4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The site is currently an active airport with areas surrounding the runway regularly maintained. An existing fence surrounds much of the airfield, but is not contiguous. The current fence
does not prevent animals from digging beneath and is too low to prevent wildlife from jumping over to access the air field. Shallow ditches are present throughout the area to provide
drainage for the runway and surrounding area. A small portion of the proposed fence will be within a young mixed pine -hardwood forest with a moderately dense shrub under story.
Surrounding land use is mixed residential and agriculture with patches of undeveloped forest. Interstate 795 is located approximately 0.5 miles west of the airport.

To increase airfield safety by construction of a wildlife exclusion fence around the airfield and adjacent hangers and buildings.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The Perimeter Fence project consists of the removal of existing fence and installation of approximately 900 LF of ornamental fence in the terminal area and approximately 18,800 LF of
wildlife fence around the remaining airport perimeter. The existing fence around the airport perimeter is only 3-5 feet tall, wtiich does not provide adequate security. The installation of
the Perimeter Fence project will be packaged and constructed as three (3) separate projects or phases. Phase 1 will consist of all the ornamental fencing and approximately 5,200 LF of
wildlife fence. Phase 2 will consist of approximately 8,000 LF of wildlife fence and Phase 3 will consist of approximately 4,800 LF of wildlife fence. This PCN includes all three construction
phases. The phasing provides better control over disturbed soils and erosion prevention by allowing each phase to be stabilized.

This office concurs with your preliminary jurisdictional determination dated March 20, 2020; and more specifically,
Figure 2. Project Overview, Figure 3.1 Jurisdictional Waters (VV1, D1 and D2) , Figure 3.2 Jurisdictional Waters (UT1),
Figure 3.3 Jurisdictional Waters (D3), Figure 3.4 Jurisdictional Waters (VV2 and D4), and Figure 3.5 Jurisdictional
Waters (W3 and D5).
This email serves as my concurrence for the above referenced project and may be used for planning purposes and
avoidance and minimization. Given my current workload please let me know when/if you need the JD.
The Corps Action ID for the project is: SAW-2017-00770. Please reference this on all future correspondence.
With regard to permitting the perimeter fence, the use of Nationwide Permit 39 (commercial and institutional
developments), and possibly Nationwide Permit 23 (approved categorical exclusions), is most applicable for the
proposed activites. The installation of concrete to support the posts should be counted as permanent impacts, and
any wetland that would be permanently maintained in conjunction with the fence should be considered permanent
conversion. I would be happy to discuss the project further at your request.

Reference your correspondence dated June 12, 2020 in which you requested comments for the referenced project.
Preliminary analysis of the project reveals the potential for multiple impacts to streams, riparian buffers and

Further investigations at a higher resolution should be undertaken to verify the presence of other streams and/or
jurisdictional wetlands in the area. In the event that any jurisdictional areas are identified, the Division of Water
Resources requests that applicant consider the following environmental issues for the proposed project:
Project Specific Comments:
1. The streams and tributaries in the project area are all classified as Nutrient Sensitive Waters (NSW) of the State.
The NCDWR is very concerned with sediment and erosion impacts that could result from this project. The
NCDWR recommends that highly protective sediment and erosion control BMPs be implemented to reduce the
risk of nutrient runoff to these waters. Post -construction stormwater BMPs should, to the MEP, be selected and
designed to reduce nutrients.
2. This project is within the Neuse Basin. Riparian buffer impacts shall be avoided and minimized to the greatest
extent possible pursuant to 15A NCAC 2B.0233. New development activities located in the protected 50-foot
wide riparian areas within the basin shall be limited to "uses" identified within and constructed in accordance
with 15A NCAC .02B .0295. Buffer mitigation may be required for buffer impacts resulting from activities
classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a
variance under the Buffer Rules. A buffer mitigation plan, including use of the North Carolina Division of
Mitigation Services, must be provided to the NCDWR prior to approval of the Water Quality Certification.
Buffer mitigation may be required for buffer impacts resulting from activities classified as "allowable with

mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer
Rules. A buffer mitigation plan, coordinated with the North Carolina Division of Mitigation Services, must be
provided to the NCDWR prior to approval of the Water Quality Certification.
General Transportation Project Comments:
1. The environmental documents should provide a detailed and itemized presentation of the proposed impacts to
wetlands and streams with corresponding mapping. If mitigation is necessary as required by 15A NCAC
2H.0506(h), it is preferable to present a conceptual (if not finalized) mitigation plan with the environmental
documentation. Appropriate mitigation plans will be required prior to issuance of a 401 Water Quality
Certification.
2. Environmental impact statement alternatives shall consider design criteria that reduce the impacts to streams
and wetlands from storm water runoff. These alternatives shall include road designs that allow for treatment
of the storm water runoff through BMPs as detailed in the most recent version of the North Carolina
Department of Transportation Stormwater Best Management Practices Tool box manual, such as grassed
swales, buffer areas, preformed scour holes, retention basins, etc.
3. After the selection of the preferred alternative and prior to an issuance of the 401 Water Quality Certification,
the applicant is respectfully reminded that they will need to demonstrate the avoidance and minimization of
impacts to wetlands (and streams) to the maximum extent practical. In accordance with the Environmental
Management Commission's Rules (15A NCAC 2H.0506[h]), mitigation will be required for impacts of
greater than 1 acre to wetlands. In the event that mitigation is required, the mitigation plan shall be designed
to replace appropriate lost functions and values. North Carolina Division of Mitigation Services may be
available for assistance with wetland mitigation.
4. In accordance with the Environmental Management Commission's Rules (15A NCAC 2H.0506[h]),
mitigation will be required for impacts of greater than 300 linear feet to any perennial stream. In the event
that mitigation is required, the mitigation plan shall be designed to replace appropriate lost functions and
values. The North Carolina Division of Mitigation Services may be available for assistance with stream
mitigation.
5. Future documentation, including the 401 Water Quality Certification Application, shall continue to include an
itemized listing of the proposed wetland and stream impacts with corresponding mapping.
6. The NCDWR is very concerned with sediment and erosion impacts that could result from this project. The
applicant shall address these concerns by describing the potential impacts that may occur to the aquatic
environments and any mitigating factors that would reduce the impacts.
7. An analysis of cumulative and secondary impacts anticipated as a result of this project is required. The type
and detail of analysis shall conform to the NC Division of Water Resource Policy on the assessment of
secondary and cumulative impacts dated April 10, 2004.
8. The appliacant is respectfully reminded that all impacts, including but not limited to, bridging, fill, excavation
and clearing, and rip rap to jurisdictional wetlands, streams, and riparian buffers need to be included in the
final impact calculations. These impacts, in addition to any construction impacts, temporary or otherwise,
also need to be included as part of the 401 Water Quality Certification Application.
9. Sediment and erosion control measures should not be placed in wetlands or streams.

10. Borrow/waste areas should avoid wetlands to the maximum extent practical. Impacts to wetlands in
borrow/waste areas will need to be presented in the 401 Water Quality Certification and could precipitate
compensatory mitigation.
11. The 401 Water Quality Certification application will need to specifically address the proposed methods for
stormwater management. More specifically, stormwater shall not be permitted to discharge directly into
streams or surface waters. Please refer to the most recent version of the North Carolina Department of
Transportation Stormwater Best Management Practices Toolbox manual for approved measures.
12. Based on the information presented in the document, the magnitude of impacts to wetlands and streams may
require a Nationwide Permit (NW) application to the Corps of Engineers and corresponding 401 Water
Quality Certification. Please be advised that a 401 Water Quality Certification requires satisfactory protection
of water quality to ensure that water quality standards are met and no wetland or stream uses are lost. Final
permit authorization will require the submittal of a formal application by the applicant and written
concurrence from the NCDWR. Please be aware that any approval will be contingent on appropriate
avoidance and minimization of wetland and stream impacts to the maximum extent practical, the development
of an acceptable stormwater management plan, and the inclusion of appropriate mitigation plans where
appropriate.
13. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact between
curing concrete and stream water. Water that inadvertently contacts uncured concrete shall not be discharged
to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. Concrete shall
be handled in accordance with the NPDES Construction General Permit NCG010000.
14. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction contours
and elevations. Disturbed areas shall be seeded or mulched to stabilize the soil and appropriate native woody
species shall be planted. When using temporary structures the area shall be cleared but not grubbed. Clearing
the area with chain saws, mowers, bush -hogs, or other mechanized equipment and leaving the stumps and root
mat intact allows the area to re -vegetate naturally and minimizes soil disturbance.
15. Unless otherwise authorized, placement of culverts and other structures in waters and streams shall be placed
below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and
20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow
passage of water and aquatic life. Design and placement of culverts and other structures including temporary
erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or
streambeds or banks, adjacent to or upstream and downstream of the above structures. The applicant is
required to provide evidence that the equilibrium is being maintained if requested in writing by the NCDWR.
If this condition is unable to be met due to bedrock or other limiting features encountered during construction,
please contact the NCDWR for guidance on how to proceed and to determine whether or not a permit
modification will be required.
16. If multiple pipes or barrels are required, they shall be designed to mimic natural stream cross section as
closely as possible including pipes or barrels at flood plain elevation, floodplain benches, and/or sills may be
required where appropriate. Widening the stream channel should be avoided. Stream channel widening at the
inlet or outlet end of structures typically decreases water velocity causing sediment deposition that requires
increased maintenance and disrupts aquatic life passage.
17. If foundation test borings are necessary; it shall be noted in the document. Geotechnical work is approved
under General 401 Certification Number 4085/Nationwide Permit No. 6 for Survey Activities.

