I have reviewed the above - referenced application and revised Mitigation Plan (we have a while before this one is due,
but I have a busy second half of September so I am trying to get to as much as I can now). Unless your review identifies
any concerns, you can go ahead and issue. However, I request you include the following as a condition:
Approval of the restoration plan and issuance of the 401 Water Quality Certification means that DWQ has determined
that the proposed activity will not remove or degrade significant existing uses of the surface water (15A NCAC 2H
.0506(a)). The issuance does not represent an approval of credit yield for the project.
DWR remains concerned regarding the drainage area of T2 (29 acres), and concur with USACE in their letter dated
August 12, 2013. If any of the restored streams (T1 or T2), or any portions thereof, fail to meet the 30 -day flow
requirement, or fail to demonstrate other jurisdictional indicators as determined by USACE, these areas may be
removed from stream credit generation.
