Sullins Director August 16, 2011 Subject: NOTICE OF VIOLATION (NOV-201 1 -PC-0461) State Stormwater Management Permit SW6090701 Grays Creek Middle School Cumberland County Dear Mr. Lacy: Dee Freeman Secretary On August 9, 2011, I, Michael Lawyer from the Fayetteville Regional Office of the Division of Water Quality, along with Robert Patterson and Brian Lowther with the Stormwater Permitting Unit, conducted a Compliance Evaluation Inspection at the Grays Creek Middle School facility located in Cumberland County, North Carolina. The purpose of the inspection was to ensure compliance with State Stormwater Management Permit SW6090701 that was issued on July 8, 2009. A copy of the Compliance Inspection Report is enclosed for your review. As a result of the inspection and subsequent file review, it has been determined that the facility is Not Compliant. The required actions that are necessary to bring this site into compliance are noted under the Inspection Summary and Comments sections of the report. You are asked to provide this office a written/typed response within 30 calendar days from receipt of this letter. Your response should specify actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to properly resolve the violation(s) may constitute the assessment of a civil penalty of up to $25,000 per day, per violation. Erosion observed in areas around inlets and along slopes. Re -vegetation needed. Additional inlet pipe entering main pond that was not on the approved plans and head -cutting has occurred under the pipe. Flow should be redirected to the forebay and revised plans submitted for review and approval. Outlet structure does not meet approved design and configuration. Two cut-outs were observed within the riser barrel that are lower than shown on the approved plans. This is not allowing for temporary storage and should be fixed to meet approved design specs.
