An easement will be required, granted to NCDENR in the event maintenance is required AND a deed restriction will be
required that states a BMP is located on site, needs to be maintained, and if the property is sold then the new Owner
assumes responsibility for the BMP.

Thanks again for answering my questions yesterday on the closeout for the Owen High School Tennis Court
Project. Another question that was brought up by the Owner was the process for an easement plat for the bioretention
cell. We do a lot of these with the local municipalities in conjuction with inspection and maintenance agreements that
give Buncombe County/City of Asheville the power to maintain the BMPs should the Owner neglect to do so. Will this
be required where an easement is granted to NCDENR in the event maintenance is required, or will this simply be a deed
restriction that states a BMP is located on site, needs to be maintained, and if the property is sold then the new Owner
assumes responsibility for the BMP? Or should this be done through Buncombe County even though they did not issue
the permit? With this being a high school campus, it is highly unlikely that ownership is ever transferred, but we want to
make sure we are meeting the necessary requirements and keeping Buncombe County Schools in compliance.
