Recently you were seat a letter from the Division of Land Resources (DLR) regarding approval
of your Sedimentation and Plosion Control Plan for the subject development project Accompanying the
DLR letter was a National Pollutant Discharge Elimination System (NPDES) General Stormwater
Permit No. NCG010000. That permit authorial you to discharge stomrwater to the surface waters of
North Carolina Those point source discharges are associated with activities such as clearing, grading,
and other land disturbing and construction activities.
The purpose of this letter is to draw your attention to and to stress the importance of that NPDES
General Stormwata Permit. The requirements contained in the stormwater permit coupled with the
requirements called for by the Division of Lend Resources are vitally important to the protection of the
waters of the State. If you have not already done so, you are urged to immediately read and adhere to
the starmwater permit requirements contained there in. Of particular importance are Parts I and B of the
permit
Peru I and 11 set forth the minimum visual monitoring and reporting requirements for your
starmwarer discharge. In particular, Part 1, Section B describes the visual monitoring frequencies and

all inspections. Upon commencement of your land disturbing activity, you must initiate the visual
monitoring and record keeping requirements as called for in the permit. The visual monitoring data
results, along with all other permit required records must be maintained on -site and made available to
Division of Water Quality representatives upon request andfm during upcoming inspections. The
remaining parts of the Permit set forth definitions, general conditions, and special conditions applicable
to stonmwata dischmge(s). The conditions include special reporting requirements in the event of
noncompliance, bypasses, treatment unit/process failures, etc.

11. SCHEDULE OF COMPLIANCE
1. The stomhwater management system shall be cons trucled In Its entirety,
veeggetated and operational for tis Intended use prior to the construction of any
burn -upon surface. '
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stomhwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed In
Its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of slopes and the vegetated finer.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
ons

7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stomhwater treatment device,
and prior to occupancy of the facility.
8. Access to the stommvater facilities shall be maintained vie appropriate
easements at all times.
9. The permittee shall submit to the Director and shad have received approval for
revised plans. specifications, and calculations priot to construction, for any
modifica8on to the approved plans, Including, but not limited to, those listed
below:
a. Any revision to any them shown on the approved plans, including the
stornwaher management measures, built -upon area, details, etc.
b. Project name change.

d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project

for which 1mentation and Erosion Control Plan approval or a CAMA

10. The perntttee shall submit final site laCut and grading plans for any permitted
future areas shown on the approved plans, prior to construction.

Application for Onslow Container Service on July 2, 2008. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2006-
246. We are forwarding Permit No. SW6080502, dated July 3, 2008, for the
construction of the subject project.
This permit shall be effective from the date of issuance until July 2, 2018, and shall be

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 103,610 square feet of
impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
- ..the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months). .
b. Sediment removal.
C. Mowin.9 and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g._ Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.

6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior -to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area. .
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a completed Name/Ownership Change form, to the Division of Water
Quality, signed by both parties, and accompanied by supporting documentation
as listed on page 2 of the form. The project must be in good standing with the
Division. The approval of this request will be considered on its merits and may or
may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request.

Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit issued shall continue in force and effect until revoked or terminated. .
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law 2006-
246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
11.The permittee shall notify the Division of any name, ownership or mailing
address changes at least 30 days prior to making such changes.

easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. -The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a completed Name/Ownership Change form, to the Division of Water
Quality, signed by both parties, and accompanied by supporting documentation
as listed on page 2 of the form. The project must be in good standing with the
Division. The approval of this request will be considered on its merits and may or
may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request.

3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit issued shall continue in force and effect until revoked or terminated. .
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
. and are enforceable parts of the permit.
10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law 2006-
246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
11.The permittee shall notify the Division of any name, ownership or mailing
address changes at least 30 days prior to making such changes.

The purpose of this letter is to transmit additional information in accordance with the May 27, 2008
request from North Carolina Division of Water Quality (NCDWQ). As we discussed on the phone, we
are responding to the inquiries applicable to the work performed by our company, so that'you can
incorporate it into your comprehensive response to NCDWQ.
To respond to item number 4, a copy of the Request for Jurisdictional Determination that was
submitted to the Army Corps of Engineers (ACOE) is attached for your use. The submittal was sent to
the ACOE on June 6, 2008, but has not been signed and sent back. We will transmit a copy of the
signed map to your office once it is received.
A determination of the seasonal high water table (SI-IWT) elevation was requested at the location of
the pond in item number 5. The Clark Group advanced several borings in the vicinity of the proposed
pond and found that the SFIWT ranged, depending on location, from an elevation of approximately
118.5 ft. above mean sea level (msl) to 120.3 ft. msl within the basin.
Borings advanced along the boundary of the wetland indicate that the SHTW is approximately 1 ft.
below ground surface. The most upgradient portion of the wetland exists at an elevation of
approximately 117.0 ft msl; therefore, the SHWT exists at an elevation of approximately 116.0 ft. msl
along the upgradient wetland boundary. As impacts to the wetland hydrology are the point of concern,
this elevation is the limiting SHWT condition.

The permanent pool elevation of the proposed pond is set at 115.50 msl, and it exists upgradient to the
wetland area. Because groundwater flows toward the wetland from areas around and upgradient of the
proposed pond, where the SHWT elevation occurs several feet above the SHWT at the wetland, after
pond construction, a continuing source of groundwater will exist to flow into the wetland system, as it
does presently.

