I have reviewed the above reference project and need the following comments/questions addressed in order to proceed
with the evaluation of the project.
1) The PCN states "the project will serve as a road connection to the existing Horton Ridge Blvd in accordance with
the Town of Apex transportation plans." Please provide some documentation to support the stated purpose
such as providing the referenced transportation plan or a traffic study to support the need for the road;
2) The PCN states "the road connection was designed to avoid impacts to WOTUS to the maximum extent
practicable, while still containing the required grade and curvatures for safety and connectivity." Please provide
additional details to support the proposed project compliance with general conditions 23 a and b. For example,
please provide justification to support the proposed location and alignment of the proposed project. Without
additional clarification it appears there are uplands north of impact area B and uplands west of impact area C
that could be utilized while still achieving the project purpose;
3) Cumulative permanent stream impacts for this project exceed the 150 linear foot threshold per NWP 14
Regional Condition 3.2, and therefore compensatory mitigation is required. Please submit a compensatory
mitigation plan.The mitigation rule generally prescribes purchasing stream credits first through a mitigation
bank with stream credits available in this HUC, or second through the NC Division of Mitigation Services; please
provide a mitigation acceptance letter from your proposed compensatory mitigation provider.Typically,
compensatory mitigation is required at a 2:1 credit to impact ratio unless otherwise justified based on
evaluation of aquatic function;
4) Cumulative permanent wetland impacts for this project exceed the 0.1acre threshold per Nationwide Permit
General Condition 23c, and therefore compensatory mitigation is required. Please submit a compensatory
mitigation plan.The mitigation rule generally prescribes purchasing wetland credits first through a mitigation
bank with wetland credits available in this HUC, or second through the NC Division of Mitigation Services; please
provide a mitigation acceptance letter from your proposed compensatory mitigation provider.Typically,
compensatory mitigation is required at a 2:1 credit to impact ratio unless otherwise justified based on
evaluation of aquatic function;
5) Based on the cross sections for Area A and Area B rip rap dissipator pads are proposed. Please update the
impact table and impact maps to include the proposed riprap dissipator pads. Additionally, the proposed rip rap
should be in compliance with regional condition 3.5.2 (see attached);

6) What is the design speed of the proposed road?Would a shift of the road at Impact Area A also shift the road at
Impact Area B?Would a shift of the road at Impact Area B also shift the Road at Impact Area A?Would a shift of
the Road at Impact Area B also shift the Road at Impact Area C?
Please submit the above information within 30 days of receipt of this Notification or we may consider your application
