Dear Mr. Keeny:
The Central DEQ Office received and accepted a State Stormwater Fast Track Authorization to Construct
Permit Application for the subject project on September 27, 2021. A preliminary in-depth review of that
information has determined that the application is not complete and additional information is needed to
determine whether the project complies with 15A NCAC 02H.1043. To continue the review, please
provide the following additional information:
1. Please submit a copy of lease agreements, affidavits, or other documents showing that the
applicant has obtained legal rights to submit a stormwater permit application within the proposed
project area. [15A NCAC 02H .1043(3)(c)]
2. Please submit an application form with a signed and notarized Property Owner's Authorization.
3. The site plan sheet shows the typical road cross section with roadside ditches. In some spots, the
ditch slopes are 2: 1. The low density rules require a maximum slope of 3:1. [15A NCAC
02H . 1003 (2)(c)(i)]. Please note that during the ATC review process, the plans are not reviewed
for technical compliance with the rules. The complete review will be done after construction
when the final permit application is received.
4. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:
https:Hedocs.deq.nc.gov/Forms/SW-Supplemental-Upload
Please remember to confirm that any revised information is presented consistently throughout the
application documents. Please also remember to provide two hard copies and one electronic copy of any
updated or requested documents per 15A NCAC 02H.1043(3).
The requested information should be received in this Office by November 4, 2021, or the application will
be returned as incomplete. The return of a project will necessitate resubmission of all required items,
including the application fee. Please note that the Division is allowed 30 days ftom the receipt of a
complete application to issue the authorization to construct permit.

The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.
