Can you let me know when we can expect the DWQ letter? Any chance you could email me a
copy? They are champing at the bit and need to get it over to the Town this week if at all possible
know that's short order, but it's a really important project for the Town (over 2,000 new jobs as I
understand it). I have an idea about which company is moving in, but it's very hush -hush.

Attached is the revised application and plans, reflecting the Corps verification that the 121 feet of
stream impact requested is non-jurisdictional/non-404, and requesting approval under the State
Isolated /Non -404 General Permit, Neuse Buffer Rule and requesting a "no permit required" letter from
the Corps. I included a revised cover letter as well. The remainder of the information provided in the
original application remains valid. (Cherri - I also filled in the correct buffer section, thanks for the
catch and understanding.)
Please let me know if this digital copy is sufficient or if you need paper copies.
I appreciate your help as always, and don't hesitate to contact me if you have any questions

Evaluated were two adjacent properties of approximately 40 acres located at Weston Lakefront, between
Weston Parkway and Weston Lake, in Cary, Wake County, North Carolina. The approximate center point
of the properties: Latitude 35.8299, Longitude - 78.7991. PINs: 0755978384 & 0755972015.
Description of Activitv:
Proposed is the development of a commercial office complex on the properties.
Based on PCN and other documents submitted to our office on August 12, 2013 and updated on August
22, 2013, along with an August 13, 2013 site visit to confirm accuracy of a 2002 jurisdictional
determination (SAW- 2002 - 21494), planned development will avoid impacts to waters of the U.S.
This determination applies only to the proposed development as described in the documents described
above and as shown on the attached "Overall Site Plan". Areas on the property outside of the proposed
development were not evaluated. Jurisdictional features may exist outside the evaluated area, but still
within the property boundaries. All future work within jurisdictional waters must have prior approval of
the USAGE.
Your work as proposed does not require Department of the Army authorization for the following reason(s):
There are no jurisdictional waters or wetlands within the boundaries of the property.
X The proposed project does not impact jurisdictional waters or wetlands.
The proposed project is exempt from Department of the Army regulation.
