This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in Non -discharge Permit No. WQ0013348. The findings and comments noted during this inspection are provided in the enclosed copy of the inspection report entitled "Compliance Inspection Report". The facility was found to be noncompliant with Non -discharge permit WQ0013348. Please respond in writting to this office within 30 days of your receipt of this letter regarding your plans or measures to be taken to address the following issues: During the compliance evaluation of Pamlico Regional WWTF on 09/17/2021 it was found 2 of the 9 aerators permitted for Bayboro WWTF were not operational. This is a violation of permit condition III.1 During the compliance evaluation of Pamlico Regional WWTF on 09/17/2021 the liner of the northeast corner of the Bayboro WWTF Lagoon was found to be extensively torn. The facility was found to be non -compliant with permit #WQ0013348. Below is a summary of the findings and observations made during the inspection. The Bayboro lagoon liner was still extensively torn in one corner. Eric Harper stated that the facility just recently received funding from FEMA to repair the liner. Additionally, it was observed that only 7 of the 9 aerators permitted for the system were in operation at Bayboro WWTF. This is a violation of permit condition 111.1. The 2 aerators being down out of the 9 permitted and torn lagoon liner are the major reasons the facility was found to be noncompliant with permit #WQ0013348. It should also be noted that the Bayboro WWTF has had extensive limit violations for BOD over the last 12 months and the facility should be utilizing all permitted aerators to help remedy this Issue. This is als an additional reason the facility was found to be noncompliant with permit #WQ0013348. The July 2021 NDMR, July 2021 GW-59 and 03/2021 NDMR reports were spot checked with corresponding lab data with no discrepancies found. Operations and Maintenance logs and ORC visitation logs for the Bayboro WWTF, Oriental WWTF and the Arapahoe Irrigation Facility were available and complete. The facility keeps also records for at least 5 years. A 12-month violation record review for the facility showed that Pamlico Regional WWTF received 1 Notice of Deficiencies, 5 Notice of Violations and 4 Notice of Violation with Intent to the enforce. These notices were issued mainly due to BOD limit violations at Bayboro WWTF, Freeboard Violations for the storage lagoon during February2021 and March 2021 and for a bypass incident on 08/23/2021.The facility has also not been obtaining annual soil reports as required by the permit. This was discussed with ORC Eric Harper.
