Based on observations during a site evaluation conducted on 1/12/2021, it was determined that the most likely cause for this breach was waste flow through cracks in an underlying limestone layer (see Soil Evaluation Report). There were no indications that the lagoon's structural integrity was compromised in any other areas besides the single breach through the southern dike. Therefore, it is recommended that: (1) The hole of the breach will be filled in as best as possible with clay and compacted. The surrounding dike appears to be structurally sound and well compacted clay, so disturbing the remainder of the dike is not necessary. A budget proposal from a local liner installation company, Chesapeake Containment Systems, has been included with this Repair Plan. Standard details from the installer have also been included. Chesapeake Containment will install the liner according to manufacturer specifications, as well as NRCS Standards 359 (Waste Treatment Lagoon) and 521 (Pond Sealing or Lining—Geomembrane or Geosynthetic Clay Liner). To prevent gas build-up under the liner, a ventilation system will need to be included in the installation. There are two options for this listed in the budget proposal, with the strip ventilation layer recommended. This plan will repair the existing breach in the lagoon and prevent any additional existing cracks in the limestone layer from resulting in breaches in the future. Every day without all subgrade available at 8am will be charged a premium of $4,500 in addition to established rates. 1.2.3 CCS to provide equipment and operator(s) for duration of liner installation to assist with liner installation. _ CH ESAPEAKE 1.2.4 Wage Scale and Union Requirements are EXCLUDED 1.2.5 Measurement and Payment is to be all installed materials measured in 3D including Anchor Trench but excluding waste, scrap and overlap. 1.2.6 Installation and Material specifications for geomembrane not included. CCS includes industry standards for both the supply/production of materials as well as the installation of these materials. Introduction of any additional information can result in revised pricing. 1.2.7 Anchor Trench, Boots, Concrete Attachment and other geosynthetic details were not included. CCS assumes a standard 2ft x 2ft anchor trench at full perimeter of pond and standard details for all other items/details required for installation. Introduction of any additional information can result in revised pricing. 1.2.8 All third -party material conformance testing is excluded. However, third -party conformance testing can be provided at an additional fee. 1.2.9 Onsite destructive and nondestructive testing of geomembrane is included by CCS. Third -Party Destructive Testing is not included. 1.2.10 Pricing reflected above is valid for both the supply and installation of materials listed. Any changes in scope can result in revised pricing. 1.2.11 Pricing attached is budgetary and shall be used for budgetary purposes only. **Due to the unstable market for petroleum -based products this Budget Proposal is only good for fourteen days. This Budget Proposal is subject to change at anytime during the validity period AND up to time of shipment due to claims of force majeure by raw material suppliers and/or geosynthetic manufacturers.** 2.0 Material Specifications: The materials supplied for this project will be supplied and subject to the manufacturer's standard material specifications. 3.0 Services Furnished By Others (at no cost to CCS): 3.1 Preparation of all surfaces to be covered per the specifications. All site work, earthwork, leveling, trenching, backfilling, concrete preparation. 3.2 Digging and backfilling of anchor trench is performed and paid for by others. 3.3 Contractor is responsible for cleaning of all existing liner at tie-in areas and maintenance of those tie-in areas. Tie-in to be broom swept with a MINIMUM of 48" exposed and cleaned PRIOR to mobilization. Any cleaning of tie-in by CCS will be charged on a Time and Material basis. Installation of tie-in with less than 48" exposed to be charged on a Time and Material basis. 3.4 Click on the Pre -mobilization Checklist link to view site condition requirements that should be achieved, prior to CCS mobilization. 3.5 Provide a subgrade surface that is stable enough to drive a front-end loader or forklift on without the machine causing tire ruts. 3.6 Continuous removal of rainwater, any other source of water, and snow at lining site. 3.7 Access to and from work site for CCS employees including maintenance of roads and equipment access. 3.8 Access to and use of sanitary facilities for CCS employees. 3.9 Sand or chip stone for filling sandbags provided at lining site. CHESAPEAKE CONTAINMENT SYSTEMS, INC. 3.10 Supply equipment and personnel to manage deliveries and unload materials prior to CCS mobilization. 3.11 Contractor is responsible for safe storage of materials including storing materials on dry positively graded stone pad and on dunnage and covering of all geosynthetics with plastic and ballast. Maintenance of the cover when CCS is off site is the responsibility of the contractor. 3.12 All third -party QC/QA testing, unless specifically mentioned in Item1. This includes but is not limited to, laboratory testing of the field samples and all third -party testing. 3.13 Provide dedicated prepared storage and parking area within 500 feet of the area to be lined. This is in addition to material storage area. Materials further than 500' away will be moved on a Time and Material basis. 3.14 Disposal of waste off site if necessary. Maintain dumpsters in close proximity to the work area, empty and replace when full. 3.15 Surveyed as -built drawings if necessary. We have included measured as -built drawing. 