There were no Schweinitz's sunflowers found within the permitted area. The teams also reviewed the area for small whorled pogonia habitat and it wasn't found. However, I have a list from the Service that states surveys are only valid for a certain period of time. The surveys are valid for small whorled pogonia for 1 year and for Schweinitz's sunflower for 2 years. Please advise on how you plan to address since the field visits were conducted in 2015 for small whorled pogonia and the survey will expire in the next couple of weeks for Schweinitz's sunflower. My apologies for not having acknowledged, but this email was in response to the information provided in your 30 Aug 21 email. However, in getting back up to speed with all things ESA, I was asking the PMs in the shop about addressing the plant species. They mentioned that they have begun to ask for consultants to further address suitable habitat, which is entirely different than critical habitat that has been identified and put on notice by the USFWS to aid us in making our determination. Based upon my discussions, small whorled pogonia likes wooded areas and Schweinitz's sunflower likes disturbed areas, like road shoulders. So, in order for me to concur that the project can proceed without a PCN, I would need information that either states that suitable habitat is not present and/or a survey that supports that they are not present. Vickie, Thanks for the information on the aquatic species that would need to be addressed, but didn't see anything pertaining to the endangered flora. If you wished to proceed, we would need something that confirms that neither suitable habitat or the species are present at the crossing locations and the uplands immediately adjacent to those crossings. The Atlantic pigtoe is listed as proposed threatened for Guilford and Randolph Counties but the waterline project area only intersects the range for the 4 species near Ledbetter and Hemphill Roads. There is one small intermittent stream that crosses the study area in that location SA-181-7 (maps attached). This stream does not maintain adequate flow or the habitat that the Atlantic pigtoe requires. I took a clip of the USFWS page this morning just to reverify that there we not changes in the range since the last time we checked. Big Alamance and Climax Creeks are not within the range of the species. The project should not have any impacts to the Atlantic pigtoe. Jackson pulled the USFWS and NHP information (both attached) today so you would have it available as well. Let us know if you need anything else. Vicki, It appears that the Atlantic Pigtoe has been listed since your initial request and I know that this portion of the project will impact Big Alamance Creek and Climax Creek based upon the provided drawings. I know you mentioned you keep these surveys up-to-date, so perhaps you have additional documentation that would support that the project would not impact the recently listed species since the contractor is now proposing open cutting. I finally received the information and have attached the files to this email for your review. In general, there are five sites where we were previously planning to avoid by jack and boring pipes under the streams but in the first location the contractor has encountered rock that is extremely hard and they have not been able to complete a jack and bore. As they move along they are still intending to use jack and bore where it is possible but they wanted to request the modification in case they encounter rock at the other crossings. Please let me know if you need additional information beyond the attached cover letter and the updated exhibits.
