Facility Summary
This facility is a minor facility (flow < 1 MGD) discharging 100% domestic wastewater, plus filter
backwash generated from private water supply wells using ion exchange treatment technology. This facility
has a design capacity of 0.0416 MGD but is permitted to expand to a 2nd phase flow capacity of 0.075
MGD upon submitting an EAA and receiving an ATC from DWR. The permit has undergone two
modifications (in 2017 and 2018) since last renewal, which added water treatment plant POCs following the
permitting strategy for ion exchange technology, and radiological POCs in accordance with the December
5, 2006 memo, "Disposal Wastewater Associated with Private Water Supply Wells". A CORMIX model
was also submitted in February 2019 for dilution credit for Lake Wylie (Catawba River). This WWTP
utilizes the following treatment units:

Permit Flow Conditions
Effluent flow is permitted as Phase 1 and Phase 2 (see Part I), and limited at 0.0416 MGD [Section A. (1.)]
and 0.075 MGD [Section A. (2.)]. The permit includes a condition [Part I, Section A. (3.)] for phased
construction when flow reaches 80% design capacity. At no time may the flow tributary to the facility
exceed the design capacity of the existing units. An engineering alternatives analysis (EAA) is required
[Part I, Section A. (4.)] prior to expansion above 0.0416 MGD in accordance with the Lake Wylie
Management Plan [EPA Approved: 2/5/1996]. The Management plan recommends TP limit of 2.0 mg/L
which will be applied to expansion above 0.075 MGD. Expansion requires the Division's Authorization to
Construct (ATC) permit and subsequent submittal of an Engineer's Certification Form (see Supplement to
Permit Cover Sheet).
Permit Modification Summary
A permit modification issued on April 24, 2017 included the addition of the filter backwash from the
water supply well sources. In accordance with the water treatment plant strategy for ion exchange
technology systems, monitoring and limits for Copper, Fluoride, Chloride, and Zinc, as well as
monitoring for Total Hardness and Chronic WET Testing (IWC of 90%), were added to Part I, Section A.
(1) and A. (2). The additional WTP strategy parameters Turbidity, Salinity and Conductivity that are not
already being monitored at the Harbor Estates WWTP were not included for this permit modification
because of the small volume and episodic duration of the filter backwash introduction. This modification
also included the addition of radiological monitoring with limits for Combined radium-226 and radium-
228, Alpha emitters (excluding radon and uranium), Beta emitters (excluding potassium-40 and other
naturally occurring radionuclides), Strontium-90, Tritium, and Uranium to Part I, Section A. (1) and A.
(2)., in accordance with the Division's December 5, 2006 Memo for Disposal Wastewater Associated
with Private Water Supply Wells (with potential radiology components). Narrative Standards for
Radiological POCs are found at 15A NCAC 02B .0211 (17). Maximum contaminant level (MCL) for
these Radiological POCs are applied as permit limits without benefit of dilution in the receiving stream.
The MCL of 30 µg//L for Uranium is based on EPA Federal Criteria [40 CFR 141.66]. For more
information on federal guidance and rules see EPA 816-F-01-003 and 40 CFR Parts 9, 141, and 142.
A permit modification issued on February 28, 2018 included the addition of a compliance schedule for
the new Total Copper and Total Chloride limits with an expiration date of June 30, 2020, as the WWTP
plant was not meeting limits for Copper and Chlorine with 100% domestic wastewater with no addition of
filter backwash wastewater form the potable water systems. This modification also included a technical
correction for the Strontium-90 limit to 8 pCi/L (as annual average).
Renewal Summary
This renewal required adjustments to limits based on new knowledge of dilution available in Lake Wylie.
Previously, no dilution credit was given in calculating limits for metals or other parameters. Aqua submitted
a CORMIX model in February 2019 which demonstrated that dilution is available in Lake Wylie (Catawba
River).
Proposed Changes:
• Removed limits for Total Copper, Total Fluoride, Total Chlorides, and Total Zinc from the
effluent tables in Section A. (1.) and A. (2.) as they did not demonstrate reasonable
potential to exceed applicable water quality standards/criteria. Quarterly monitoring for
these parameters is still required, as requested by the Mooresville Regional Office.
• Added monthly monitoring for Salinity, Conductivity, and Total Dissolved Solids in the
effluent tables in Section A. (1.) and A. (2.), per water treatment permitting strategy for
facilities discharging treated backwash from ion -exchange technology.