3.16 Site specific training, health exams or monitoring unless specifically mentioned in Item 1. 4.0 Schedule, Delays and Scope Modification: 4.1 Phased installation will incur a charge of $10/LF (higher on Wage Scale projects) of New to New Tie in between phases and is to be prepared BY OTHERS. 4.2 All pricing is based on a minimum site access availability of (10) hours per day (6) days per week. A standing time charge of $4,500/Day to be charged for any day we cannot work due to others excluding Sundays and the five major holidays (ie: ADD $4,500/day for any site shutdowns or extended weekends). 4.3 Work is priced for continuous and logical installation sequence with Contractor having prepared subgrade available for installation. 4.4 Removal of all rainwater, subgrade re -work, weather recovery of damage to be by others. After a weather event (precipitation above .10") subgrade to be available for deployment within 24 hours after the end of the event. Standing time to be charged if subgrade is not ready after 24 hours. 4.5 Contractor to provide a written schedule with signed Budget Proposal, contract or Purchase Order. Re -Scheduling fees will be as follows. 4.5.1 Mobilization Rescheduling 8+ days before mobilization date 0% of Mobilization Cost 4.5.2 Mobilization Rescheduling 5-7 days before mobilization date 25% of Mobilization Cost 4.5.3 Mobilization Rescheduling 3-5 days before mobilization date 50% of Mobilization Cost 4.5.4 Mobilization Rescheduling 1-2 days before mobilization date 75% of Mobilization Cost 4.6 Work delays or interruptions caused by incomplete subgrade preparation, incomplete structures or for any other reason beyond the control of CCS, shall be charged to the contractor or owner at a rate of $95.00 per manhour for a maximum of 8 hours per day. Union or prevailing wage projects will have an additional charge of $40 per hour ($135/hr total). CHESAPEAKE CONTAINMENT SYSTEMS, INC. 4.7 CCS pricing includes installation between the dates of March 15th and October 31 St Work beyond these dates will be considered Winter Work. 4.8 Work during Winter Months: $0.10 per SF of each layer and $4,500.00 for standby days (includes weather). Union Jobs are higher and dependent on the wage scale requirements. 4.9 CCS does not have crews available from December 15th thru January 7th 4.10 Crew availability from December 8th thru February 28th is very limited. 4.11 All pricing is based on performance of installation within (365) days of the date of this Budget Proposal. 4.12 All pricing is based on materials shipping within (90) days from the notice to proceed. Additional costs may be incurred if materials have not shipped within that timeframe. 4.13 Liquidated Damages, if applicable, will never exceed $500 per day or those assessed by the owner, whichever is less and must be directly and completely attributed to CCS scope of work. 4.14 CCS will not be charged or back charged for any costs, liquidated damages, delays or damages unless specifically notified in writing within 3 days of occurrence of Contractor claimed loss or delay. Failure to provide such written notice shall forfeit all rights of Contractor for claim of damage. 5.0 Exceptions: 5.1 Cost of performance and payment bonds are not included unless specifically included in item 1. Performance and Payment Bonds can be provided for 2% of contract value with all work and warranty complete within (2) years. Additional duration is an additional cost. 5.2 Permit fees are not included. 5.3 Union or prevailing wages do not apply to this Budget Proposal unless specifically included in Item 1. 5.4 All costs related to damage caused by other parties to the liner system. 6.0 Safety: 6.1 Work environment level to be level "D" only. Pricing includes work in standard PPE including Gloves, eye protection, High Visibility Vest, Hard Hat, Boots. 6.2 It is the contractor or owners' responsibility to provide MSDS sheets and any other information on hazardous materials used or stored on site. 6.3 CCS has included up to (1) hour of site -specific training. Additional site -specific training will be charged at the standby rate. 6.4 CCS will provide a minimum of (1) bi-lingual person on the crew. We exclude working on sites which exclude Spanish speaking workers. 6.5 Contractor or Owner to provide eye wash station for CCS use within a reasonable distance from CCS work area. 6.6 CCS will provide personnel with a minimum of 10HR OSHA training. Supervisors will have 30HR OSHA training. 6.7 CCS excludes providing a full-time on -site Health and Safety officer. One can be provided for additional cost. CHESAPEAKE CONTAINMENT SYSTEMS, INC. 6.8 CCS assumes all soil types (with the exclusion of anchor trenches) as Class C soil, requiring a slope of 1.5:1 as indicated in CRF 1926 Subpart P Appendix B Figure B-1, unless the soil is reclassified and the requirements for the protective systems are changed by a professional engineer in accordance with 1926.652(b)(4)(i) and 1926 Subpart P Appendix A (c)(4). 7.0 Warranty: 7.1 The installation warranty will be provided by and subject to CCS's standard warranty. 7.2 The warranty for the material will be provided by and subject to the material manufacturer's warranty. 8.0 Terms of Payment: 8.1 CCS reserves the right to extend credit in our sole discretion. Any Contractor requesting credit with CCS will be required to fill out both a Credit Application and a project information sheet. Prepayment for materials and services will be required without established credit. 8.2 CCS will invoice for stored materials. Payment will be made to CCS within 45 calendar days after receipt of invoice. Retainage will not be held on stored materials. 