Location description: The project site is located on a tract of land (PINs 8593-64-2665-000 and 8593-74-0366-000) on
Black Beaver Road, south of the intersection of Black Beaver Road and Spring Brook Lane in Brevard, Transylvania
County, North Carolina.
Description of projects area and activity: This after -the -fact permit verification authorizes 0.06 acres of permanent
impacts to wetlands associated with mechanized land clearing of forested acreage and land grading/leveling activities
for establishment of pastures. The permit verification request was submitted by the Permittee in response to the
requested remedial actions of the issued Notification of Unauthorized Activity dated March 6, 2017.
Special Condition(s): 1) Completion of the approved Corrective Action Plan and additional requirements per the
Corps' letter dated April 21, 2017 (attached).
2) Conductance of the additional remedial measures of the Corps' issued Notification of Unauthorized Activity
outlined in the above noted letter of April 21, 2017.
3) Removal of the culverts from UT-1 and Steel Creek with restoration of the stream reaches and stream buffers per
the attached McGill Associates plans/drawings (Figures 1-4, dated May 26, 2017) by December 1, 2017.
4) Visual monitoring of the above noted restored stream reaches and stream buffers at a minimum of quarterly for 12
months after completion of the restoration activities to ensure the reaches are stable and revegetation of the buffers is
successful. During the monitoring period any failures of stream restoration structures and/or stream buffer vegetation
will be replaced/repaired by the Permittee upon identification by the Permittee, his authorized agent, or the Corps.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
attached conditions, above noted special conditions, and your submitted application and attached information dated
May 19, 2017. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is
modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide/regional permit authorization
is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies
with all requirements of the modified nationwide/regional permit. If the nationwide/regional permit authorization expires or is
suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide/regional permit, activities which have commenced (i.e., are under construction) or are under contract to commence
in reliance upon the nationwide/regional permit, will remain authorized provided the activity is completed within twelve months
of the date of the nationwide/regional permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.

11. CONTAINER GROWN PLANTS SHALL BE HEALTHY, VIGOROUS, WELL —ROOTED,
AND SHALL HAVE BECOME ESTABLISHED IN THE CONTAINER IN WHICH THEY
ARE DELIVERED. THESE PLANTS SHALL HAVE BEEN IN THE ESTABLISHED
CONTAINER LONG ENOUGH FOR THE FIBROUS ROOTS TO HAVE DEVELOPED SO
THAT THE ROOT MASS WILL RETAIN ITS SHAPE AND HOLD TOGETHER WHEN
REMOVED FROM THE CONTAINER. THE CONTAINER SHALL BE A 1 GALLON
CONTAINER OR LARGER, SUFFICIENTLY RIGID TO FIRMLY HOLD THE SOIL
PROTECTING THE ROOT DURING TRANSPORTING, HANDLING, AND PLANTING,
AND THE SOIL SHALL NOT BE ALLOWED TO BECOME FROZEN.
12. BARE ROOT PLANTS, IF USED, SHALL HAVE A HEAVY FIBROUS ROOT SYSTEM
WHICH HAS BEEN DEVELOPED BY PROPER CULTURAL TREATMENT. THEY
SHALL BE DUG, PACKAGED, TRANSPORTED, AND HANDLED IN A MANNER THAT
WILL PREVENT INJURY TO OR DRYING OUT OF THE TRUNKS, BRANCHES, OR
ROOTS, OR FREEZING OF THE ROOTS.
13. NDl CHANGE IN SPECIFIED PLANTS (SPECIES, VARIETY, SIZE, CAUPER,
ETC.)WILL BE MADE WITHOUT APPROVAL FROM THE REPRESENTATIVE
ENGINEER. ALL REQUEST BY THE CONTRACTOR FOR SUBSTITUTIONS SHALL
BE PRESENTED IN WRITING AND SHALL INCLUDE A LISTING OF SOURCES WHICH
HAVE BEEN CONTACTED IN AN ATTEMPT TO SECURE THE SPECIFIED PLANT
MATERIAL. REQUESTS FOR SUBSTITUTIONS SHALL INCLUDE BOTANICAL NAME,
COMMON NAME, SIZE, CALIPER, AND FURNISH DESCRIPTION AND PROPOSED
sus-1-rum.
14. REMOVAL OR CONTROL OF SOD FORMING GRASSES SUCH AS FESCUE AND
KENTUCKY BLUEGRASS, INVASIVE, EXOTIC PLANTS THAT WILL HINDER AND
COMPETE WITH PLANTINGS FOR ESTABLISHMENT AND NUTRIENTS NUISANCE BE
PERFORMED FOR A PERIOD OF 90 DAYS AS NECESSARY TO ENSURE
ADEQUATE SURVIVAL OF SPECIFIED PLANT SPECIES.
15. CONTRACTOR SHALL PROVIDE INITIAL WATERING ON THE DAY OF PLANTING.
CONTRACTOR IS SOLELY RESPONSIBLE FOR SURVIVABILITY OF PLANTS FOR 1
YEAR FROM DATE OF PLANTING. ENGINEER RECOMMENDS PLANTS BE
WATERED AT THE MINIMUM RATE OF 1" PER 7 CALENDAR DAYS (INCLUDING
RAINFALL)FOR A PERIOD OF 90 DAYS.
