PROJECT SUMMARY: The applicant proposes to install a private pier with a gazebo, floating dock, boatlift, and boathouse for a total of four formalized slips on the AIWW. PROJECT DESCRIPTION The proposed project is located on the Atlantic Intracoastal Waterway (AIWW) at 427 Shoreline Drive W., on the mainland side of Sunset Beach, Brunswick County. To locate the project site from the Wilmington Regional Office (WiRO), travel southwest from Wilmington to Sunset Beach on US 74 W (Martin Luther King Jr Pkwy) & US 17 S for approximately 45 miles until you reach Ocean Isle Beach Road SW on your left. Travel about 2 miles down Ocean Isle Beach Road SW and then turn right at the round -about onto Old Georgetown Road SW. Go down Old Georgetown Road SW for about 3 miles until you reach Seaside Road SW (NC 179 / NC 904) and make a left at the traffic light. Then travel almost a mile and a half down Seaside Road SW (NC 179 / NC 904) until you get to a traffic circle. Continue straight through the traffic circle and take the next right onto Shoreline Dr. W. The project site will be located a mile down the road on the left. Currently the project site is a vacant lot with mature pine, oak, and hickory species. High ground elevations are approximately l Oft. above the normal high water (NHW) level, and the applicant's entire shoreline (+/- 97 linear ft.) is stabilized by native vegetation. High Marsh Coastal Wetlands within the applicant's riparian corridor include a l Oft. wide swath of Saltmeadow Cordgrass (Spartina patens), Bullrush (Scirpus sp.), and Black Needlerush (Juncus roemerianus). The Low Marsh extends approximately 65ft. waterward of the High Marsh and consists of a dense stand of Smooth Cordgrass (Spartina alterniflora). A 12ft. wide high -ground hummock of oyster shells splits the stand of Smooth Cordgrass in half and runs parallel with the shoreline across the applicant's entire riparian corridor. The proposed docking facility would be located entirely over open water in the AIWW. A residential property borders the project site to the west and a vacant lot sits to the east of the project site. The width of the AIWW measures approximately 580ft. feet from edge of marsh at the proposed project site. The waters of the AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the August 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) or live oyster beds in the surrounding waters. According to the applicant, water depths in the vicinity of the proposed docking facility are approximately -3ft. MLW. DCM staff verified water depths in the project vicinity during a site visit on 9-15-2021 at 10:00am. According to the applicant, tidal amplitude in the project area is approximately 6ft. between NLW and NHW (See Sheet 2 of 2). PROPOSED PROJECT The applicant proposes to install a private pier with a gazebo, floating dock, boatlift, and boathouse for a total of four formalized slips on the AIWW. The applicant proposes to build a 6ft. x 215ft. access pier (as measured from NHW) that would originate from an upland point and extend south into the AIWW. Approximately 208ft. down the access pier, the applicant proposes a gangway extending off the west side of the access pier, leading to a proposed l Oft. x 14ft. floating dock (Slips #1 & #2). The access pier would continue south another 7ft. and terminate with a 12ft. x 12ft. gazebo in line with the adjacent pier head to the west (GP# 48302 issued 5-30-07). To the west of the gazebo, a 12ft. x 12ft. open boatlift would be installed (Slip #3). To the east of the gazebo, the applicant has proposed a 14ft. x 35ft. boathouse to store a 38ft. vessel (Slip #4). Keith & Pamela Harrold September 22, 2021 Page 3 As proposed, the docking facility would be located within the applicant's area of riparian access and would not encroach within either adjacent neighbor's 15ft. riparian setback. No riparian setback waivers were obtained during the application process. The adjacent riparian neighbor to the east of the applicant has sent in a written objection to the proposed docking facility based on the size of the proposed gazebo and boathouse. According to the applicant, water measurements in the vicinity of the floating dock and boathouse show approximately - 3ft. NLW. DCM staff verified water depths in the project vicinity during a site visit on 9-15-2021 at 10:00am. As proposed, the waterward edge of the docking facility would be built in line with the existing pier to the west and terminate approximately 8ft. landward of the USACE 80' Federal Channel Setback. As proposed, the docking facility would extend south approximately 162ft. from the edge of marsh to approximately 28% of the waterbody width. The proposed docking facility would exceed the ''A width of the waterbody but not exceed the 1/3`d width, the pier head line, or the USACE 80' Federal Channel Setback. 10. ANTICIPATED IMPACTS The proposed four -slip docking facility would result in the shading of 390 sq. ft. of Coastal Wetlands and the incorporation of approximately 1,818 square feet of Estuarine Waters and Public Trust Area. As proposed, the docking facility would be located in line with the adjacent pier at 429 Shoreline Dr. W. (GP# 48302 issued 5- 30-07), exceeding the % waterbody width but remaining landward of the 80' Federal Channel Setback and the 1/3`d waterbody width. The proposed four -slip docking facility would be located over an area of open water (-3ft. NLW) in a Primary Nursery Area. The proposed development would be located outside the 15' riparian corridor setbacks to the east and west. Turbidity associated with the piling installation would be kept to a minimum. It was received complete on September 13th, 2021 and appears to be adequate for processing at this time. The projected deadline for making a decision is November 27th, 2021. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from September 13th, 2021 you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