18. Sediment and erosion control measures sufficient to protect water resources must be implemented and
maintained in accordance with the most recent version of North Carolina Sediment and Erosion Control
Planning and Design Manual and the most recent version of NCS000250.
19. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP measures
from the most current version of the NCDOT Construction and Maintenance Activities manual such as
sandbags, rock berms, cofferdams and other diversion structures shall be used to prevent excavation in
flowing water.
20. While the use of National Wetland Inventory (NWI) maps, NC Coastal Region Evaluation of Wetland
Significance (NC -CREWS) maps and soil survey maps are useful tools, their inherent inaccuracies require
that qualified personnel perform onsite wetland delineations prior to permit approval.
21. Heavy equipment should be operated from the bank rather than in stream channels in order to minimize
sedimentation and reduce the likelihood of introducing other pollutants into streams. This equipment shall be
inspected daily and maintained to prevent contamination of surface waters from leaking fuels, lubricants,
hydraulic fluids, or other toxic materials.
22. Riprap shall not be placed in the active thalweg channel or placed in the streambed in a manner that precludes
aquatic life passage. Bioengineering boulders or structures should be properly designed, sized and installed.
23. Riparian vegetation (native trees and shrubs) shall be preserved to the maximum extent possible. Riparian
vegetation must be reestablished within the construction limits of the project by the end of the growing season
following completion of construction.

SUBJECT: Request for Environmental Scoping for Removal and Installation of Fencing at Wayne
Executive Jetport, Wayne County, DEQ Project No. 20-0283.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject
document. Comments are provided in accordance with provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661-667e), North Carolina Environmental Policy Act (G.S.
113A-1 through 113A-10; 1 NCAC 25) and North Carolina General Statutes (G.S. 113-131 et seq.).
The Wayne Executive Jetport Airport proposes to remove the existing airport fencing and install 1,000
linear feet of ornamental fence and approximately 18,800 linear feet of wildlife exclusion fence. The
work will be conducted in 3 phases. The airport is located at 240 Aviation Road NE, north of Goldsboro.
The NCWRC offers the following recommendations to minimize impacts to sensitive aquatic and
terrestrial wildlife resources:
1. Maintain a minimum 100-foot undisturbed, native, forested buffer along perennial streams,
and a minimum 50-foot buffer along intermittent streams and wetlands. Maintaining
undisturbed, forested buffers along these areas will minimize impacts to aquatic and
terrestrial wildlife resources. Wide riparian buffers are helpful in maintaining stream bank
stability. In addition, these buffers provide a travel corridor for wildlife species. Lay down
and staging areas should be located outside wetland areas and at least 100 feet from stream
banks. In addition, heavy machinery and equipment should remain outside of any wetland
areas.
2. The project footprint should have updated surveys for wetlands and streams to ensure there
are no impacts to surface waters. In addition to providing wildlife habitat, wetland areas and
streams aid in flood control and water quality protection. United States Army Corps of
Engineers Section 404 Permits and NC Division of Water Resources Section 401
Certifications are required for any impacts to jurisdictional streams or wetlands.

