Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 17, 2007 (or as subsequently amended.) The following procedure has been recently implemented by DWQ: Total residual chlorine (TRC) compliance level changed to 50 µg/L. Effective March 1, 2008, the Division received EPA approval to allow a 50 µg/L TRC compliance level. This change is due to analytical difficulties with TRC measurements. Facilities will still be required to report actual results on their monthly discharge monitoring report (DMR) submittals, but for compliance purposes, all TRC values below 50 µg/L will be treated as zero. A footnote regarding this change has been added to the effluent limitations page in the permit. The following modifications included in the August 27th draft permit remain in the final permit: • Effluent limits for cadmium have been dropped from the permit at the 3 MGD permitted flow. This change was based on the results of the reasonable potential analysis (RPA) of submitted data. The RPA showed there was no reasonable potential to exceed the chronic allowable concentration. Cadmium will.continue to be monitored in the pretreatment program short term monitoring plan. • The condition for the submittal of a wastewater management plan has been removed from the permit based on recent upgrades to the treatment facility. • Please .review the language in Special Condition A. 3 and A.4. Chronic Toxicity Permit Limit. There are some minor additions regarding the DWQ forms to be submitted and clarification on reporting pollutant data. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. (3) CHRONIC TOXICITY PERMIT LIMIT (Quarterly at 1.0 MGD) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 45%. The permit holder shall perform at a minimum, quarterlu monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed. If reporting pass/fail results using the parameter code TGP3B, DWQ Form AT-1 (original) is sent to the below address. If reporting Chronic Value results using the parameter code THP3B, DWQ Form AT-3 (original) is to be sent to the following address: Attention: NCDENR/DWQ/Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation 85 reporting of the data submitted on the DMR 8s all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The plant serves approximately 4200 domestic customers in the Town of Rutherfordton and one Significant Industrial User (SIU). The last permit renewal was April 14, 2004. The permit expired on July 31, 2008 and has been administratively extended. The Permittee submitted EPA Form 2A on January 24, 2008 requesting renewal of the permit. The facility's 2004 request (via the Asheville Regional Office) that the flow be phased at 1.0 MGD and 3.0 MGD will be continued in this permit renewal. The condition that when the facility reaches an annual average flow of 0.8 MGD (80% of 1.0 MGD), the limits at 3 MGD will then be implemented also remains in the permit. The facility will be rated as Class III at the lower flow of 1.0 MGD with the appropriate monitoring frequencies. At the higher flow of 3 MGD, the facility will be rated as Class IV. Rutherfordton has a modified pretreatment program with the Division of Water Quality's PERCS Unit. It is recommended that this program continue to be implemented in accordance with the permit. Notes from the April 2004 factsheet: Prior to the 2004 permit renewal, Rutherfordton anticipated the addition of a textile plant, with the flow to be treated at the Rutherfordton WWTP. Accordingly, the Town expanded the plant from 1 MGD to 3 MGD. The industry, however, never relocated to Rutherfordton. Lower than anticipated flows created operational problems at the plant; one described by the regional office is excess aeration which is interfering with the ability of nitrifying bacteria to nitrify. This has resulted in non-compliance with the ammonia nitrogen limit The facility has also experienced a number of compliance problems relating to toxicity failures and BOD violations. Rutherford applied for a Special Order by Consent (SOC) in April 2004 and requested modified limits for BODS, TSS, summer and winter NH3 and chronic toxicity monitoring. The SOC was approved by the Environmental Management Commission and was effective August 1, 2005 and expired August 1, 2007. Fact Sheet NPDES NC0025909 Renewal Page 1 RECEIVING STREAM INFORMATION This facility discharges to Cleghorn • Creek in sub basin 03-08-02 of the Broad River Basin. Cleghorn Creek is classified C waters at the point of discharge. Beginning approximately 0.2 miles downstream of the Rutherfordton WViT P discharge, Cleghorn Creek is listed on the draft North Carolina 2008-303(d) list. (From its confluence with Stonecutter Creek to the Broad River). That segment is impaired in the use support category for aquatic life based in the biological criteria being exceeded. The parameter of interest is the ecological/biological integrity of the benthos. PERMIT LIMITS Existing limits for BOD5, TSS, NH3, DO, fecal coliform TRC, and pH will be renewed in this permit. No changes to these conventional parameters. Effluent monitoring for temperature, TN, TP will remain the same, in addition to instream monitoring for DO, fecal coliform, temperature, and conductivity. INSTREAM MONITORING Upstream: 150 feet above the discharge point Downstream: 300 feet below the discharge point Instream data for dissolved oxygen, temperature, fecal coliform and conductivity were reviewed based on reported Discharge Monitoring Report (DMR) data. A review of the data for the summer months (April through October) and for the years 2006, 2007, and 2008 was done. In 2006, there were no violations of the instream DO standard, upstream or downstream of the WWTP. The fecal coliform