event, but the plans weren’t notated. We will have them note as such on the plans, and comment to

Dave,
We are in the process of preparing our permit application for U-5738 (Julian Rod widening) in Rowan
County. We completed our JD and MCDC (SEPA documentation) in 2017. During preparation of our
permit package, we discovered that Town Creek was added to the 303d list for turbidity on the 2020
list. It was not there for turbidity prior to that. We have already designed the EC plan and are preparing
to let in February 2022. I know DSSW is typically required for projects with streams that are on the
303d list for turbidity. Redesigning the EC plan to meet DSSW at this time could cause delays to our
project schedule. Can you tell me if the project would be grandfathered due to the recent change in
listing for the DSSW requirements? I know DWR does grandfather for buffer rules based on document
date, and wanted to see if it was possible to apply the same logic here. Please advise as soon as
possible. We have to turn in our plans soon to meet the let date, and are very concerned that the let
date might be in jeopardy if we have to redesign the EC plans.
