I'm doing this from memory, and you know how that is sometimes.....but I believe that the final credit release was similar to the amount linear footage contained within the repair area. Since the final release of credits is tied to closeout (something we can't do for three more years), we were going to hold the final release in abeyance until the repair was closed out (with no prorated release). The only other option we had was to not release the credits for year three. With the amount of repair needed (and the costs associated with the repair), we released the 3rd year's credits and deferred to final closeout - so that some of the repair costs could be recovered quickly. Does this make sense? With the erosive soils around Forrest Creek, I would be hesitant to work thru a prorated release because it seems like an unexpected problem can occur quickly. I think that James is taking over Forrest Creek and he has the file. You may want to check with him for a final determination. Talk to you soon, Monte -----Original Message----- From: Tommy Cousins \[mailto:tommy@ebxusa.com\] Sent: Monday, September 09, 2013 6:26 PM To: Matthews, Monte K SAW Subject: \[EXTERNAL\] RE: forrest creek (UNCLASSIFIED) Monte, first of all congrats on the new position. We are sorry you won't be working with us anymore! I know I have asked you this before so I apologize, but can you remind what the agreement was with EarthMark on the Forrest Creek monitoring? I know we are doing an additional three years but I couldn't remember if we are prorating the credit releases at all 1 based on the percentage of the project that is failing? I was thinking Rich had negotiated a partial release of the final credit release. Thanks! Tommy Classification: UNCLASSIFIED Caveats: NONE 2
