DWR is not granting prorated credit releases for the last credit release for any buffer mitigation bank site regardless of
overall site conditions.

Katie, we have been discussing the buffer bank quite a bit and how to move forward. We would like to propose a
solution similar to what we did with the stream bank when EarthMark did those repairs a few years ago. We have no
intention of leaving a project before it is successful, but we think there is a good portion that is doing very well and to
help ease the burden of going three more years we wanted to see if you would be willing to release a percentage of
credits as outlined in the attached letter. Please see the attached letter and let me know what you think. Thanks for your
