Proposed built -upon area, drainage system, and wet detention pond appeared to be installed per the approved plans.
Pond was discharging at the time of inspection through open gate valve at the bottom of the outlet structure instead of the
approved drawdown devices. This does not allow the pond to reach its designed and approved permanent pool. Certain
areas of the vegetative shelf and side slopes appeared to be in need of re-planting/re-vegetation.

Comment: At -the time of inspection, pond was discharging through open gate valve at

Please find attached the revised documentation on the DSS project as we discussed on the phone. I am sending the
revised page 3 of the permit application, the revised wet detention basin supplement form, and the revised supporting
calculations. I have changed all these documents to reflect 30 acres as the project area and total build -out of 21 acres,
which will be the maximum allowed impervious area since there can be no more than 70% of the site covered by
impervious area due to the fact that it is located in a water supply watershed (WS-IV). Please note that the plans and the
wet detention basin layout as previously submitted to you have NOT changed as a result of these revisions.

Our office has received a copy of the Financial Responsibility/Ownership Form (FR/O) from the Division
of Land Resources, Land Quality Section for the Robeson County DSS Facility project to be located in Robeson
County. Based on project location information provided on the FR/O, we have determined that the project is
subject to a State Stormwater Management Permit for development activities within one mile of and draining to
High Quality Waters (HOW).
Please be advised that construction of any built -upon areas prior to issuance of a State
Stormwater Management Permit will be considered a violation of the NC Administrative Codes and could
result in the assessment of civil penalties of up to $25,000 per day, per violation. The State Stormwater
Management Permit is in addition to the NPDES Stormwater General Permit (NCG010000) received for
