Subject: The replacement of Bridge No. 50 over Johnsons Mill Run on NC 33 in Pitt County; TIP B -5418; DWQ project number 13-
0845
Dear Mr. Johnson:
The Division of Water Resources has reviewed your submittal for a 401 Water Quality Certification and Tar- Pamlico Buffer
Authorization, for the aforementioned project. Review of your application revealed it lacking necessary information required for
making an informed permit decision. The permit application was deficient in the following areas:
1. Ditches and Swales. New ditches are shown on the BSR but not on the plan sheet. The BSR references Detail 2, however that
nor any other information about ditches is included with the application. According to 15A NCAC 2B .0259 (6), new ditches are
allowable only if they provide for nitrogen control and attenuate now. Grassed swales can used to meet these requirements at a
ratio of 100 linear feet of swale per acre of drainage to each respective new ditch line. If swales are to be used, please provide the
necessary information regarding Swale dimensions and drainage area.
2. Pipes. The plan sheets show removal of two pipes under the access driveways on the north side of the bridge. These driveway
accesses are often relocated to accommodate longer guardrails. Please provide any information regarding the replacement of these
pipes including sizes and location. There is also a pipe discharge in the southwest quadrant that is in disrepair. This pipe is not
shown on the plan sheet. Please provide any information regarding the replacement of this pipe.
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the
necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the
information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you
are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water
Resources, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
