Dear Mr. Conard,
This is with reference to the request received by Bryan Hall, Field Representative, to refine State Permit
No. 71-17, which was issued to James L. Bullard on June 7, 2017 for the replacement of a bulkhead,
installation of rip rap revetment and reconfiguration and replacement of floating docks at 113 Windlass
Drive, located adjacent to the Atlantic Intracoastal Water Way, in Wilmington, New Hanover County.
State Permit No. 71-17 is due to expire on December 31, 2022.
The action proposed in your submittal is to reduce the permitted square footage and shift the structures
closer to the bulkhead within the permitted 6 slip docking facility. The request includes the removal of the
authorized 22' x 6' fixed platform and 22' x 8' floating dock (see drawing 8/25/21 in pink color). The
request asks to rotate the previously approved 16' x 6' floating dock to run parallel to the bulkhead (see
drawing 8/25/21 in yellow color) and connect to a new 5' x 32' floating dock that would run parallel with
the northern portion of the bulkhead (see drawing 8/09/21). A proposed 5' x 10' floating dock extension,
on the western end of the proposed 5' x 32' floating dock, would connect to a previously authorized
floating dock that extends perpendicular from the bulkhead (see drawing 8/09/21). This will result in a
"U" configuration that hugs the bulkhead (see drawing 8/09/21). This will result in a reduction of 42 sq.
ft. of platform space, no change in slip count within the previously authorized footprint and usurp less
public trust area.
Upon reviewing the information provided, the Division of Coastal Management has determined that the
proposed action is consistent with existing State rules and regulations and is in keeping with the original
purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit
No. 71-17 as described in your email and attachments dated received August 4'h, 2021. Please note this
refinement does not alleviate the need to obtain any other local, state or federal permits

As per our conversation a couple weeks ago, attached is the drawing for the Bullard modification along with the
adjacent property owner notification / waiver. The first page is what is currently existing and permitted. The second
page shows the stationary pier and section of floating dock (in pink) that are to be removed. The yellow floating dock
section will be relocated straight. The orange section will be a new section of 6' floating dock and a new 5' x 10'
stationary access pier. All of the green dock is existing and will remain. The last page shows the final proposed dock