Dear Mr. Patterson:
Please find attached to this summary letter revised plans, revised calculations, and other
items which address your review comments dated 5/27/08. We have addressed each of
your comments as follows:
1). We have completed a new wet pond supplement and level spreader on the most
current forms. We have also completed the required items check list for each supplement.
2). There will not be any buildings on site, only the gravel storage area as shown.
3). We have provided for a permanent berm to be installed between the edge of gravel
and the street Right of Way at Front Street. We have also provided spot elevation at each
entrance which are higher than the street. These measures will assure that no water from
Front Street flows onto the site. There will not be any off site drainage flowing onto the
site due to the proposed finish grades of the site and the berm along the Northern portion
of the gravel. area.
4). We are providing with this submission a copy of the wetland map that was submitted
to the Corp of Engineers.
5). We are providing with this letter a revised subsurface report which designates 116.00
as the seasonal high water table elevation. Our permanent pool elevation is 115.50 which
is 6" below the SH WT.
6). We have removed the French drain from this revised plan.
7). We have calculated an average depth of 3.2' for the pond as designed.
8). We have shown a pond easement area and an access easement from the pond to the
public right of Way.
9). We are providing a corrected and revised Sheet 43 for the wet pond O & M.
10). We have revised the orifice draw down calculations within the revised storm water
calculations furnished with this submission.
11). We have revised the outer slopes of the forebay (above the permanent pool
elevation) to be a 3:1 slope.
12). We have provided a Rip Rap Swale liner for the emergency bypass swale (see detail
sheet).
13). We have provided for 0.2% slope on the outlet pipe.
14). We have used the 1 year, 10 year and 100 year intensity from the NOAA Station
close to the site (Intensity form is included with this submission).
15). We have shown the finish grade contours at the level spreader which clarifies that
the level spreader lip is elevation 115.00, while the down slope elevation of the filter trip
is 114.33 (also see level spreader detail).
16). We have revised sheet L-101 to be consistent with the revised plans. We have made
the level spreader parallel with the down slope contours.
17). We have revised the landscape planting plan for the filter strip.
18). We have revised the landscape plan to address this issue.
19). We have revised the landscape plan to move any plantings out of the flow line of the
swale. This will allow the flow line of the swale to the grass only.
20). There are no turn lanes or road widening involved in this project.
21). We have provided a revised wet pond supplement and a revised filter strip
supplement on the most current forms.
We trust that these revised plans and additional information will be sufficient for
approval of this storm water permit request.

The Division of Water Quality Central Office received a Stormwater Management Permit Application for
the subject project on May 22, 2008. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the Stormwater review:
1. Please complete the Required Items Checklist on the Wet Detention Basin Supplement Form.
2. What will this site be used for; will there not be any buildings on the site? If there will be
impervious area on the site other than gravel parking, please revise the table on page 2 of
SWU-101.
It appears on the grading plan that a portion of Front Street (offsite area) flows towards DI 91.
How will the site area draining to the north be conveyed to DI #1; and where will the street
runoff go?
4. Please provide a copy of the wetland delineation signed by the USACE. If it has not been
signed yet, provide a copy of the plan to scale that was submitted for concurrence by the
USACE.
Please provide the estimated seasonal high water table (SHWT) elevation at the basin. The
permanent pool elevation (PPE) should be set within 6" of the SHWT to prevent draining of
the adjacent wetlands. If the SHWT is below the PPE, then a liner will need to be provided in
order to maintain the permanent pool.
6. It is the policy of DWQ that french drains cannot be used to artificially drawdown the water
table, especially with the proximity of the adjacent wetlands. The drain could potentially drain
the wetland.
7. The average depth calculation used to calculate the SA/DA ratio on page 4 of the calculations
is incorrect. The average depth is equal to the permanent pool volume (PPV) divided by V f hcarolina

8. An easement must be provided for maintenance and emergency access to at least the forebay
of the basin.
9. The forebay elevations on page 3 of the basin O&M agreement do not match those provided
on the plans and calculations. Please correct the discrepancy.
10. Please revise the orifice drawdown calculation using average head equal to 1/3 (instead of %)
of the distance between the PPE and the elevation of the next available outlet above the PPE.
11. Please revise the east slope of the forebay above the vegetated shelf to have a slope no steeper
than 3:1 (H:V).
12. The emergency spillway must be a hardened structure to prevent erosion during larger storm
events.
13. The basin outlet pipe needs to be sloped to provide positive flow.
14. Rainfall depth and intensity for the 1-year, 24-hour stone can be found for all areas of NC at
this website: http://hdsc.nws.noaa.gov/hdsc/pfds/orb/nc_pfds.html
Please revise calculations as needed.
15. The level spreader lip (el. 115.5) is lower than the "down slope" elevation shown on the plans
for the filter strip (existing el. 116.5). Please correct this discrepancy. Please provide a swale
or equivalent to keep water from flowing around the sides of the lip.
16. There is an inconsistency in the location of the level spreader between sheet 1 and sheet L-101
Please correct and be sure that the level spreader and filter strip is parallel with the down slope
contours.
17. The filter strip should be planted with a full uniform cover like grass or sod. The areas
between the soft rush plants specified on the planting plan will be very susceptible.to erosion.
18. Wetland plants should only be planted on the vegetated shelf of the basin. The slopes above
the temporary pool should be stabilized with grass. Otherwise, the soil between the plants will
be susceptible to erosion.
19. Calculations for swale A are based on bermuda grass cover. However, there are trees and
shrubs shown instead of bermuda grass on the planting plan. Please clarify.
20. Please submit any information regarding turn lanes or road widening as a result of this project
that may be required on Front Street. Any new impervious area to the Moore Road will need
to be treated on this site to the maximum extent practicable.
21. Please note that many of our application forms have been updated in recent months. We
suggest always checking for updated forms online when submitting a project.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to June 30, 2008, or the application.will be
