Stormwater ATC Project No. SWA000109

Dear Mr. Lambert:
The Central DEQ Office received and accepted a State Stormwater Fast Track Process:
"Authorization to Construct" (ATC) Permit Application for the subject project on July 7, 2021. A
preliminary in-depth review of that information has determined that the application is not
complete and additional information is needed to determine whether the project complies with 15A
NCAC 02H.1043. To continue the review, please provide the following additional information:
Please revise the application form to address the following deficiencies:
a. Under "B. General Information" on Page 1, please add the nearest city name.
b. Under Part D.5 on Page 3, please list the name of the licensed professional who
signed the Designer's Certification and will be responsible for ensuring that the
project meets the design criteria upon completion.
c. Under Part D.5 on Page 3, please add a phone number at which the licensed
professional can be reached.
d. Under "E. Project Information", Low Density is checked, but according the project
summary and the BUA percentage, this site is a high density site. Please correct this.
2. When the applicant is a corporation or LLC, documentation from the NC Secretary of State
or other official documentation showing the titles and positions held by the person who
signed the application is required. Because the business registration from the NC Secretary
of State does not list Brian Massengill as a company official, other documentation from the
LLC will be required to verify that he has the authority to sign on behalf of the LLC.
3. When a complete application is received, a hardcopy of the permit will be mailed to the
permittee. Two different addresses are given for the responsible party (one in Gaithersburg,
MD and one in Cary, NC). Please specify to which address the permit should be sent.
Please remember to confirm that any revised information is presented consistently throughout the
application documents. Please also remember to provide two hard copies and one electronic copy
of any updated or requested documents per 15A NCAC 02H.1043(3).

The requested information should be received in this Office by September 5, 2021, or the
application will be returned as incomplete. The return of a project will necessitate resubmission of
all required items, including the application fee. Please note that the Division is allowed 30 days
from the receipt of a complete application to issue the authorization to construct permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.
