Subject: Unified Development Ordinance Revisions Approval
Dear Mr. Sullivan:
The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed and approved the
proposed revisions to Goldston Unified Development Ordinance (and supporting information) that pertain
to water supply watershed protection received by our office on May 5, 2021 and September 17,
2021. We accept the proposed revisions to sections 8.1.3-Exemptions to Applicability, 8.1.4-Repeal of
Existing Watershed Ordinance, 8.1.9-General Definitions and 8.5. 1 -Watershed Administrator and Duties
Thereof.
DEMLR approved the revisions to the ordinances in accordance with North Carolina General Statute 143-
214.5 and North Carolina Administrative Code 15A NCAC .0100, .0200, .0620-.0624. Specifically, 15A
NCAC 2B .0623 (4) requires that all ordinance revisions be approved by Environmental Management
Commission (EMC) or its designee. Please note that the local government may adopt and
begin to implement the revised ordinances prior to receiving approval by the Commission or its
designee.
On July 12, 2007, the EMC issued a decision to delegate approvals under the Water Supply
Watershed rules to the Director of Division of Water Quality (DWQ). On August 1, 2013, this delegation
was transferred from DWQ to DEMLR.