• Corrected sample type to `Composite' for the radiological parameters in the effluent tables
in Section A. (1.) and A. (2.), as per 15A NCAC 2B .0505.
• Removed A. (2.) Schedule of Compliance permit condition and corresponding footnote as
the permittee no longer has limits for the two parameters, Total Copper and Total Chloride.
• Section A. (6.) Chronic Toxicity Pass/Fail Monitoring has been updated with the new IWC
of 7.9%, to reflect the new dilution credit applied, and the new electronic submission
information for testing results.
• Updated Section A. (7.) Electronic Reporting of Discharge Monitoring Reports to reflect
current federal requirements.
Compliance History
Harbor Estates WWTP has had no enforcements since 1998. Most recent inspection (September 2019)
revealed the facility to be non -compliant due to the internal metal structure of the aeration basin being
severely corroded, including a significant hole in one of the aeration basins.
Two violations have been issued since last permit renewal:
• July 2016 — PC violation — Failure to register and submit eDMRs
• September 2019 — O&M violation — corrosion of metal structure of aeration basins
CORMIX Model
The model that was submitted suggests a dilution factor of 12.6 for both flow tiers, using a calculated
discharge rate of 0.120 MGD (pumping rate of 83 gallons per minute), and is achieved at a ZID (zone of
initial dilution) of 0.90 meters downstream from the outfall.
Whole Effluent Toxicity (WET) Testing
In accordance with current strategies designating this influent as a "complex waste stream," WET testing
is required in this permit as fresh water Chronic [TGP3B] Quarterly monitoring [15A NCAC 02B .0500
et seq.] with Ceriodaphnia dubia. Using information from the recently submitted dilution model, this
renewal modifies WET testing requirements to an effluent concentration of 7.9%. (Section A. (6.)).
This facility has passed 14 out of 16 toxicity tests between July 2017 and October 2020.
RPA /WOBELs for Hardness -Dependent Metals — Freshwater
The need for toxicant limits is based upon a demonstration of reasonable potential to exceed water quality
standards, a statistical evaluation that is conducted during every permit renewal utilizing the most recent
effluent data for each outfall. The RPA is conducted in accordance with 40 CFR 122.44 (d) (i). The NC
RPA procedure utilizes the following: 1) 95% Confidence Level/95% Probability; 2) assumption of zero
background; 3) use of'h detection limit for "less than" values; and 4) stream flows used for dilution
consideration based on 15A NCAC 2B.0206. Effective April 6, 2016, NC began implementation of
dissolved metals criteria in the RPA process in accordance with guidance titled NPDES Implementation of
Instream Dissolved Metals Standards, dated June 10, 2016.
A reasonable potential analysis was conducted on effluent toxicant data collected between June 2017 and
Dec 2020. Pollutants of concern included toxicants with positive detections and associated water quality
standards/criteria. Based on this analysis, the following permitting actions are proposed for this permit:
• Total Chloride — no reasonable potential to exceed water quality standards; predicted max < 50%
of allowable concentration; monitoring kept at quarterly at the request of Mooresville Regional
Office
• Total Copper — no reasonable potential to exceed water quality standards; predicted max < 50% of
allowable concentration; monitoring kept at quarterly at the request of Mooresville Regional Office

Harbor Estates WWTP
The North Carolina Environmental Management Commission proposes to issue
a NPDES wastewater discharge permit to the person(s) listed below. Written
comments regarding the proposed permit will be accepted until 30 days after
the publish date of this notice. The Director of the NC Division of Water Re-
sources (DWR) may hold a public hearing should there be a significant de-
gree of public interest. Please mail comments and/or information requests to
DWR at the above address. Interested persons may visit the DWR at 512 N.
Salisbury Street, Raleigh, NC 27604 to review information on file. Additional
information on NPDES permits and this notice may be found on our website:
http://deq.nc.gov/about/d ivisions/water-resources/water-resources-perm its/
wastewater-branch/npdes-wastewater/public-notices,or by calling (919) 707-
3601. Aqua North Carolina, Inc. applied to modify NPDES permit for Harbor
Estates WWTP [NC0063860], Pine Harbor Rd, Charlotte, Mecklenburg County,
discharging treated wastewater to Catawba River (Lake Wylie), Catawba River
Basin. Currently Biochemical Oxygen Demand (BOD), Ammonia Nitrogen, Fecal
Coliform, Dissolved Oxygen (DO), Total Residual Chlorine (TRC), Combined ra-
dium-226 and radium-228, Alpha emitters (excluding radon and uranium), Beta
emitters (excluding potassium-40 and other naturally occurring radionuclides),
Strontium-90, Tritium and Uranium are water -quality limited. This discharge may
affect future wasteload allocations in this portion of Catawba River (Lake Wylie).
