ASSESSMENT FACTORS
1) The degree and extent of harm to the natural resources of the State, to the public health, or to private
property resulting from the violation:
In reference to the cited violations, no harm to the natural resources of the State was observed, to the public
health, or to private property was documented. No discharge of waste from the waste collection and
treatment system could be documented.
2) The duration and gravity of the violation:
One application event occurred on June 11, 2020 in two spray fields not accounted for in the facility's
CAWMP. Not accounting for proper agronomic rates when land applying waste has potential to damage
the quality of the soil by causing nutrient imbalances.
3) The effect on ground or surface water quantity or quality or on air quality:
No evidence of a significant effect on ground water, surface water, or air quality was documented.
4) The cost of rectifying the damage:
No cost to rectify the damage was documented.
5) The amount of money saved by noncompliance:
No explicit amount of money was saved by this noncompliance. A new waste plan accounting for the areas
in which waste had been applied could have been drawn up for no cost.
6) Whether the violation was committed willfully or intentionally;
Mr. Michael Corn admitted to knowingly land applying the waste against the specifications of his CAWMP.
7) The prior record of the violator in complying or failing to comply with programs over which the
Environmental Management Commission has regulatory authority; and
A database and file review indicates that the facility does have a violation history. One such previous
violation included a discharge of waste into surface waters of the state. The violations on record for the
past 5 years for this facility include: NOV-2016-DV-0296, NOV-2017-PC-0300, and NOV-2018-PC-0307.
