The property is currently a mix of timbered and forested land, with recent construction of Leonard Wiggins Parkway along its northern extents. General land use within the vicinity of the project includes primarily agricultural operations with other manufacturing and distribution facilities in the area. The proposed project has an existing Approved Jurisdictional Determination (SAW-2021-01227) that shows the wetlands that are to be impacted as (b)(1) non -adjacent waters. This permit application is to request approval from NCDEQ under 15A NCAC 02H .1300 as Isolated Wetlands. See cover letter for additional details. 4b. The manufacturing and warehouse facilities would then be constructed in two phases, both of which are shown in this application. Due to the processes involved in the County's economic development efforts, the eventual owner and user of the site is currently withheld until agreements are finalized, and the site development is named Project Eagle. This project would bring economic benefit to Edgecombe County including 510 newjobs with approximately $105,000,000 dollars in corporate investment. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* Project Eagle would entail the clearing and grading of an approximately 110 acre area and the construction of a 603,200 square foot manufacturing and 539,400 square foot warehouse facility, along with associated transport, parking, and ancillary features such as stormwater management devices. The project would also involve the construction of a 12" gravity sanitary sewer line east of the facility. This utility would then be bored under Walnut Branch and its associated wetlands in order to connect to existing infrastructure on the site. A rail spur would be constructed from the southeast edge of the site to the facility. Site grading would require typical equipment such as dump trucks, excavators, and graders. Installation of the proposed sanitary sewer line would involve the use of excavators and drilling/boring equipment. 5. Jurisdictional Determinations 5a. The park's transportation and utility infrastructure were initially developed in conjunction with the Triangle Tire facility and R-5868, which were issued an Individual Permit, Individual Water Quality Certification, and Major Buffer Variance in 2017. No additional impacts to Waters of the US or State riparian buffers are proposed for the development of Project Eagle, and therefore no modification to the prior permits are required. D. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Although this proposed project will permanently impact 1.62 acres of isolated wetlands, it has been designed to avoid impacts to all Section 404 jurisdictional wetlands and streams on the property. Avoidance of the isolated wetland features would result in Pad C being unusable for a large business or industry. Other uses, such as residential development are not appropriate within the business park. Final design of the facility and associated grading plans wiIl be developed after the agreement for the site is finalized and prior to construction commencing, and will ensure that no impacts to WOTUS occur. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The sewer connection will utilize subsurface construction techniques (directional drill or bore) to avoid impacts to the stream and wetland east of the construction site. All un-impacted resources will be clearly marked with tree protection or other high visibility fencing to ensure encroachment into those areas does not occur. Sediment and erosion control measures will be constructed, inspected, and maintained throughout construction, and will not be located in jurisdictional areas. 2. (CEI), in conjunction with Appian Engineers, has prepared the associated electronic Pre -Construction Notification (e-PCN) for Edgecombe County in order to acquire an Isolated Wetlands Permit for the above -referenced project. Preliminary Construction Plans Project Eagle is an economic development effort by the County to attract and secure industry investment in the Kingsboro Business Park. At this time the proposed user is considering two sites, one of which is this project, but has not made a final selection. Therefore, the end -user of the site has been withheld from the application at this time, and the County is applying for this permit as the site owner. Preliminary plans have been developed to provide sufficient documentation that the site can be developed without impacts to Waters of the US (WOTUS). The isolated wetlands are located in the center of the site, and avoidance and minimization of impacts to those features is not practical due to this location. Final plans will be developed by the user's engineers and reviewed/approved by the County prior to construction. A final construction plan set, including approved stormwater management plan, can be provided if requested to ensure compliance with issued approvals. Note that this site is Pad C of the Kingsboro Business Park, formerly known as the Kingsboro CSX Select Site or Industrial Park. Initial development of the park infrastructure (transportation and sewer) were permitted in conjunction with the Triangle Tire facility being constructed to the east of this site. The Park's Individual 404 Permit (AID SAW-2008-02741), Individual Water Mr. Rick Trone Project Eagle Page 2 of 2 September 27, 2021 Quality Certification (DWR# 20180133v3), and Major Buffer Variance (DWR# 20180133v2) do not require modification for the development of Project Eagle, as only Isolated Wetlands are proposed to be impacted. The USACE issued an Approved Jurisdictional Determination (AID 2021-01227) for this site on July 19, 2021. The proposed wetland impacts are classified as (b)(1) Non -Adjacent Waters under this AJD. After issuance of the AJD, Carolina Ecosystems staff reviewed the site (August 16, 2021), and it is our professional opinion that the wetlands proposed for impact are Isolated and subject to 15A NCAC 02H.1300. All wetlands were assessed on foot and any potential connection or drainage to downstream waters was evaluated in the field and using GIS information. As can be seen in the enclosed LiDAR map (Figure 5), there is no evident connection to downstream waters. One small ditch was evident in the center of the wetland areas using GIS data, but in the field was not connected to any of the wetland features. Some anecdotal evidence suggests that at least portions of the wetland areas were affected or created by borrow activities associated with the adjacent US 64 Highway construction. However, documentation of these activities is not available, therefore we are considering the wetlands as Isolated, and classified as Basin Wetlands under the NC Wetland Assessment Method, for the processing of this permit application. This information, along with the associated e-PCN are being submitted for your review of this project. Note that the US Army Corps of Engineers is also copied on this submittal, and a Nationwide Permit is "checked" on the e-PCN as the submittal process seems to require selection of an NWP. A note was added regarding this in the e-PCN, and we are not requesting authorization to impact any WOTUS. The area generally drains to the north into unnamed tributaries of Walnut Creek, which is part of the Tar River Basin. b. Wetlands shown have been delineated and confirmed by the US COE per SAW-2008-02741. Tar -Pam riparian buffers shown have been verified by NCDEQ DWR per TBRRO#18-005 (2/15/18). No disturbance of wetland, stream or riparian buffers is allowed without permits from COE/DWR. c. STORMWATER: Site disturbance exceeds 0.5 acre, therefore Edgecombe County stormwater management requirements apply. The site is in the Tar -Pamlico Watershed. Prior to final site plan approval, detailed stormwater management plan with supporting calculations will be required demonstrating compliance with nutrient management and peak flow attenuation requirements. 9. EROSION CONTROL: a. The disturbed area for this project is greater than 1 acre. Therefore, a formal Sedimentation and Erosion Control Plan and permit is required prior to any grading or construction on the site. Contractor is responsible for containing all erosion and sedimentation within the project limits. b- Erosion control is under the jurisdiction of NCDEQ Raleigh Regional Office (permit approval pending).
