This new boat ramp and fishing pier will be used by the public to provide safe access and provide additional recreation opportunities on Lake Emory. This Pre - Construction Notification (PCN) package is being submitted to NCDENR -DWQ requesting 401 Water Quality Certification. The required application fee of $240 is enclosed. The plans for the project have been reviewed and approved by Macon County, NC. Appropriate best management practices will be utilized to control erosion during the project. All disturbed land surfaces will be stabilized upon completion of the project. Enclosed are five (5) sets of the completed PCN form with associated attachments and the executed Agent Authorization Form that was submitted to the USACE. Project Description: 3a.: Existing conditions at the site are the Lake Emory Access Area are undeveloped. The public has been using the area to fish from the bank. There is currently no public boat ramp or onshore fishing platform located on the site. The project site area is bounded on the east by Lakeside Drive and north and west by wooded and residential properties along Clyde Downs Road. Adjacent properties to the east, west and south are lake front properties on Lake Emory. 3d.: The purpose of this project is to install a boat ramp and fishing pier along the eastern shore of Lake Emory. The project is within Duke Energy's Franklin Hydroelectric Project FERC No. 2603. As part of their FERC Approved Recreation Management Plan that was reviewed and approved by Federal, State, Local agencies, and stakeholders (issued on March 27, 2013), Duke Energy has agreed to make improvements and upgrades to access areas on Lake Emory. Using the maximum recommended grade (15 %) for the ramp will require the ramp to be about 40 feet in length into the water to achieve the desired depth. The concrete fishing platform will be constructed on land and will not impact the lake. Construction sequencing will include 1) clearing for and installation of perimeter sediment & erosion controls, 2) clearing & grubbing, 3) rough grading using motor - grader or dozer, 4) construction of boat ramp embankment using track -hoe type equipment to place and compact riprap to desired shape, 5) construct boat ramp and fishing platform Page 1 of 3 D S on land, 6) placement and compaction of graded aggregate base course surface using appropriate grading and compacting equipment, 7) final grading and landscaping stabilization, and 8) removal of sediment controls. Appropriate grading equipment will be utilized to prepare the area. Appropriate sediment and erosion protection best management practices (BMPs) will be utilized to protect the waters of Lake Emory. Approvals for land disturbance activities permits have been be obtained from Macon County as required. C. Proposes Impacts Inventory 4. Open Water Impacts 4g. The General Permit 198200030 authorizes maintenance, repair, and construction activities in Lake Emory which is regulated by Duke Energy. Certified Local Government Review 3b.: Macon County has jurisdiction for land disturbance activities. Approvals for land disturbance activities have been applied for with Macon County. They have reviewed the project plans and provisionally approved. Final approval by Macon County can only be made after the contractor has been chosen. All approvals will be obtained prior to beginning the project. Endangered Species and Designated Critical Habitat (Corps Requirement) 5d.: Mr. Mark Cantrell of the USFWS Asheville Field Office was contacted concerning improvements at the Lake Emory projects. Per a telephone conversation on August 21, 2013, he said he had reviewed plans for the improvements on Lake Emory as well as the survey for threatened & endangered species on the Franklin Dam project and concluded the Lake Emory Access Area project will have no effect on any threatened or endangered species nor will it constitute an adverse modification of critical habitat. The Virginia spirea (Spirea virginiana) plant was not found where the boat ramp or fishing pier are is to be located. His main concern was for the contractor to protect the lake waters from the concrete work for the new boat ramp and fishing pier and that strict sediment and erosion control protection measures be utilized to protect the lake waters. 7. Historic or Prehistoric Cultural Resources (Corps Requirement) 7b.: Improvements are at an existing dam project area. We do not believe there are any cultural resource issues with the property. It is Duke Energy's policy and federal law mandates that if any historic or cultural resources are discovered during construction, then all construction activities will immediately cease.
