Subject: Request for Authorization of Vegetation Management for PNC Gas Pipeline Right -of -Way,
Line 513, Neuse River Buffer
Dear Mr. Lawler:
On August 12, 2013 this Office received your request for maintenance cutting of vegetation along
Piedmont Natural Gas Pipeline 5B (Project 91357 -13 -007). It is noted that Line 5B was constructed in
1959, prior to the buffer rules, and has been maintained with a 50 foot right -of -way (ROW). In accordance
with 15A NCAC 02B .0233, (3) (b) (i) the subject pipeline ROW predates the riparian buffer rules and the
existing uses are present and ongoing; therefore, the 50 foot ROW is exempt from the Neuse River
Riparian Buffer Rules. In addition, you should obtain or otherwise comply with any other required federal,
state or local permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control, Non - discharge regulations.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B
.0233. This letter does not authorize any impacts to either Waters of the United States or Waters of the
State. Please contact the US Army Corps of Engineers (USACE) or NC Division of Water Resources
(DWR) if any impacts are proposed to either of these waters. If you have any questions, please telephone
