The Division of Water Resources (Division) has reviewed the repair summary submitted along
with the response to the items of concern that the Division provided. The Division still finds that
the proposal would not provide adequate protection of surface and ground waters. The earthen
liner for this structure has failed twice now — once during initial construction and the current failure.
There remain questions as to the integrity of the embankment due to the unknown flow path of the
failure under the embankment. A repair plan that only includes repairing/replacing the liner along
the embankment wall and twenty feet out into the lagoon bottom does not provide adequate
protection for this structure in this location. At a minimum, the breach inlet and outlets must be
properly repaired along with the installation of a synthetic liner to protect surface and ground
waters. Lagoon replacement also remains an option for this facility. The new lagoon would also
need a synthetic liner.