8.3 Installation will be billed as job progresses; payment is due within 45 calendar days after receipt of invoice. Upon completion of the scope of work in Paragraph 1.1, payment will be received by CCS within 45 calendar days following receipt of final invoice, retainage on installation will be released as soon as all close out documentation is submitted to contractor. 8.4 Interest of 2% per month will be charged on overdue invoices. 8.5 Contractor hereby acknowledges that CCS relies solely and exclusively on the credit of the Contractor for payment for its work. All payments, including progress payments, payments for change orders and extra work, retainage and final payment are the sole responsibility of the Contractor and shall be paid according to the terms of payment stipulated herein and on invoice documents. Receipt of payment from the Owner by the Contractor is specifically not a condition precedent to payment for payments due to CCS by the Contractor. Soil Scientists: Edward Stephens, Soil Scientist, NCDA&CS DSWC Other Participants: Martin McLawhorn, Environmental Specialist, NCDA&CS DSWC Marlene Salyer, NCDENR DWR Chris Love, Engineer, NCDA&CS DSWC Kevin Weston, Smithfield Foods Donnie Mills, Farm Owner Location: The farm is near Hargett's Crossroads on Lee Mills Road in Jones County. Coordinates recorded in decimal degrees are: 35.012769, -77.614509. Geology/Topography: The lagoon is built on an upland landscape position on soil mapped as Goldsboro loamy sand, 0-2% slope. Tuckahoe Creek flows near the lagoon. A soil map is attached to this report. Field Work: A large tracked excavator with an operator was on site to assist with the soil evaluation. Two pits were excavated and then filled in after evaluation. Elevation and depth measurement data was collected with a Topcon laser construction level and should be considered preliminary. A site map showing the lagoon and approximate locations of the conveyance is attached. General Observations: 1. The lagoon was completed in 1994. The construction checklist has a hand-written note that mentions a geotextile liner that was covered by 1' of "good plastic material". This note does not specify the type of geotextile or the USCS classification of the soil installed as a liner. Mr. Mills stated that clay for the lagoon liner and dike wall core was trucked in form Pink Hill, NC. 2. The lagoon structure appeared to be well maintained. The structure was free of trees and was covered in grass. 3. A hole over 8' deep and 3-4' in diameter was observed on the toe slope of the lagoon on the outside bordered by Tuckahoe Creek. A photograph of the hole is included as Figure 1. The hole had been created by the flow of effluent under pressure from the lagoon. A hole approximately 3' in diameter 1 was observed on the inside of the lagoon on the inner slope. The hole was the inlet to the conveyance and had been temporarily diked with soil from the top of the structure. 4. The hole on the inside of the lagoon was enlarged with the excavator to provide access to the clay core. The core appeared to be constructed of cohesive soil that was compacted. The inlet hole was nearly vertical and is not thought to penetrate through the core. The hole was filled in and tamped with the excavator bucket to serve as a temporary repair to prevent effluent discharge. 5. The hole on the outside of the lagoon was enlarged to determine how effluent was leaving the lagoon. At a depth of approximately 8.5' a layer of hard sedimentary rock or marl was observed. The excavator could not continue digging past the top of that layer. The soil that was excavated around the outlet hole was native, coarse textured soil with some silt and clay content. The excavated soil was returned to the pit and was compacted with the excavator bucket. 6. Effluent was observed entering the outlet hole/excavated pit from the Tuckahoe Creek side instead of the lagoon side. The volume of the flow was similar to a 6" irrigation pipe with very low pressure, the effluent bubbled into the pit from an unseen opening in the sedimentary rock. 6. According to Mr. Mills, Tuckahoe Creek has exceeded its banks several times recently due to heavy rains associated with hurricanes. Flood waters from Tuckahoe Creek have encroached on the toe slope of the lagoon structure before receding. Results: Based on observations of the effluent conveyance it seems likely that the clay liner has failed and allowed effluent to discharge from the lagoon structure. A localized repair of the liner in the conveyance and adjacent area should be sufficient to repair the structure. Clay from a local clay mine or bentonite should be considered. The core of the lagoon structure is thought to be in good repair since the discharge was not attributed to an overtop event or high levels of effluent and the dike wall remains in place. A possible cause of the liner failure is the amount of water that has been absorbed, discharged or transmitted through the soil and fractured sedimentary rock adjacent to and under the lagoon structure. Due to the recent hurricanes and tropical weather systems that have passed through southeastern North Carolina the water table has been at or above the surface for extended periods. Recent temporary changes to the hydrology could have allowed soil and rock to shift. A weak spot in the lagoon liner may have allowed the flow of effluent down through the sedimentary rock and back to the surface on the outside toe slope of the lagoon structure. 2 For questions or comments, contact Edward Stephens at 910-585-3792 (email: edward.stephens@ncagr.gov).
