This WARRANTY DEED is made the f day of June, 2000,
by and between BRANCH BANKING AND TRUST COMPANY and ELIZABETH
WOLTZ SHOOK, Co -Trustees under the Will of W. G. Woltz
probated the 14th day of October, 1992, in Granville County
(formerly Southern National Bank of North Carolina and
Elizabeth M. Woltz, Co -Trustees under the same Will) with its
principal place of business in Wilson, North Carolina
(hereinafter referred to in the neuter singular as "the
Grantors) and CLYDE L. PATTERSON of 4271 Leaflet Church Road,
Broadway, North Carolina 27505 (hereinafter referred to in
the neuter singular as "the Grantee"):
W I T N E S S E T H:
THAT said Grantor, for and in consideration of good and
valuable considerations, receipt of which is hereby acknow-
ledged, has given, granted, bargained, sold and conveyed, and
by these presents does hereby give, grant, bargain, sell and
convey unto said Grantee, its heirs, successors, admini-
strators and assigns of the survivor of them, all of that
certain piece, parcel or tract of land situate, lying and
being in Upper Little River Township of said County and
State, and more particularly described as follows:
_TRACT 1.:
BEGINNING at a stake thirty feet from the center of
the Atlantic and Western R.R., a corner between Nos. 2
and 3, said corner being 57 chains from the N.E. corner
of the tract; thence lying between Nos. 2 and 3 South
22--1/4 West 35.15 chains to a stake and oak and pine
pointers on the North side of a drain; thence South
6-3/4 East 25.95 chains to a lightwood stake in a field;
thence East 1..60 chains to a P.O. on the line of No. 2;
thence a line between Nos_ 3 and 6 South 12-1/4 West

pointers in old road as formerly located, Byrd's corner
or line; thence Byrd's line North 6-1/2 West 17.40
chains to a stake and pointers on the South side of a
branch at Byrd's corner; thence his line North 31-1/2
West 15.50 chains to a flint road and pointers, a corner
between Nos. 3 and 5; thence a line between said lots to
and with No. 4 North 77 chains to a stake 14.6 feet from
the North rail of R.R.; thence South 88-3/4 East 6.1
chains to a stake on North side of the
Lillington-Sanford Road, Hawley's corner; thence his
line South 16-3'/4 East 3.15 chains (crossing R.R. at
1.20 chains) to a stake in a field; thence South 87-1/4
East 18.87 chains; thence up R.R. 13 chains to the
Beginning, containing two hundred and thirty-nine (239)
acres, more or less. This is the third lot from the
East and second from West and being Lot No. 3 on the map,
filed in Map Book 4, page 60, Public Registry of Harnett
County.
TRACT 2:
BEGINNING at a point in the center of SR 1291,
being a point in the center of intersecting SR 1258;
thence South 5 degrees 30 minutes West 30 feet to a
point in the southern margin of SR 1291; thence South 5
degrees 30 minutes West 42 feet to an iron stake; thence
South 85 degrees 30 minutes West along old Atlantic &
Western Railroad right-of-way 689.2 feet to an old iron
stake, Jenkens Corner; thence North 00 30 minutes West
40.2 feet to the margin of SR 1291; thence North 00
degrees 30 minutes West 30 feet to the center of SR
1291; thence approximately North 84 degrees 30 minutes
East 696.2 feet along the center of SR 1291, to the
BEGINNING, containing .66 acres, more or less.
It is agreed and understood that said property
extends only to the center of the right-of-way of SR
1291.
For reference to chain of title, see second tract
in a deed recorded in Book 280, Page 467, Harnett County
Registry.
TRACT 3'
All that certain tract or parcel of land located
from the centerline of the old Sanford highway (formerly
U.S. 421) (60) and being on the south of said highway
and granted to Betsy Moss Woltz by judgment dated
October 25, 1967, of record in the office of the Clerk
of Superior Court of Harnett County in that certain
action entitled Betsy Moss Woltz vs. Ann Cannady
Jenkins, a minor, and J. E. Jenkins, Guardian Ad Litem
for Anne Cannady Jenkins, the dividing line of which is
described as follows:
BEGINNING at a point in the center of old U.S. 421
in the Jenkins property line, at a culvert, the said
point being located North 4 degrees 40 minutes East 70
feet from an iron stake in the center of the old A & W
right-of-way and runs along the center of said highway
South 88 degrees 40 minutes West 186 feet; thence North
87 degrees 50 minutes West 203 feet; thence North 82
degrees 05 minutes West 203 feet; thence North 79
degrees West 1156 feet to a point in the center of the
road and in the Jenkins property line, said point being
located North 8 degrees 05 minutes East 5 feet from a
nail in the original Moss property line.
it being the intent of Grantors (Jenkins) herein to
convey by fee simple title all property located to the
south of old U.S. 421 (formerly old N.C. 60) and
included in the property allotted to E. G. Moss, known
as Lot 3 of the John Moss division, less and excepting
all property to the north of said highway.
TO HAVE AND TO HOLD the above -described lands and
premises, together with all appurtenances thereunto
belonging, or in anywise appertaining, unto the Grantee, its
heirs, successors, administrators and assigns forever, but
subject always, however, to the limitations set out above.
AND the said Grantor, as Co -Trustees under the Will of
W. G. Woltz, covenants to and with said Grantee, its heirs,
successors, administrators and assigns that it is lawfully
seized in fee simple of said lands and premises, and
individually covenants that it has full right and power to
convey the same to the Grantee in•fee simple (but subject,
however, to the limitations set out above) and covenants as
Co -Trustees (and not individually) that said lands and
premises are free from any and all encumbrances, except as
set forth above, and that it (as Co -Trustees and not
individually) will, and its heirs, successors, administrators
and assigns shall forever warrant and defend the title to the
same lands and premises, together with the appurtenances
thereunto appertaining, unto the Grantee, its heirs,
successors, administrators and assigns against the lawful
