Subject: Major Variance from the
Neuse River Riparian Area Protection Rules
8103 Dreamy Way, Raleigh

Dear Mr. Morris:
On January 16, 2013 a Notice of Violation was issued to you for impacts to Neuse Riparian
Buffer Rules for the subject lot at 8103 Dreamy Way in Raleigh, Wake County. On July 12,
2013 the Environmental Management Commission (EMC) issued you an Approval with
Conditions of Neuse River Riparian Area Protection Rules Major Variance. This Major
Variance contained a number of conditions.
On August 8, 2013, Patrick Smith with Soil and Environmental Consultants, PA provided an
Engineer's Certification that detailed the following:
1) The construction of a small retrofit bioretention area;
2) The rerouting of roof gutters and associated down spouts (with splash -pads to discharge
the majority of the rooftop runoff outside of the buffer;
3) The planting of select portions of the Zone 1 and Zone 2 of the riparian buffer with native
shrub species;
4) Payment of Nutrient Offset Mitigation for a total of 4.63 lbs /ac/ yr or 34.725 Nutrient
Reduction Credits (pound of nitrogen); and
5) Payment of Buffer Mitigation in the amount of 2, 938.50 Buffer Credits (square feet).
The information provided in this Engineer's Certification communicated compliance with the an
additional condition set forth in the Major Variance from the Neuse River Riparian Area
Protection Rules. The remaining condition is the recording of the Declaration of Compliance of
Stream and Buffer Regulations for Lot 9, Stonehaven Subdivision, as approved by EMC. Once

Variance July 12, 2013, the violations cited in January 16, 2013 Notice of Violation by copy of
this letter are resolved.