standard was exceeded consistently upstream and downstream of the plant, however there were no effluent violations of the fecal coliform limit during this time. It may indicate that fecal violations could be nonpoint source related. In 2007 and 2008, there were (2) recorded instream DO violations, but the instream monthly DO averages were above 6.0 mg/1. All other data indicated that the instream DO standard was met. Again in 2007 and 2008, the fecal coliform standard was exceeded consistently upstream and downstream of the plant. TOXICITY TESTING: Current Requirement(s): Chronic Ceriodaphnia Qrtrly P/F © 45% at 1 MGD Chronic Ceriodaphnia Qrtrly P/F © 71% at 3 MGD Testing during the months of January April July and October. Facility has had a history of toxicity text failures which resulted in copper and zinc limits being placed in the 2004 permit. In 2004, Rutherford failed toxicity tests four times. In 2005, there was 1 Fail, 3 passes. In 2006, all tests were passed. In 2007, there was a FAIL in October 2007 and a No Report (counted as a FAIL) in November 2007. DWQ recommends that the quarterly chronic Ceriodaphnia toxicity tests © 45% (at 1 MGD) and 71% (at 3 MGD) be continued in the renewed permit. _ COMPLIANCE REVIEW Reviewed compliance data and correspondence files from 2006 through 2008. Rutherfordton's compliance with conventional permit limits has improved in the past year based on review of 2008 effluent data. There was only 1 NOV issued for late toxicity testing. In 2007, here were some compliance issues . In April 2007, NOV issued for failure to monitor. Also civil penalties totaling $3000 assessed for violations of the SOC limits. Violations for pH in January and February 2007. Tox test failure in October 2007. In 2006, consistent violations of TSS limits and NH3 limits in first half of the year: 1) TSS violations from Jan. 2006 to April 2006, 2) NH3 violations from January through September 2006, 3) pH violations in July, November and December 2006. Several NOVs issued and civil penalties assessed for permit violations of TRC and NH3 . Fact Sheet NPDES NC0025909 Renewal Page { Notes from 2004 factsheet, background on Cu and Zn limits: As a result of repeated toxicity failures, in March 2003 there was a request to reopen the NPDES Permit and incorporate effluent limitations for copper and zinc. The Town failed to submit TIE rdnta, as required, to rule out copper or zinc as causative of toxicity problems. Tjze Aquatic Toxicology Unit therefore recommended that the permit include limits for these parameters. As calculated by the NPDES Unit, prospective copper and zinc limits would be 25 pg/L and 216,ug/L, respectively (at 3.0 MGD). These limits were also calculated for 1.0 MGD and would be 40 ug/l and 339 ug/I, respectively. REASONABLE POTENTIAL ANALYSES (RPA) RESULTS Reasonable potential analyses were conducted for cyanide and metals on reported discharge monitoring data from January 2006 through June 2008. Results are applicable at both permitted flows of 1 MGD and 3 MGD. • Arsenic, chromium, lead, mercury, nickel, molybdenum and selenium demonstrated no reasonable potential to exceed state water quality standards or acute criteria. Most data were reported below detection levels (exceptions were molybdenum and nickel). No effluent limits or monitoring will be required with the permit, but the City will have to continue to monitor these parameters through the Pretreatment (PERCS) Program's Short Term Monitoring Plan. • Cadmium - the maximum predicted value indicated no reasonable potential to exceed the chronic or acute allowable concentrations. In addition, all 70 reported data values were below detection. Based on this result, it is recommended that the weekly average and daily maximum limits be removed from the permit. Cadmium will continueto be monitored through the Pretreatment (PERCS) Program's Short Term Monitoring Plan. • Cyanide - the maximum predicted value indicated a reasonable potential to exceed both the chronic or acute allowable concentrations. Based on these results, it is recommended that the weekly average and daily maximum limits remain in the permit. At 1 MGD, CN limits will be 11 ug/1 (weekly avg) and 22 ug/1 (daily max.) At 3 MGD, CN limits will be 7 ug/1 (weekly avg) and 22 ug/1 (daily max.) • Silver - the maximum predicted value indicated a reasonable potential to exceed both the chronic or acute allowable concentrations. However, since silver is a NC action level standard, no limit will be recommended unless toxicity can be attributed to elevated effluent silver values. However, twice per month monitoring will remain in the permit. • Copper and Zinc did demonstrate a reasonable potential to exceed both the chronic and acute criteria. In the 2004 permit renewal, after several toxicity test failures and • reviewing TIE studies by the Town, DWQ's Aquatic Toxicology Unit recommended limits for copper and zinc. The limits were based upon re -calculated values that take into account TSS levels for the individual sub -basin. Based on the updated RPA results and toxicity test failures still occurring, it is recommended that limits for copper and zinc remain in the permit. Copper limits at 1 MGD and 3 MGD, will be 40 ug/1 and 25 ug/1, respectively. Zinc limits at 1 MGD and 3 MGD, will be 338 ug/1 and 216 ug/1, respectively. Monitoring frequency will be weekly. SUMMARY OF PROPOSED CHANGES • Additional language regarding sampling for TRC • Deletion of Wastewater Management Plan - based on construction upgrades conducted during the SOC and improved operation and compliance, ARO recommends that the condition for the wastewater management plan be removed. • Elimination of the cadmium limit at 3 MGD flow.
