Dear Mr. Brown and Ms. Burdette:
Attached is a complete PCN Application package and the Corps of Engineers' Jurisdictional
Determination for the FLS- Battleground Solar Site. This site is located at 929 York Road in
Kings Mountain, just under the intersection for Interstate 85 and Route 161. This site is located in
Cleveland and Gaston Counties (Parcel IDs: 12653, 62472). The 25.55 acre site will be
developed into a solar facility.
The only proposed impact to jurisdictional areas of this site is one road crossing on one stream
channel as shown on the attached maps. Stream impacts total 27 linear feet. Impacts to
jurisdictional areas have been minimized to the maximum extent practicable. The road system has
been designated to cross each channel at a perpendicular angle and located so as to minimize the
amount of fill needed to cross the stream valleys.

The site is currently an abandoned livestodc pasture with dear fields. There are four wetlands and four streams of interest located on the site, as well
as a small pond. The terrain is mostly flat, and trees are located along the southern boundary of the site and the eastern comer of the site.

C. Basis For Determination
The site contains wetlands as determined by the 1987 Corps of Engineers Wetland Delineation Manual and the Interim
Regional Supplement to the Corps of Engineers Wetlands Delineation Manual: Eastern Mountain and Piedmont Region. These
wetlands are abutting to stream channels located on the property that exhibit indicators of ordinary high water marks and have
perennial flow. The stream channels on the property are unnamed tributaries (UT) to the Crowders Creek, relatively perment
waters (RPW), which flow into Crowders Creek (RPW), and then into the Catawba River a Section 10 water, The Catawba
River joins the Santee Cooper River in South Carolina before entering the Atlantic Ocean. The UTs to Crowder Creek, on the
property, have bed and bank, are blue line features on the USGS 7.5 minute topographic quadrangle map, and exhibit
indicators of ordinary high water mark.
D. Remarks:
The waters of the U.S., at this site, were verified on -site by the Corps on July 10, 2013 and are as depicted on the attached
Wetland Delineation Map, surveyed by Justin F. Cloninger, PSL, datcd April 18, 2013 and revised June 21, 2013 (Sheets 1
through 8).
E. Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the
particular site identified in this request. The delineation/determination may not be valid for the wetland conservation
provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation
in USDA programs, you should request a certified wetland determination from the local office of the Natural Resources
Conservation Service, prior to starting work.