3. If pesticides or chemicals will be used for site maintenance, stormwater runoff from the site
should be funneled to bio-retention areas prior to discharge to streams or wetlands.
Pesticides, fertilizers and other chemicals should not be used near streams.
4. Sediment and erosion control measures should be installed prior to any land -disturbing
activity. The use of biodegradable and wildlife -friendly sediment and erosion control devices
is strongly recommended. Silt fencing, fiber rolls and/or other products should have loose -
weave netting that is made of natural fiber materials with movable joints between the vertical
and horizontal twines. Silt fencing that has been reinforced with plastic or metal mesh should
be avoided as it impedes the movement of terrestrial wildlife species. Excessive silt and
sediment loads can have detrimental effects on aquatic resources including destruction of
spawning habitat, suffocation of eggs and clogging of gills.

The Division of Waste Management, Solid Waste Section (Section) has reviewed the EA
documents for the subject project in Wayne County, NC. Based on the information provided in
these documents, the Section at this time does not see an adverse impact on the surrounding
communities and likewise knows of no situations in the communities, which would affect this
project.
As always for any planned or proposed projects, it is recommended that during any land clearing,
demolition and construction, the Wayne Executive Jetport and/or its contractors would make
every feasible effort to minimize the generation of waste, to recycle materials for which viable
markets exist, and to use recycled products and materials in the development of this project
where suitable. Any waste generated by and of the projects that cannot be beneficially
reused or recycled must be disposed of at a solid waste management facility permitted by
the Division. The Section strongly recommends that the Wayne Executive Jetport require
all contractors to provide proof of proper disposal for all generated waste to permitted
facilities.

Project Description
The Wayne Executive Jetport Airport currently has a lot of issues with wildlife presence on the airfield.
The USDA APHIS Wildlife Services completed a Wildlife Hazard Site Visit (WHSV) on January 7, 2019.
One of the recommendations in the WHSV report was the installation of wildlife fencing around the airport
perimeter to stop deer from entering the airfield.
The Perimeter Fence project consists of the removal of existing fence and installation of approximately
1,000 LF of ornamental fence in the terminal area and approximately 18,800 LF of wildlife fence around
the remaining airport perimeter. The existing fence around the airport perimeter is only 3-5 feet tall, which
does not provide much security. Also, the wildlife fence is needed around the airport's perimeter to keep
deer and coyotes off the airfield to avoid hazards caused by the presence of wildlife.
The Perimeter Fence project will be packaged and constructed as three (3) separate projects. Phase 1 will
consist of all the ornamental fencing and approximately 5,200 LF of wildlife fence. Phase 2 will consist of
approximately 8,500 LF of wildlife fence and Phase 3 will consist of approximately 5,100 LF of wildlife
fence.
An environmental evaluation has been completed and the entire project footprint is within airport
property. The existing fence is currently within a maintained perimeter around the airfield, hangers, and
terminal. Approximately 2,500 LF of fence will be within a new corridor that requires clearing of mature
loblolly pine trees and shrubs. Using the on State Historic Preservation Office on-line GIS map service,
there are no known protected sites located within one half mile of the project. No historic buildings or
structures that appeared to be 50 years or older were observed in the project area and the wildlife fence
project does not impact any historic sites.

Subject: Updated list of threatened and endangered species that may occur in your proposed
project location or may be affected by your proposed project
To Whom It May Concern:
The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.

Not all Threatened and Endangered Species that occur in North Carolina are subject to section 7
consultation with the U.S Fish and Wildlife Service. Atlantic and shortnose sturgeon, sea
turtles,when in the water, and certain marine mammals are under purview of the National Marine
Fisheries Service. If your project occurs in marine, estuarine, or coastal river systems you should
also contact the National Marine Fisheries Service, http://www.nmfs.noaa.gov/

Wayne Executive Jetport -Perimeter Wildlife Exclusion Fence
The Wayne Executive Jetport wishes to construct a perimeter fence
project to enclose the airport property by constructing a wildlife exclusion
fence. This project will consist of constructing approximately 19,550
linear feet of wildlife exclusion fencing surrounding the perimeter of
airport property of which approximately 2,500 feet will be on new
alignment. The fence will tie into existing new fencing behind new
hangers currently being constructed to provide a continuous perimeter
fence. The existing perimeter fence is inadequate for wildlife exclusion
and has structure failure at numerous points. Within the new alignment, a
proposed 20-foot-wide corridor is anticipated to allow for access to
inspect, repair, and maintain.
The proposed fence will in large part replace the failing and inadequate
existing 4-foot chain -link fence. The new fencing will consist of 8-foot
chain -link fence with post set concrete and extend 2 to 3 feet at a 45-
degree angle underground to prevent animal digging beneath the fence.
